SPECIFIC INCLUSIONS. With regard to a plan which contains a qualified cash or deferred arrangement or matching contributions or employee contributions, excess contributions and excess aggregate contributions (whether or not distributed during or after the limitation year) shall be considered annual additions in the year contributed. Excess deferrals that are not distributed in accordance with the regulations under section 402(g) of the Code are annual additions.
SPECIFIC INCLUSIONS. The Work specifically includes the following items, all of which are included in the Contract Price set forth on Exhibit “C”. SPECIFIC INCLUSIONS o Pre-fabricated GI Cable trays, bends, couplers, down road supports, provision of Anchor fasteners, wherever required. o Epoxy painted steel angles and channel support for cable trays with proper earthing at equal intervals – will be paid in separate line item. o Steel support channels for panels / DBs. o Excavation of pits for earth electrode, Construction of earth pits including masonry and covers. o Provision of pipe sleeves for cables and earth bus o Chipping, Breaking and making good the damaged portion of civil works o Calibration & Testing of all protective relays, meters & other measuring and Protective devices. o Co-operation / Co-ordination for testing and commissioning with other suppliers o Obtain drawing approval from necessary authorities, arrange inspection and obtain safety certificate for entire in stallation. o Submission of 6 (six) copies of As Built Drawings, Documents and maintenance manuals o Epoxy / Zinc rich painting, wherever required o Preparation of drawings for CEA submission.
SPECIFIC INCLUSIONS. Without limiting the generality of the foregoing, a Force Majeure Event may include any of the following acts, events or circumstances, but only to the extent that each of the requirements set out in paragraphs (a) to (d) of Clause 15.1 (Definition of Force Majeure) is satisfied:
(a) an act of God, including drought, earthquake, volcanic eruption, landslide, flood, storm, lightning strike, cyclone, tornado, typhoon or other natural disasters;
(b) fire, explosion, radioactive contamination or chemical contamination;
(c) epidemic or plague;
(d) air crash, shipwreck or train crash;
(e) war, hostilities, acts of terrorism, sabotage, civil commotion, riot, revolution or insurrection;
(f) import restrictions, rationing or allocation, or closure of harbours, docks or other facilities for the use of, or services to, shipping or navigation;
(g) any act, event or circumstance of a nature analogous to any of the foregoing;
(h) (in the case of the Seller alone) any act, event or circumstance of a nature analogous to any of the foregoing affecting a Contractor in a manner which, had the Seller been performing the functions of the Contractor itself rather than through the affected Contractor, the Seller would have been entitled to relief under this provision;
(i) (in the case of the Seller alone and only to the extent applicable) any act, event or circumstance of a nature analogous to any of the foregoing (other than paragraph (i) above) affecting the Source Facility or the Owner in such a manner that, had the Seller been the owner of the Source Facility instead of the Owner, the Seller would have been entitled to relief under this provision;
(j) (in the case of the Buyer alone) any act, event or circumstance of a nature analogous to any of the foregoing (other than paragraphs (i) and
