The result will be the MCO’s “Adjusted Fee.” The STATE’s payment to the MCO’s for the Adjusted Fee shall be made when the STATE determines the MCO has satisfactorily completed its duties in section 4.2.11(A). The STATE reserves the right to update the calculation and method of payment for the MCO’s Adjusted Fee based upon CMS requirements, including the exclusion of appropriate Medicaid payments for long-term care, nursing home care, home health care, and community-based care, or changes to regulations governing the Annual Fee.

STATE Duties. The State will be responsible for creating and maintaining a database for bridge inventory and load rating data for all bridges made part of a Public Road in Nebraska. The State will continue to have jurisdictional responsibility for all public bridges on the State highway system, as that term is defined by Neb. Rev. Stat. §39-1302(37). Further, the State will be responsible for arranging the underwater inspection by consultants, for the local bridge owners, as described in Section 3 above. The parties agree and acknowledge that this agreement does not shift to the Local Bridge Owner any jurisdictional responsibility for bridges on the State highway system, and does not shift any duty to the State for jurisdictional responsibility of any bridges not included in the State highway system.
STATE Duties. The State shall operate a Medicaid program that is in compliance with applicable State and federal requirements. The State retains responsibility for maintaining and managing the records of State and for responding to public records requests pertaining to such records. The State will provide work space and administrative support to the Chief Medical Officer (CMO) and the Medical Director at its facilities at 000 Xxxxxxxxx Xxxx, Xxxxxxxxx, Vermont, or any location in which the State’s operations may move to during the contract period. In addition, the State will supply all computing and telecommunications equipment to be used by the CMO and Medical Director in fulfilling Contractor’s responsibilities to the State; this equipment must be returned to the State at the conclusion of the contract or termination of the CMO or Medical Director positions. This equipment will only be provided to the CMO and Medical Director when they are on-site at State facilities. The State will employ other State staff who will assist the CMO and Medical Director in the performance of their duties.

(A) The STATE shall calculate the dental payment for each state-operated dental clinic based on their cost reports and provide to the MCO a payment report that will identify the amount of payment due to be paid to each state-operated dental clinic. (B) The STATE will issue a gross payment adjustment to the MCO that will be the sum of the payment amounts due to the state-operated dental clinics, no later than November 30 or sixty (60) days after the date the STATE provides their final cost report, whichever is later. The MCO shall distribute the payments as specified by the STATE to each of the state-operated dental clinics no later than thirty (30) days after notification of the gross payment adjustment. The exact payment amount identified by the STATE is to be passed through to the state-operated dental clinic. (C) In the event that a state-operated dental clinic provides notice to the STATE that a payment by the MCO is incorrect, the STATE will verify the correct payment and notify both the clinic and MCO of the correct payment.

  • General Duties It shall be the duty of the Owner Trustee to discharge (or cause to be discharged) all of its responsibilities pursuant to the terms of this Agreement and the Sale and Servicing Agreement and to administer the Trust in the interest of the Holder, subject to the Basic Documents and in accordance with the provisions of this Agreement. Notwithstanding the foregoing, the Owner Trustee shall be deemed to have discharged its duties and responsibilities hereunder and under the Basic Documents to the extent the Servicer has agreed in the Sale and Servicing Agreement to perform any act or to discharge any duty of the Trust or the Owner Trustee hereunder or under any Basic Document, and the Owner Trustee shall not be liable for the default or failure of the Servicer to carry out its obligations under the Sale and Servicing Agreement.

  • Normal Duties (a) Faculty members are accountable for 10 months of the year. The 10 months accountable time includes such activities as teaching, the counselling of students, curriculum/program development, professional development and participation on a variety of educational committees. (b) At least one month before the commencement of any accountable time longer than four consecutive days, and covering activities other than teaching or professional development the faculty member will submit for approval to the appropriate administrator an activity plan for this period. The Owner Trustee nevertheless agrees that it will, at its own cost and expense, promptly take all action as may be necessary to discharge any liens on any part of the Owner Trust Estate that result from actions by, or claims against, the Owner Trustee that are not related to the ownership or the administration of the Owner Trust Estate.
