Sick Leave Donations. A participating member may contribute in ½ day increments up to 7.5 hours of sick leave to a common donation. 1. The cumulative number of donated days shall not exceed 30 days per donation request. The Association has the right to seek out further donations based on grant requests. 2. The DDEA Executive Council or their designee will determine grants from the Sick Leave Bank. Inquiries to Human Resources shall be referred to the DDEA President. 3. After reviewing the licensed professional’s application, the DDEA President or designee will notify Human Resources regarding the licensed professional’s need to use days from the Bank and the number of days granted to the licensed professional. a) Once a licensed professional has been approved for use of sick leave donation days, the DDEA President will request donations from the licensed staff in the licensed professional’s building. b) If the donated sick leave days from the licensed professional’s building total less than the number of days granted, then the DDEA President will request sick leave day donations from all licensed staff. c) Licensed staff will use the DDEA Sick Leave donation form to make a donation and these forms will be filled out and returned directly to the DDEA President. d) As the DDEA president receives the donation forms, each one will be time stamped so as to know the order in which the donations were received. e) Any donated increment that exceeds the total number of days requested will be returned to the licensed professional who donated that increment. f) Payroll will process the days as instructed by the Association. 4. The DDEA will keep accurate records of the days contributed for donations. Upon request the DDEA will provide the District with an update regarding the number of days used from the donations. 5. The District is not responsible for any personal tax liability that may incur by the donating member or the receiving member, should any liability arise.

The Association agrees to hold the harmless the District for not coordinating or distributing the request for sick leave supplement requests. 7. Further, the OSEA Present or designee will report the donated sick leave supplements back to the district office prior to the payroll processing date for that month for credit to the leave bank for that member. 8. XXXX agrees to keep records on requests for sick leave supplements and the need for additional requests but will also verify the potential expiration of benefits with the district office in accordance with the cycle of requests. 9. Donated sick leave hours will be matched to the need of the hourly length of the workday of the Classified employee making the request. i. When an 8-hour Classified employee requests “a day” the donation across classification by a Certified employee will result in a deduction of 8 sick leave hours. ii. When a 7-hour Classified employee requests “a day” the donation across classification by a Certified employee will result in a deduction of 7 sick leave hours. iii. When a 6-hour Classified employee requests “a day” the donation across classification by a Certified employee will result in a deduction of 6 sick leave hours. iv. When a 5-hour Classified employee requests “a day” the donation across classification by a Certified employee will result in a deduction of 5 sick leave hours. v. When a 4-hour Classified employee requests “a day” the donation across classification by a Certified employee will result in a deduction of 4 sick leave hours. 10. The Classified collective bargaining agreement in Article 12, Item 12.2.3, states that sick leave donations will only be made in 4-hour or 8-hour increments. It is understood that any sick leave donations will be made in an hourly match method, not responsible to exceed the daily sick leave allocation for the FTE of the employee having the shorter day. 11. The Certified collective bargaining agreement in Article 33, Item 14, Sub b, states that sick leave donations will only be made in 4-hour or 8-hour increments. It is understood that any sick leave donations made across association classification will be made in an hourly match method, not to exceed the daily sick leave allocation for the FTE of the employee having the shorter workday. 12.2.3 It is understood that the donation is voluntary on the part of the members with a minimum of four (4) hours and a maximum of eight (8) hours donation for any personal tax liability that occurrence. An additional contribution may incur be made if all donated hours are exhausted before the employee qualifies for other benefits. 12.2.4 The donated hours will be used in the order in which they were contributed and any hours not used will revert to the donor. 12.2.5 No sick leave bank is intended or established by the donating member or the receiving member, should any liability ariseterms of this Agreement. It is understood that once an employee agrees to make a donation that decision is irreversible. 12.2.6 Sick leave donations must be in place prior to finalization of monthly payroll and cannot be done retroactively.

Sick Leave Donations. A participating member In the event an employee has a serious or life-threatening illness, the employee or Department Head may contribute submit a request for the Sick Leave Donation by completing the required form in ½ day increments up appendix E of this document. The completed Sick Leave Donation Request Form will be submitted to 7.5 the Human Resources Office. The Sick Leave Donation Request form should also include any relevant information that the applicant wishes to disclose to the committee and donating employees related to his/her condition. It should be noted that the employee’s signature on the Sick Leave Donation Request Form authorizes the release of the information the employee has elected to disclose. The Sick Leave Donation Committee will review the request form to determine eligibility to receive donated hours from other employees. The Committee shall consist of two (2) members of the union, two members from management, and the Human Resources Director. The Committee will determine if the applicant is approved for donations. The decision to grant such a request lies soley at the Committee’s discretion, and is not subject to the grievance procedure. The Employee will be notified of the approval of denial of the request. If approved, the Human Resources Office will notify employees of the request for a sick leave donation to a common donationsolicit donations. Donation forms can be sent to the City Human Resources office until the donation period has ended. Once donation forms have been received, the Human Resources Office will submit them for processing. 1.
