Shift Work. (1) Except as varied by this Clause, all other aspects of Section 4 of the Agreement shall apply to the working of shift work. (2) The Company has the right to direct Employees to work shift work as required and the Employees shall work the shift work as directed. Shift Work.
(1) Except Where agreed between Employer and Employee, shift work may be worked to meet exceptional circumstances, such as varied by this Clause, all other aspects of Section 4 where general site conditions prohibit the performance of the Agreement work during ordinary hours. Nothing in this clause shall apply be taken to limit the working of shift work.
(2) The Company has the right Employer’s ability to direct Employees to work shift work as required and utilising overtime provisions to perform the Employees shall work the shift work as directedin question outside ordinary hours. Shift work must be for no less than 1 week at a time and always for a full week. No shift work will be undertaken during the ordinary hours of work, being 6:00 am to 6:00 pm, or between noon Saturday and 6:00 am Monday. No shift shall be for more than 8 continuous hours, excluding meal breaks. The unpaid crib break of shift workers shall be 45 minutes or, where the Employer and Employees agree, 30 minutes to suit particular circumstances. Employees performing shift work will receive normal daily fares and travel. There will be one 30-minute paid break in lieu of all other rest and meal breaks. Alternatively, the Employer and Employee may agree to have two paid rest breaks of 10 minutes each per day, one in the first half of the day and one in the second half of the day , as well as an unpaid meal break of not less than 30 minutes, to be taken between noon and 1:00 pm. No Employee will work more than 4 hours without a break. An Employee required to work overtime for at least 1.5 hours after working ordinary hours will be paid a meal allowance in accordance with Appendix 3 plus an additional meal allowance for each subsequent 4 hours worked. The Employer may provide a meal(s) instead of paying an allowance. When an Employee is rostered to work 3 or more hours overtime the Employee is entitled to a paid rest break of 20 minutes immediately after ordinary hours ceasing time. Where this break is not taken, the 20 minutes will be added to the total overtime worked and paid for in accordance with this subclause.

Shift Work.
(1) Except as varied by this Clause, all other aspects of Section 4 of the Agreement The following conditions shall apply to shift work:
17.1 The ordinary hours of the particular shifts should be the subject of Agreement between the employer, except where employees are working shift hours as determined by the roster applying to the majority of shift workworkers at the employee’s workplace.
(2) The Company has 17.2 Thirty minutes crib time shall be granted in respect of each shift of eight hours. Employees working twelve hour shifts shall be allowed reasonable crib breaks as agreed between the right to direct Employees to work shift work as required employer and the majority of the employees in the enterprise or part of the enterprise concerned.
17.3 Employees working afternoon or night shift over a five day roster shall be paid the following shift allowances, calculated as a percentage of the ordinary rate of salary for the appropriate job classification:
17.4 In this clause the following definitions apply:
17.5 An employee working a non-continuous shift roster which requires work the shift work as directed. Shift work on either Saturday or Sunday but not both days will be paid a shift allowance for each shift worked on either Saturday or Sunday. The Allowance will be reviewed annually.
17.6 An employee working a non-continuous shift roster which requires work on both Saturday and Sunday will be paid a shift allowance for each shift worked on both Saturday and Sunday. Such payments are in lieu of the allowances provided for in 17.3. The Allowance will be reviewed annually.
17.7 For the purpose of this clause, Saturday or Sunday shifts are those shifts occurring between twelve midnight Friday and 11.00 p.m. Sunday, or 8.00
17.8 Employees working a seven day continuous roster shall be paid an allowance in lieu of afternoon and night shift allowances, weekend penalty rates and payment for any rostered overtime shift included in the cycle. This allowance shall be determined at each location by the employer and the Association. Provided that employees working a seven day continuous roster which operates over a four week, 38 hours per week, roster cycle shall be paid a shift allowance of 40% of ordinary salary for time worked.
17.9 Shift allowances prescribed by this clause will not be payable where the time worked attracts an overtime payment in accordance with this subclauseAgreement.

