Unexpected Closures Clause Samples
The "Unexpected Closures" clause defines the procedures and responsibilities that apply if a business or facility must close unexpectedly, such as due to emergencies, natural disasters, or other unforeseen events. Typically, this clause outlines notification requirements, obligations for both parties during the closure, and any adjustments to timelines or payments that may result. Its core practical function is to provide a clear framework for managing disruptions, minimizing confusion, and allocating risk when operations are interrupted by circumstances beyond the parties' control.
Unexpected Closures. The District, at its discretion, will determine whether schools need to be closed due to inclement weather or other emergencies.
10.7.1 When inclement weather requires schools to be closed, classified bargaining members will not be required to work. The lost days will not be charged against other paid leaves. The District may adjust the school calendar to make up for lost days. If, however, the District does not choose to make up lost days, classified bargaining unit members will not be monetarily penalized.
10.7.2 When other emergencies require that schools be closed, bargaining unit members will not be required to work unless otherwise notified. If they are not notified to work, the lost days will not be charged against other paid leaves. If bargaining unit members are not required to report to work, the District may adjust the school calendar to make up for lost days. If, however, the District does not choose to make up the lost days, bargaining unit members will not be monetarily penalized.

10.7.3 As classified employees are paid for inclement weather cancellations and other emergency closure days as if it were a regular contract day. Staff with pre-arranged absences or while on protected leave (FMLA/OFLA) will have their scheduled leave deducted as if the workday was held in regular session. These days are considered a workday and staff are paid as such; all other pay and leave provisions should apply for inclement weather cancellations, shortened days and other emergency closures. Pre-arranged single day leave events that fall on the day of an emergency closure will be returned to an employee’s leave balance. Inclement weather days that occur when leave days are pre-scheduled during a multi-day leave event are not credited back to the employee.
