A copy of 5 any document in the personnel file shall be made available to the employee, upon request, at the 7 information contained in the file. The employee will be notified of the entry of any derogatory 8 information into the employee's personnel file within twenty (20) work days of such entry. Any 9 derogatory information, of which the employee is not advised, shall not be relied upon in matters of 10 discipline. Employees, at their discretion, may add materials which they deem appropriate.
Section 3.6. Personnel Files. 37 There shall be only one (1) official personnel file for each employee, to be kept in the District 38 Administration Office. Employees, upon request, have the right to inspect all contents of their 39 complete personnel files kept at the District Office, in the presence of an administrator or district 40 representative. During the review, employees shall be allowed to request copies of any material therein 41 and shall be permitted to make a written inventory of any material there, and, on request, have such 42 inventory signed and dated by a district representative. An official or representative of the Association 43 may be present during the review. Copies provided to the employee will be at District expense.

Any material relating to an employee’s health or medical issues shall 15 be maintained in a separate secure, confidential file to which only the superintendent or the 16 superintendent’s designee, shall have access once the material has been filed.

Said employee or former employee may be 37 accompanied by another person for said inspection provided that the Human Resource Services 38 Department receives not less than a twelve (12) hour notification. 40 No secret, duplicate, alternate or other personnel file, except for yearly information accumulated for 41 the annual evaluation and for material relating to an employee’s health and medical issues as provided 42 below, shall be kept anywhere in the District. Employees shall receive a copy of all material placed in 43 their personnel file and shall have the opportunity to attach written comments. Written comments will 44 be initialed and dated. 46 Any material relating to an employee’s health or medical issues shall be maintained in a separate 47 secure, confidential file to which only the superintendent or superintendent’s designee shall have 48 access once the materials have been filed.