Shift Work.
(1) Except as varied by this Clause, all other aspects Notwithstanding the provisions of Section 4 of the Agreement shall apply to the working of Clause 6. - Overtime hereof workers may be employed -
(a) on "regular shift work" that is in regular rotation from week to week on two or three shifts spread over 16 or 24 hours respectively, day shift to be worked between 7.30am to not later than 3.30pm; afternoon shift between 3.30pm to not later than 11.30pm and night shift from 11.30pm to not later than 7.30am.
(b) On "Casual Shift Work" that is on one weekly shift only worked in any department, casual day, afternoon and night shifts to start and finish at the times respectively referred to in the preceding paragraph.
(2) The Company has In the right to direct Employees to work shift work as required case of both regular and the Employees shall work the shift work as directed. Shift work will be worked and paid for in accordance with this subclause.
(3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as such.
(4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. (5) Prior to the commencement of casual shift work, the Company shall seek the agreement first shift of the Employees involved. Failing agreement, week will begin on Sunday at 11.30pm and the Company will provide to the Employees concerned one (1) week's notice last shift of the commencement of shift work week shall finish at 11.30pm on Friday. Duty Rosters shall be posted on Friday in each week and shall show the starting and finishing times of Ordinary Hours each worker during each week. Particulars relating to these starting and finishing times shall be rigidly adhered to.
(3) The provisions contained in the previous subclause of this clause may be varied by mutual agreement between the shiftsemployer and the Union.
(4) All workers employed on regular day shift work shall be paid an allowance equal to ten percent of their ordinary weekly rate of pay.
(5) All workers employed on a regular afternoon shift shall be paid an allowance equal to 15 percent of their ordinary weekly rate of pay.
(6) Where less than five (5) consecutive shifts are worked then Employees All workers employed on casual afternoon shift work shall be paid at overtime rates in lieu an allowance equal to 17½ percent of the shift loading prescribed at subclause (7) their ordinary weekly rate of this clause. (7) A All workers employed on regular night shift Employee shall receive a flat loading of twenty-five (25) be paid an allowance equal to 17½ percent of their Ordinary Hourly Rate for each hour workedordinary weekly rate of pay.
(8) Employees working All workers employed on casual night shift shall be entitled paid an allowance equal to stop work for a half-hour without deduction 20 percent of pay for the purpose their ordinary weekly rate of taking a meal breakpay.
(9) The Company may stagger A crib time of 30 minutes shall be allowed to all workers on regular or casual shift. Crib time shall be included in the times for Employees to take meal breaks to meet operational requirementsworking time.
(10) The Company additional allowances mentioned in subclauses (4), (5), (6), (7) and (8) hereof shall structure be taken into consideration in calculating overtime rates for any overtime for work done beyond eight hours per day on Mondays to Fridays inclusive. Except as aforesaid the Project Working Hours above allowances shall not be included for Employees working the purpose of calculating any other penalty rates under this Agreement.
(11) Where less than five consecutive afternoon or five consecutive night shifts are worked, workers employed on such afternoon or night shifts shall be paid for such shifts at overtime rates; provided that time not worked on a Saturday or a Sunday shall not constitute a break in the sequence of shifts for the purpose of this subclause.
(12) Workers on regular afternoon shift in the case of two roster shifts or on regular night shift to include one (1) half-hour rest break to work - the cause of 3 roster shifts work the week following the afternoon shift work or the night shift as the case may be taken without deduction of pay by Employees working the Project Working Hours on any night day shift.

Shift Work. 19.1 Employees may be required to work shift work under a roster (or as otherwise directed).

19.7 Subject to any individual flexibility arrangement made under this Agreement and the accrual of RDOs under sub clause 18.7 the method of working shift work will be by Employees working 8 ordinary hours each shift, excluding unpaid meal breaks arranged in accordance with this Agreement. The Company has the right to direct Employees shift loading of 15% will be paid on 8 ordinary hours worked, but will not be paid when any accrued RDOs are taken or paid out.
19.8 An Employee required to work shift work as required and the Employees shall work the shift work as directed. Shift work will be worked and paid for in accordance with this subclause.
(3) Shift work is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as such.
(4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue.
(5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's receive 5 days' notice of the commencement of the shift work and or payment of penalty rates (as set out in clause 21 - but with no shift loading paid) for the starting and finishing times of Ordinary Hours of time worked, until the shiftsnotice period expires.
(6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu 19.9 No notice period will apply to the completion of shift work. At the completion of the shift loading prescribed at subclause (7) of this clause. The work, Employees will revert back to their normal start time, after having had 10 consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holiday.

(9) The Company may stagger 19.10 Apart from when the times employee is working an afternoon or night shift, this Shift Work clause does not apply to Casual Employees who will otherwise be paid for Employees to take meal breaks to meet operational requirementsall time worked in accordance with clause 23.14 of this Agreement.
(10) The Company shall structure the Project Working Hours for Employees 19.11 A Casual Employee working an afternoon or night shift will be paid a loading of 40% more than the base rate for the ordinary hours of shift work (Monday to include one (1Friday) half– which includes both shift and casual loadings under this Agreement. However; sub-hour rest break clause 19.3 will not apply to be taken without deduction of pay by Employees working the Project Working Hours on a Casual Employee in any night shiftevent.

Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accruecycle.
(5) Prior to the commencement of shift work, the Company shall seek the agreement of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one (1) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts.
(6e) Where less than five (5) consecutive shifts are worked then worked, Employees shall will be paid at overtime rates in lieu of shift loading, except when the shift loading prescribed at subclause process has come to an end in the last week and less than five (75) of this clause. consecutive days is required to finish the work.

(7g) A rest period not exceeding fifteen (15) minutes and without deduction of pay will be allowed during each shift Employee at a time determined by the Employer. Where the rostered shift is for ten (10) hours or more, then the rest period will be extended to thirty (30) minutes without deduction of pay.
(h) A meal break not exceeding thirty (30) minutes and without deduction of pay will be allowed during each shift at a time determined by the Employer. To avoid doubt, the paid meal break will not be counted as time worked.
(i) The Employer may stagger the times Employees take rest periods and meal breaks to suit the operational requirements of the Project.
(j) In addition to the wages paid under this Agreement, Employees on night shift shall receive be paid a flat loading of twenty-five (25) percent % of their the Ordinary Hourly Rate of Pay for each hour worked.
(8) Employees working night shift shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break.
(9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements.

Provided that where the ordinary hours of work normally worked in lieu the workplace are worked less than five (5) days then the provisions of the shift loading prescribed at subclause sub-clause 19.5(i) shall be as if four (74) consecutive shifts were substituted for five (5) consecutive shifts.
(ii) The sequence of this clause. The consecutive nature of shifts will work shall not be deemed to be broken if under the preceding sub-clause, by reason of the fact that work on the process is not carried out on a Saturday, Saturday or Sunday, RDO or on any other day that the Company observes a shutdown for the purpose of allowing a thirty six (36) hour week or on any public holiday.

25.4. Shift Work requires at least 5 consecutive shifts to be rostered by the Company, otherwise overtime provisions will apply. To avoid any doubt, it is the shift loading prescribed arrangement as established by the Company that will satisfy the requirement that there be at subclause (7) of this clauseleast 5 consecutive shifts. The consecutive nature of shifts will not be deemed to be regarded as broken if work is not carried out on an RDO, public holiday, Saturday or Sunday.
25.5. Ordinary hours for shift Employees will average 38 hours per week over a Saturday, Sunday, RDO or defined work cycle and can be worked on any public holidayday of the week. Unless otherwise agreed, no more than 8 ordinary hours will be worked on any single shift.
(7) A 25.6. The ordinary hours for Employees on Shift Work will include a paid meal break not exceeding 30 minutes.
25.7. Employees on Shift Work, Monday to Friday, shall be paid a shift Employee shall receive a flat loading of twenty-five (25) percent 30% of their Ordinary Hourly Rate the Employee’s ordinary rate for each ordinary hour worked.

Shift work may be utilized to meet the Construction Contract schedule, or otherwise to comply with the Construction Contract requirements or written directive from the Owner. Shift work options under this RTSA include the following: (1a) Except as varied by this ClauseTwo-Shift Operation. (4) Ordinary Hours for shift Employees will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. Such Ordinary Hours are the specified hours under each shift Employee's terms of employment by reference to which annual leave and personal/carer's leave accrue.
(5) Prior to the commencement of shift workscheduled, the Company shall seek the agreement first eight (8) hours of the Employees involved. Failing agreement, the Company will provide to the Employees concerned one work per day (1exclusive of a non-paid meal period) week's notice of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shifts.
(6) Where less than five (5) consecutive shifts are worked then Employees shall be paid at overtime rates in lieu the Covered Employee's regular straight-time rate of pay. The length and schedule of working hours on any of the three shifts (whether 8, 7-1/2, or 7 hours) shall be as determined and scheduled at the Contractor-Employer's sole discretion provided; That on each shift loading prescribed at subclause (whether scheduled on a 8, 7-1/2, or 7 hour basis), the Contractor-Employer shall provide Covered Employees with eight (8) straight-time hours of work opportunity (exclusive of meal periods) or pay for same. This does not apply where the Covered Employee quits, voluntarily lays out, or is suspended or discharged prior to the completion of this clausean eight (8) hour period, or the Contractor-Employer is unable to provide such work due to weather conditions, equipment breakdown, power failure, work stoppage, labor disputes, accident, or other circumstances beyond the control of the Contractor-Employer. (3b) Shift work An employee working rotating day, afternoon and night shifts or where an employee works afternoon or night shifts only, will be paid a shift allowance of 20% of their base salary per week, paid weekly as a shift allowance, including when the employee is deemed to be any arrangement of Project Working Hours where the majority of the Ordinary Hours are worked outside of the spread of Ordinary Hours defined at clause 16 - Hours of Work of this Agreement and when Employees are working as suchday shifts.
(4c) Ordinary Hours for shift Employees Shift workers will comprise thirty-six (36) hours per week averaged over a defined work cycle and will not commence before 5.00pm on Sunday night. (e) No employee under 18 years of age will be employed on shiftwork except with the commencement of shift work, the Company shall seek the agreement written consent of the Employees involved. Failing agreement, employee’s parent/guardian.
(f) Shift workers who work a Saturday as an ordinary shift shall be paid for at the Company will provide to the Employees concerned rate of time and one (1) week's notice half of the commencement of shift work and the starting and finishing times of Ordinary Hours of the shiftsordinary rate.
(6g) Where less than five (5) consecutive shifts are worked then Employees Shift workers who work a Sunday as an ordinary shift shall be paid for at overtime rates the rate of time and three (3) quarters of the ordinary rate.
(h) Shift workers who work a public holiday as an ordinary shift shall be paid for at the rate of two (2) and a half times the ordinary rate and such payment shall be in lieu of weekend or shift allowances that would have been paid had the shift loading prescribed at subclause (7) of this clause. The consecutive nature of shifts will day not be deemed to be broken if work is not carried out on been a Saturday, Sunday, RDO or on any public holiday.
(7i) A shift Employee shall receive worker rostered not to work on a flat loading of twenty-five (25) percent of their Ordinary Hourly Rate for each hour worked.
(8) Employees working night shift public holiday shall be entitled to stop work for a half-hour without deduction of pay for the purpose of taking a meal break.
(9) The Company may stagger the times for Employees to take meal breaks to meet operational requirements.
(10) The Company shall structure the Project Working Hours for Employees working night shift to include paid one (1) half-hour rest break day’s pay for the public holiday or have one (1) day added to be taken without deduction of pay by Employees working the Project Working Hours on any night shifttheir annual leave.

