Section E. Bumping. The employee scheduled for layoff may elect to either accept layoff or bump to the least senior position in a former classification in his/her Agency or work location (or Department, in the Department of Natural Resources, unless a secondary agreement is in effect) as provided in this Section. An employee scheduled for layoff who fails or is unable, in accordance with Section C.3., to exercise the option to bump to the least senior position in a former classification shall be laid off. For purposes of this Article, the least senior position is defined as:

Section E. Bumping. ‌ Bumping will occur in the following sequence: Step I: The employee will bump into the least senior position in the layoff unit at a lower level within their current class series. This does not apply to a pre-authorized class series. Step II: If the employee cannot exercise a bump at Step I, then the employee may bump into the least senior position in the layoff unit in a former class series. Step III: If the employee cannot/will not exercise a bump at Step II, then the employee will bump into the least senior position in their current class and level on a statewide basis. Step IV: If the employee cannot exercise a bump at Step III, then the employee will bump into the least senior position in their current class at a lower level on a statewide basis. This does not apply to a pre-authorized class series. Step V: If the employee cannot exercise a bump at Step IV, then the employee will bump into the least senior position in a former class series on a statewide basis. If an employee has no bump within his/her current employment type at Steps I and II, then he/she may elect to bump into another employment type before having to exercise a statewide bump at Steps III, IV, or V. Bumping between employment types shall occur at the layoff unit only, by seniority, in the following sequences: A. Full-time shall bump full-time first, and then less than full-time. B. Less than full-time shall bump less than full-time first, and then full-time. If an individual being afforded the opportunity to bump declines such a bump at any time, Management may retain the “less” senior individual that would have been laid off by such bump on a temporary basis until a permanent recall can occur. Absent a permanent recall within thirty (30) calendar days, the less senior employee may remain in the position unless, such less senior employee chooses to immediately exercise his/her bumping rights during his/her next working day. The employee’s potential bump chain shall not be recomputed. In the event of multiple vacancies within an affected classification, employees may list available locations by order of preference. To the extent vacancies are available, employees will be bumped into vacancies based on their preference by order of seniority.
Section E. Bumping. 19 The employee scheduled for layoff under Section D. may elect to either accept 20 layoff or bump in accordance with the process outlined in this Section.

  • Bumping The employee scheduled for layoff under Section D. may elect to either accept layoff or bump in accordance with the process outlined in this Section. An employee scheduled for layoff who fails or is unable, in accordance with Section D.3., to exercise the option to bump to the least senior position shall be laid off. Within seven calendar days of receipt of notification of layoff, the employee scheduled for layoff shall notify the Employer of his/her decision to either accept layoff or bump within his/her current class series, as listed below. Alternatively, an employee may bump into the least senior position in the layoff unit in a former class series at or below any level at which the employee had satisfactorily completed the required probationary period. This alternative shall not apply to employees who were demoted from the higher paying class for disciplinary reasons or who transferred from the higher paying classification in less than satisfactory employment status. An employee seeking to bump into another position must meet all requirements in accordance with Section D.3. As a result of bumping, an employee shall not earn more than the maximum rate of the lower classification bumped into or more than the rate previously earned in a higher classification from which the employee bumped. When an employee bumps downward, he/she shall be paid at that step in the lower level pay range which credits the service in the higher level range(s) to the step at which the employee was paid when promoted from a lower level. The Employer shall identify the vacancies and least senior employees within the layoff unit equal to the number of positions being abolished within the layoff unit. These least senior employees shall be issued layoff notices. 2. If the layoff unit contains more than one work location, employees remaining in the layoff unit who are displaced from their original work location (due to the closure, reduction consolidation, etc.), will be placed in existing vacancies or the vacated positions identified in step 1 above. Placement into these positions shall be in seniority order based on preferences provided by the employees. 3. Employees remaining in the layoff unit may request an exchange transfer (one for one transfer) with any bargaining unit member in the same classification in accordance with Article 15 Part D §A.6., either within or outside the layoff unit. Exchange transfers shall not be unreasonably denied and will be processed with the rest of the layoff unit moves, if possible. In addition, during the bump process, exchange transfers occurring within this Article shall supersede all other closer to home and seniority based transfers or recalls, as no vacancy exists. Requests for exchange transfers shall be in writing by both employees requesting to exchange. 4. The parties may reach mutual agreement to modify the process to minimize impact on affected employees as necessary.

  • Tariff Elimination 1. Except as otherwise provided in this Agreement, neither Party may increase any existing customs duty, or adopt a new customs duty, on an originating good. 2. Except as otherwise provided in this Agreement, each Party shall progressively eliminate its customs duties on originating goods in accordance with the Tariff Elimination Schedule established in Annex III.04.2. 3. Upon the request of any Party, the Parties shall consult to consider the possibility of accelerating the elimination of customs duties set out in Annex III.04.2 or incorporating into one Party’s Tariff Elimination Schedule goods not subject to the elimination schedule. An agreement between the Parties to accelerate the elimination of a customs duty on a good or to include a good in a Party’s elimination schedule shall supersede any duty rate or staging category determined pursuant to their Schedules for such good when approved by each such Party in accordance with its applicable legal procedures. 4. The agreement adopted based on paragraph 3, regarding the accelerated elimination of a customs duty for an originating good, shall prevail over any customs duty or tariff elimination schedule set out in the Annexes to this Article. 5. Notwithstanding paragraphs 1 and 2, any Party may maintain or increase a customs duty as authorised by the Dispute Settlement Understanding of the WTO, or any other agreement under the WTO Agreement. 6. Originating goods produced in free trade zones in the territory of a Party shall be subject to the most favoured nation treatment (MFN tariff) when imported into the territory of the other Party, except for the products included in Annex III.04.6, which shall benefit from the Tariff Elimination Schedule. 7. The Parties agree that, from the date of entry into force of this Agreement, and in accordance with the functions assigned to the Joint Council in Article I.06.8(a), upon request of either Party, the Joint Council may meet with the purpose of including other goods into Annex III.04.6.

  • Dumping If a Party finds that dumping, within the meaning of Article VI of GATT 1994 is taking place in trade relations governed by this Agreement, it may take appropriate measures against that practice in accordance with Article VI of the GATT 1994 and the rules established by agreements related to that Article.

  • Unbundled Voice Loops (UVLs) 2.2.1 BellSouth shall make available the following UVLs:

  • Switching and Tagging Rules Each Party shall provide the other Parties a copy of its switching and tagging rules that are applicable to the other Parties’ activities. Such switching and tagging rules shall be developed on a non-discriminatory basis. The Parties shall comply with applicable switching and tagging rules, as amended from time to time, in obtaining clearances for work or for switching operations on equipment.

  • Unbundled Digital Loops 2.3.1 BellSouth will offer Unbundled Digital Loops (UDL). UDLs are service specific, will be designed, will be provisioned with test points (where appropriate), and will come standard with OC and a DLR. The various UDLs are intended to support a specific digital transmission scheme or service. 2.3.2 BellSouth shall make available the following UDLs, subject to restrictions set forth herein:
