Review of Drawings. ‌ (a) The Concessionaire shall promptly and in such sequence as is consistent with the Construction Requirements, submit a copy of each of the drawings as mentioned in the Schedule 6 to the Independent Engineer and the Lead ULB.‌ (b) By forwarding the drawings to the Independent Engineer and the Lead ULB pursuant to the preceding Clause 12.4.2 (a), the Concessionaire shall be deemed to have represented that it has verified and determined that the drawings forwarded are in conformity with the Construction Requirements. (c) Within 15 days of receipt of the drawings, Independent Engineer shall review the same taking into account, inter-alia, comments of the Lead ULB, if any, thereon, and convey its comments / observations to the Concessionaire on the conformity of drawings with Construction Requirements. If the comments / observations of the Independent Engineer indicate that the drawings are not in conformity with the Construction Requirements, such drawings shall be revised by the Concessionaire to the extent necessary and resubmitted to Independent Engineer for further review. The Independent Engineer shall give its observations and comments, if any, within 15 (fifteen) days of receipt of such revised drawings, which shall be taken into account by the Concessionaire while finalising the drawings.‌ (d) If, within the period stipulated in the preceding Clause 12.4.2 (c), the Independent Engineer does not respond to the drawings submitted to it by the Concessionaire shall be entitled to proceed with the Construction Works on the basis of such drawings submitted by it to the Independent Engineer, and intimate the same to the Lead ULB. The same should be highlighted in the periodic reporting by the Concessionaire. (e) Notwithstanding any review or failure to review by or the comments / observations of the Independent Engineer or the Lead ULB, the Concessionaire shall be solely responsible for the adequacy of the drawings and their conformity with the Construction Requirements, and shall not be relieved or absolved in any manner whatsoever of any of its obligations hereunder. (f) The Concessionaire shall be responsible for delays in meeting the Construction Requirements caused by reason of any drawings not being in conformity with the Construction Requirements, and shall not be entitled to seek any relief in that regard from the Lead ULB. By forwarding drawings to the Authority, the Operator shall be deemed to have represented that it has verified and determined that the drawings forwarded are in conformity with the design requirements. (ii) Within 15 days of receipt of the drawings, the Authority shall review the same and convey its comments and/or observations to the Operator on conformity of the drawings with the design requirements. If the comments and observations of the Authority indicate that the drawings are not in conformity with the design requirements, such drawings shall be revised by the Operator to the extent necessary and resubmitted to the Authority for further review. The Authority shall give its observations, if any, within 15 days of receipt of the revised drawings, which shall be taken into account by the Operator while finalising such drawings. If the Authority does not respond within the period stipulated as above, the Operator shall proceed with the Project on the basis of such drawings submitted by it to the Authority. (iii) Notwithstanding any review or failure to review by the Authority, the Operator shall be responsible for the adequacy of the drawings and their conformity with the design requirements and shall be responsible for delays in meeting the design requirements caused by the drawings not being in conformity with the design requirements. (iv) Within 90 days of COD, the Operator shall furnish to the Authority three copies of “as built” drawings duly verified by a Technical Agent, including, without limitation, an “as built” survey illustrating the layout of the Project and setback lines, if any, of the buildings and structures forming part of the Facilities reflecting the Project as actually designed, engineered and constructed.
Review of Drawings. (a) No later than 60 days after the end of each calendar year, the Contractor will submit to Hydro’s Representative for Review a full set of the Marked-Up IFC Drawings and Record Drawings for Work completed during that year, as follows: (i) two copies of each drawing in hard copy form; (ii) one electronic copy of each Marked-Up IFC Drawing and any supplementary Drawing in its native Autodesk Design Review format, or other native file format Accepted by Hydro’s Representative; and (iii) one electronic copy of each Record Drawing in its native AutoCAD 2014 file format, or other native file format Accepted by Hydro’s Representative. (b) Hydro’s Representative, acting reasonably, may at any time request copies of the Record Drawings and Marked-Up IFC Drawings for review. The Contractor will submit electronic copies of the requested drawings no later than 72 hours after the later of: (i) receiving such a request; or (ii) expiry of the applicable seven day period referred to in Section 3.3(a) of this Schedule 6 [Specifications and Drawings].

(ii) By forwarding the Drawings to the Project Engineer and KDA pursuant to the preceding sub-article (i), the Contractor shall be deemed to have represented that it has verified and determined that the Drawings forwarded are in conformity with the provisions of this Agreement including the Applicable Laws. (iii) The Contractor shall be responsible for any errors in the Drawings at all times and shall correct/ rectify any defects or damage to the Works due to such error at its cost and expense.

If the comments and observations of the Contracting Authority indicate that the drawings are not in conformity with the design requirements, such drawings shall be revised by the Private party to the extent necessary and resubmitted to the Contracting Authority for further review. The Contracting Authority upon receiving approval of PPP Centre shall give its observations, if any, within 15 days of receipt of the revised drawings, which shall be taken into account by the Private party while finalising such drawings; (iii) notwithstanding any review or failure to review by the Contracting Authority, the Private party shall be responsible for the adequacy of the drawings and their conformity with the design requirements and shall be responsible for delays in meeting the design requirements caused by the drawings not being in conformity with the design requirements; (iv) the detailed project report, design and drawings referred to under para (a) and (b) of this clause save for small scale PPP Projects shall be subject for approval within twenty one (21) working days by the PPP Steering Committee after the recommendations submitted by the PPP Centre.;
Review of Drawings. 10.4.1 Architect shall participate in a review session with Owner’s Designated Representatives at the end of each Review Period. Owner will provide its review comments to Architect on the form used by Owner for internal document review, and Architect shall provide a detailed written response to each of Owner’s review comments and shall incorporate into the Construction Documents such corrections and amendments as Owner requests, unless Architect reasonably objects to such changes in writing and Owner agrees to the objections. 10.4.2 Owner’s approval of revised documents submitted by Architect pursuant to Section 10.4.1 shall not constitute or be deemed an approval of any unlisted changes, and any costs or expense for any Additional Services subsequently required and/or rendered for such unlisted changes shall be Architect’s sole responsibility. 10.4.3 Architect shall identify to Owner in writing anything in Architect’s drawings and specifications and any other drawings, plans, sketches, instructions, information, requirements, procedures, requests for action and other data supplied to Architect (by Owner or any other party) that Architect regards as unsuitable, improper or inaccurate in connection with the purposes for which such documents or data are furnished. Architect shall be solely responsible for the use of such documents or data unless Architect advises Owner in writing that in its opinion such documents or data are unsuitable, improper, or inaccurate and Owner instructs Architect in writing to proceed in accordance with the documents or data as originally provided. 10.4.4 Subsequent phases shall not begin until the prior phase has been approved by Owner, in writing, and written instructions to proceed with the subsequent phase have been delivered.