Shift Work.
(1) Except as varied by this Clause, all other aspects of Section 4 of the Agreement shall apply to the working of shift work.

(6) Where not less than five (5) consecutive shifts are worked then Employees or not less than four shifts when the fifth shift is their 38 hour week rostered day off shift and paid accordingly. An employee shall be paid at overtime rates in lieu of the for any shift loading prescribed upon which they have not been given at subclause (7) of this clause. The consecutive nature of shifts will not be deemed to be broken if work is not carried out on a Saturday, Sunday, RDO or on any public holidayleast 48 hours’ notice.
(7f) Transfer of shift workers - A shift Employee worker who is required to work on a shift other than the shift on which they would ordinarily be rostered shall receive a flat loading be paid at overtime rates for any such shift in respect of twenty-five (25) percent of their Ordinary Hourly Rate for each hour workedwhich they have not been given at least 48 hours’ notice. This provision shall not apply when the employee reverts to the shift on which they would ordinarily have been rostered.
(8) Employees working night g) Annual Leave - In addition to the benefits provided by section 3 of the Annual Xxxxxxxx Xxx, 0000 (XXX), with regard to an annual holiday of four weeks, an employee who, during the year of their employment with the Company with respect to which they become entitled to the said annual holiday of four weeks, gives service to the Company as a seven-day shift worker, shall be entitled to stop the additional leave as hereunder specified:- If during the year of their employment they have served the Company continuously as a seven-day shift worker the additional leave with respect to that year shall be one week. if during the year of their employment, they have served for only portion of it as a seven-day shift worker the additional leave shall be one day for every thirty-three ordinary shifts worked as a seven-day shift worker; An employee shall be paid for such additional leave at the annual leave rate of pay, for the number of ordinary hours of work which those employees would have been rostered for duty during the period of additional leave; where the additional leave calculated under this subclause is or includes a halffraction of a day such fraction shall not form part of the leave period and any such fraction shall be discharged by payment only; In this clause reference to one week and one day shall include holidays and non-hour without deduction working days. A seven-day shift worker under this subclause shall be paid at the appropriate rate for any ‘compulsory roster’ shift, also known as a ‘roster shift’ which they would have worked during this period of annual leave had they not been on annual leave.
(h) Days added to the period of Annual Leave.
(a) An employee who is rostered off duty on a day which is a prescribed holiday and who is not required to work on that day shall: have one day added to their annual leave period; or by mutual consent, be paid, in the pay for the purpose period in which the holiday falls, for the holiday at the rate payable pursuant to the award. Except on a Saturday in the case of taking a meal breakemployees employed as Monday to Saturday shift workers who are regularly rostered for duty on Saturdays as ordinary working days.
(9i) Shift Cover Due to the Company’s commitment to the provision of maintenance services, it will become necessary for it’s employees to follow 12 hour shift patterns as worked by our clients personnel. The Company may stagger provision of such will be required to cover planned and unplanned absences of our client's employees. Implementation will proceed by agreement with the times for Employees to take meal breaks to meet operational requirements.
