SECTION 2 - DEFINITION. Seniority shall be defined as the Employee's total compensated (not including overtime) hours from the last date of hire within the bargaining unit for all Employees on a system-wide basis regardless of any changes in classification. All compensated holidays, vacation, sick leave, and workers compensation hours shall be computed as seniority hours. Voluntary leave status and involuntary leave status shall also be computed as seniority hours. In addition, if an Employee is scheduled for hours of work that do not include time for a rest period and/or a meal period, the hours worked during the rest period and/or meal period shall be computed as seniority hours if such time is compensated. No employee shall accrue more than seventy-five (75) hours of seniority per pay period. An Employee leaving the bargaining unit for a non-bargaining unit GHI position on or after February 19, 1999 shall have his/her seniority restored, excluding time spent outside of the bargaining unit, if he/she returns to the bargaining unit within six (6) months of leaving the bargaining unit. Such Employees shall not be able to use previously earned seniority until six (6) months after re-entering the bargaining unit.
SECTION 2 - DEFINITION. A grievance is a difference or dispute between the parties or between the employer and an employee concerning the application, meaning or interpretation of the express terms of this Agreement.
SECTION 2 - DEFINITION. A grievance under this Agreement is a written dispute, claim or complaint arising under and during the term of this Agreement and filed by an authorized representative of the Organization and an employee must sign same if the grievance affects that specific employee alleging a breach of a provision(s) of this contract. Grievances are limited to matters of interpretation or application of express provisions of this Agreement. The parties recognizing that an orderly grievance procedure is necessary, agree that each step must be adhered to as set forth herein or the grievance is forfeited. All grievances must be filed within ten (10) working days after occurrence of the circumstances giving rise to the grievance. Otherwise the right to file a grievance is forfeited and no grievance shall be deemed to exist.
