SPECIFICATIONS AND DRAWINGS. (a) Seller shall be furnished the number of drawings and specifications specified in Division One at no cost.
(b) Seller shall keep on the work site a copy of the drawings and specifications and shall at all times give Company access thereto. Anything mentioned in the specifications and not shown on the drawings, or shown on the drawings and not mentioned in the specifications, shall be of like effect as if shown or mentioned in both. In case of difference between drawings and specifications, the specifications shall govern. Within the specifications, Division One shall govern. In case of discrepancy in the figures, in the drawings, or in the remainder of the specifications, the matter shall be promptly submitted to the Technical Project Officer and the Procurement Officer, who shall promptly make a determination in writing. Any adjustment by Seller without such a determination shall be at its own risk and expense. Company shall furnish from time to time such detailed drawings and other information as considered necessary, unless otherwise provided.
(1) The drawings and specifications incorporated into this Agreement are intended to include everything requisite and necessary to complete the entire work properly, notwithstanding the fact that every item necessarily involved may not be specifically mentioned.
(2) Omissions from the drawings or specifications or the misdescription of details of work that are manifestly necessary to carry out the intent of the drawings and specifications, or that are customarily performed, shall not relieve Seller from performing such omitted or misdescribed details of the work, but they shall be performed as if fully and correctly set forth and described in the drawings and specifications.
(3) The specifications and drawings may identify and list quantities of items to be furnished and installed by Seller. These identifications may be incomplete and the quantities are estimates only. Seller is responsible for furnishing the items and quantities manifestly necessary to carry out the intent of the drawings and specifications.
(4) The drawings furnished by Company are, in general, to scale. Scales shown on a microfilmed reproduced drawing change in proportion to the reduction of the drawing from original size. Figured dimensions shall always be followed and the drawings not scaled.
(5) Prior to fabricating any item (structural steel, piping, ductwork, etc.), Seller shall field-verify all dimensions critical to the installation. ...

SPECIFICATIONS AND DRAWINGS. The specifications and drawings are intended to cover all of the work that is known to be required to effect a complete installation. They are intended to be mutually explanatory of each other, but should any discrepancy or inconsistency appear or any misunderstanding arise as to the import of anything contained in either the specifications or the drawings, the interpretation of the doubtful portions will be made by the Engineer, whose decision shall, in all cases, be final and binding on the Contractor. Any materials or workmanship obviously necessary to satisfactory completion shall be furnished and installed whether or not specifically shown or mentioned. Any corrections of errors or omissions in the specifications or drawings, or both, may be made by the Engineer when such correction is necessary for the proper fulfillment of their intention as determined by him/her. Figures shall have preference over scale in reading dimensions. Copies of the specifications and drawings shall be kept constantly at the work. Any supplementary or detail drawings which may be made by the Engineer subsequent to the date of this contract, relating to the work herein contemplated, as showing more particularly the details of the work to be done, or specifications and the drawings furnished by the Contractor and approved by the Engineer, are, and are to be held to be, controlling parts of this contract insofar as they do not conflict with other provisions of the contract. If the Contractor, in the course of the work, finds any discrepancy between the plans and the physical conditions of the locality, or any errors or omissions in the plans or in the layout as given by the points and instructions furnished by the Engineer, it shall be his duty to inform the Engineer, in writing, and the Engineer shall promptly verify the same. Any work done after such discovery, until authorized, will be done at the Contractor's risk.
SPECIFICATIONS AND DRAWINGS. (a) All descriptive and shipping specifications, drawings, dimensions and weights submitted by Nepean in relation to any quotation are approximate only and any descriptions, illustrations and data contained in any catalogues price lists and/or other advertising or promotional material are intended by Nepean only to present a general view of the Goods and/or Services described therein and none of such specifications, drawings, dimensions, weights, descriptions, illustrations or data shall form part of any contract arising between Nepean and the Purchaser.
(b) In Supplying the Goods and/or Services the subject of the contract between Nepean and the Purchaser, Nepean may provide such drawings relating to the Goods and/or Services as Nepean deems in its sole discretion are reasonable and necessary. Any and all Intellectual Property Rights in any drawings supplied by Nepean shall remain vested in Nepean.
(c) All information relating to any patents, designs, drawings, specifications, computer software or code, information, samples and the like provided by Nepean shall be treated by the Purchaser as confidential and shall not be copied or disclosed by the Purchaser to a third party.
(d) The Purchaser's Order shall be accompanied by sufficient information, drawings and data to enable Xxxxxx to commence work and proceed with the work without interruption. The Purchaser shall be solely responsible for, and warrant, the accuracy of the information it provides.
(e) Any drawings or other information requiring the Purchaser's approval shall be approved, amended or rejected and returned to Nepean within 7 days of the date of receipt by the Purchaser of such drawings or other information requiring approval.
(f) Unless Nepean has expressly agreed otherwise in writing, Xxxxxx makes no representation nor gives any warranty in respect of fitness for any specific purpose or particular use.
(g) Unless otherwise expressly agreed in writing it is Purchaser’s responsibility and cost to obtain and provide any licences, access, approvals or permits as necessary for performance of any contract arising between Nepean and the Purchaser.
(h) Any performance figures provided by Xxxxxx are based on the Nepean's experience and are not guaranteed performance figures. In case of discrepancy either in the figures, in the drawings, or in the specifications, the matter shall be promptly submitted to the City, who shall promptly make a determination in writing. Any adjustment by Job Order Contractor without such a determination shall be at its own risk and expense.

Contractor shall maintain at the Plant Site a copy of the "approved for construction" working specifications and drawings (including "as-built drawings") applicable to the Work with all changes and modifications, and shall at all times, give Owner access thereto. Anything mentioned in the specifications and not shown on the drawings or shown on the drawings and not mentioned in the specifications, shall be of like effect as if shown or mentioned in both.
8.3.1 As-Built" Drawings. Contractor shall provide and keep at the Plant Site a complete "as-built" record set of drawings (also called "record drawings") that shall be updated periodically. The drawings shall reflect exact and actual "as-built" conditions of construction, installation, and erection as it progresses. Where drawings are not adequate to show "as-built" conditions, Contractor shall prepare sketches which delineate the necessary "as-built" information. Contractor shall furnish two (2) sets of all paper "blue-line" prints "approved" drawings for use in accomplishing specified xxxx-up. Final "as-built" drawings, and a computerized disk of such drawings, shall be delivered to Owner by Contractor on or before Final Completion. Notwithstanding the foregoing, with respect to the Existing Work, Owner has provided Contractor with certain "as-built" drawings and Contractor's responsibilities with respect to such drawings shall be limited to updates as necessary to reflect modifications to the Existing Work or conditions identified by Contractor through the course of performance of the Work.

In case of discrepancy either in the figures, in the drawings, or in the specifications, the matter shall be promptly submitted to Xxxxxxx’x Authorized Representative, who shall promptly submit them to Engineer for a determination in writing. Any adjustment by Job Order Contractor without such a determination shall be at its own risk and expense.
4.2 Wherever in the specifications or upon the drawings the words "directed," "required," "ordered," "designated," "prescribed," or words of like import are used, it shall be understood that the "direction," "requirement," "order," "designation," or "prescription," of Gilbert or Xxxxxxx’x Authorized Representative is intended and similarly the words "approved," "acceptable," "satisfactory," or words of like import shall mean "approved by," or "acceptable to," or "satisfactory to" Gilbert or Xxxxxxx’x Authorized Representative, unless otherwise expressly stated.
SPECIFICATIONS AND DRAWINGS. Specifications and drawings related to the Goods that are prepared by Seller are the sole and exclusive property of Seller and are subject to recall at any time before Xxxxx’s acceptance thereof. Buyer shall make no use of such specifications or drawings, except as expressly authorized by Seller. Buyer shall not disclose or publish such specifications or drawings to any other party without Seller’s prior written approval. Buyer shall not directly or indirectly use such specifications or drawings in any way detrimental to Seller’s interest.
SPECIFICATIONS AND DRAWINGS. 44.1 ALSTOM shall keep at the work site a copy of the Contract, its supplementary documents, specifications, and drawings, and shall keep available for the Engineer at all times.
44.2 Anything called for in the specifications and not shown in the drawings, or shown in the drawings and not mentioned in the specifications shall be deemed to have been called for or shown in both. In case of any difference between drawings and specifications, the specifications shall govern. In case of discrepancy in the specifications and drawings, the matter shall immediately be submitted to the Engineer, without whose decision said discrepancy in the specifications and drawings shall not be adjusted by ALSTOM, and ALSTOM shall not proceed with the work affected thereby until he has received written orders from the Engineer.
44.3 The Engineer will, from time to time, furnish such additional detailed drawings or other information as he may consider necessary for carrying out the work.
