Solicitation Documents. The solicitation documents for each contract for which goals are established shall contain a description of the requirements set forth in this Exhibit; the LBE/MBE/WBE goals; and the areas of projected subcontracting. Five (5) calendar days before the issuance of each solicitation, Developer shall submit the solicitation documents and the bid list to the UG. This submittal is mandatory for each bid subject to LBE/MBE/WBE goals.

XXXXX BACON ACT In Construction contracts involving an excess of $2000, unless exclusively in connection with the demolition or rehabilitation of residential property containing fewer than 8 units, the Contractor shall pay and the Subrecipient shall cause its contractor to pay all laborers and mechanics at a rate not less than those determined by the Secretary of Labor to be prevailing for Boulder County, which rates are to be provided by the Agency. These wage rates are a federally mandated minimum only, and will be superseded by any State or County requirement mandating higher wage rates. The contractor also agrees to comply with Department of Labor Regulations pursuant to the Xxxxx-Xxxxx Act found in 29 CFR Parts 1, 3, 5 and 7, which enforce statutory labor standards provisions. Xxxxx-Xxxxx wage decisions are established by the DOL for various types of construction (e.g. heavy, highway) and apply specifically to Boulder County areas. Solicitation Documents. Each Offeror shall complete (fill-ins and signatures) for the RFP/solicitation sections listed below. An authorized official of the firm shall sign the SF 33. Documents with original signatures shall be submitted as part of the hard copy document submission. PDF versions of the signed documents shall be submitted as part of the electronic DVD submissions. No changes or alterations shall be made to these sections of the solicitation.

xiv. RESOLVED, that each Company be, and hereby is, authorized to prepare and deliver to holders of Notes a consent solicitation statement (as it may be amended or supplemented from time to time, the “Consent Solicitation Statement”) and the related consent letter, in such form and containing such terms and provisions as are authorized by any of the Chief Executive Officer, the President, the Chief Financial Officer, any Senior Vice President, any Vice President, the Secretary, the Treasurer and such other officers as may be designated by the Chief Executive Officer (collectively, the “Authorized Officers”) with such other amendments, modifications, terms or provisions as any Authorized Officer may approve consistent with these resolutions. FURTHER RESOLVED, that each Company be, and hereby is, authorized to commence and consummate the Consent Solicitation to amend the Indenture, pursuant to the terms and subject to the conditions as set forth in the Consent Solicitation Statement, and the Authorized Officers be, and each hereby is, authorized, in the name and on behalf of each Company, to perform all acts in connection with the Consent Solicitation, and to execute and deliver the Consent Solicitation Statement and all other documents, including one or more supplemental indentures, as may be deemed necessary, appropriate or advisable, with such further amendments, modifications, terms and provisions as any Authorized Officer may approve consistent with these resolutions, the approval of such Authorized Officer to be evidenced conclusively, but not exclusively, by the Authorized Officer’s execution thereof.
