Shipping Notices. With respect to goods ordered, Seller shall mail a shipping notice to Con Edison on the day items are shipped. Each shipment shall be accompanied by an itemized packing list that states the applicable purchase order number and the Con Edison identification number(s) of the items shipped.
Shipping Notices. 13.1 For all coal shipped under this contract, Contractor shall forward to the Contract Administrator and all other parties (TVA location or otherwise) as designated by the Contract Administrator a shipping notification as to coal shipped. This shipping notice must include the Purchase Order number, line item number, release number, traffic control numbers, railcar/barge/truck numbers, origin, name of mine, size of coal, shipping date, and such other relevant information as TVA may from time to time require. TVA shall have the right to require Contractor to transmit all of the above-referenced information via electronic data transfer direct to TVA’s computer system. Contractor is responsible for ensuring that its computer system is compatible with TVA’s computer system.
13.2 Contractor must take whatever steps are necessary to ensure that shipping notices are received by the Contract Administrator and all other parties as designated by the Contract Administrator prior to arrival of the coal at the Destination or within 24 hours of loading, including weekends and holidays, whichever is earliest. The Destination may not unload coal until a correct shipping notice is received, and Contractor will be responsible to carrier or TVA for any demurrage charges resulting from delays due to late or improper notification.
13.3 In addition, on Monday of each week. Contractor must email a cumulative shipping notice to the Contract Administrator. This shipping notice will include such items as Contract number, traffic control number, shipping date, conveyance ID, tonnage, quality and explanation for all variances from schedule. The format for this report will be provided by the Contract Administrator.
Shipping Notices. Not later than 3 Business Days after departure of each vessel from the Port of Loading, Seller shall notify Buyer of the tonnage of Concentrate loaded as per xxxx of lading, the indicative assays, the stowage plan, port rotation and the estimated date of arrival at the Discharge Port. Seller shall instruct the master of the vessel to give Buyer notice of the estimated time of arrival (“ETA”) at the Discharge Port 10 days, 5 days, 72 hours, 48 hours and 24 hours prior to the ETA.

Each shipment shall be accompanied by an itemized packing list that states the applicable purchase order number and the Con Edison identification number(s) of the items shipped. 7.Expenditure Limitation Blanket Purchase Agreement 4127902, 0 Proprietary and Confidential Page 15 of 55 Seller shall not deliver the goods or perform the services specified in any purchase order if the price thereof together with the price of all previous purchase orders issued under the Contract exceeds the total expenditure authorized by the Contract, unless and until the total amount of expenditure authorized under the Contract has been increased by means of a duly executed revision or amendment to the Contract. Seller shall inform Con Xxxxxx in writing when the total price of goods or services ordered under the Contract reaches seventy-five percent (75%) of the maximum expenditure authorized by the Contract.
Shipping Notices. For each delivery by barge, truck, or rail, Seller shall supply Buyer with a shipping notice that shall include the Unit Train, barge or truck number, number of cars in a Unit Train. Source from which Fuel was supplied, Delivery Point, tonnage shipped, shipping date, destination, date and time loading commenced and finished, along with the analysis information required under Section 4.4 and any other information reasonably required by Buyer. Seller shall within twenty-four (24) hours of loading or within twenty-four (24) hours prior to arrival of the barge, truck or Unit Train (as applicable) at the destination following proper loading of such shipment (whichever comes first), send the shipping notice to Buyer by telecopy or other means as agreed to between Buyer and Seller. Seller shall also promptly provide Buyer with a Xxxx of Lading for each delivery that shall include the name of Seller, contract number or purchase order number, Unit Train, truck or barge number, date loaded and Seller’s delivered weights. Seller shall promptly notify Buyer of any loading deficiencies or delays in loading in writing or via telephone or through other electronic means (with written confirmation thereof). Any such notification delivered via telephone shall be promptly followed by written documentation of the details of such notification.
Shipping Notices a. For all rail-delivered coal Contractor shall forward to the Destination Plant Manager(s) and Contract Administrator a daily notification, in duplicate, as to coal shipped. This shipping notice must include the contract number, traffic control numbers, railcar numbers, origin, name of mine, size of coal, shipping date, and approximate date of arrival. In addition, Contractor must complete the bill of lading (provided by TVA), and forward this document to the railroad and plant for proper identification. TVA shall have the right to require Contractor to transmit all of the above-referenced information via electronic data transfer direct to TVA's computer system.
b. For all barge-delivered coal Contractor shall forward to the individual named in the consigning instructions, Destination Plant Manager(s), and Terminal Supervisor, if applicable, a daily notification, in duplicate, as to coal shipped. This shipping notice must include the contract number, barge numbers, origin, name of mine, size of coal, shipping date, and approximate date of arrival. TVA shall have the right to require Contractor to transmit all of the above-referenced information via electronic data transfer direct to TVA's computer system.
c. Contractor must take whatever steps are necessary to ensure that shipping notices arrive at the plant prior to delivery of the coal. The plant will not unload coal until a correct shipping notice is received and Contractor will be responsible to carrier or TVA for any demurrage charges resulting from delays due to late notification.
Shipping Notices. Promptly after loading each shipment Seller shall mail or electronically transmit to Buyer a notice of shipment which shall include pertinent information about such shipment as mutually agreed to by Buyer and Seller from time to time.
Shipping Notices. For each delivery by vessel, Barge, truck, or Unit Train, Seller shall supply Buyer with a shipping notice which shall include the vessel name, Unit Train or Barge or truck number, Source from which supplied, tonnage shipped, shipping date, destination, time loading commenced and finished, along with the analysis information required under Article 4.4 and any other information reasonably required by Buyer and agreed to by Seller. Seller shall within forty-eight (48) hours of loading or prior to arrival of the vessel, Barge, truck or Unit Train (as applicable) at the destination following loading of such shipment (whichever comes first), send the shipping notice to Buyer by telecopy or other means as agreed to between Buyer and Seller. Notwithstanding the obligations to send shipping notices as provided in the previous sentence, Xxxxxx agrees to make Commercially Reasonable Efforts to send any such notices. Seller shall, as soon as is reasonably possible, notify Buyer of any loading deficiencies or delays in loading via telephone or other electronic means with confirmation in writing.

TVA shall have the right to require Contractor to transmit all of the above-referenced information via electronic data transfer direct to TVA's computer system.
c. Contractor must take whatever steps are necessary to ensure that shipping notices arrive at the plant prior to delivery of the coal. The plant will not unload coal until a correct shipping notice is received and Contractor will be responsible to carrier or TVA for any demurrage charges resulting from delays due to late notification.
d. By 10:00 a.m. Eastern Time each Monday, Contractor must forward by fax a shipping notice to the Contract Administrator. This shipping notice shall include the contract number, release number, tonnage shipped by day, and mine name. If TVA's weights govern, estimated weights are satisfactory. Any difference from the schedule established by TVA pursuant to Section 3 must be explained.

Contractor is responsible for ensuring that it’s computer system is compatible with Customer’s computer system.

For all barge-delivered coal Contractor shall forward by fax to the individual named in the consigning instructions, Destination Plant Manager(s), and Terminal Supervisor, if applicable, a daily notification, as to coal shipped. Customer shall have the right to require Contractor to transmit all of the above-referenced information via electronic data transfer direct to Customer’s computer system. c. Contractor must take whatever stops are necessary to ensure that shipping notices are received by the Contract Administrator and the plant or terminal prior to delivery of the coal. The plant or terminal will not unload coal until a correct shipping notice is received and Contractor will be responsible to a carrier or Customer for any demurrage charges resulting from delays due to late or improper notification.
