1.3 The use of alcohol and illegal chemical substances has a direct and adverse effect on the safety, personal health, attendance, productivity and quality of work of all employees and the safety of all students.

Recent scientific studies demonstrate that the use of alcohol and illegal chemical substances reduces an employee's ability to perform his job beyond the time period of immediate consumption or use. The Board recognizes that all employees have certain personal rights guaranteed by the Constitutions of the United States of America and the State of Oklahoma as well as by the Oklahoma Standards for Workplace Drug and Alcohol Testing Act, OKLA. STAT. tit. 40, §§ 551 et seq. This Policy will not infringe on those rights. As a part of this Policy, the Board hereby adopts an Employee Assistance Program in which employees may be referred to third-party providers who will provide the employee, at the employee's expense, a confidential drug and alcohol dependency evaluation and referral service for substance abuse counseling, treatment or rehabilitation. The Board encourages employees who have chemical dependency problems to seek professional assistance. Due to the devastating impact that the use of alcohol and illegal chemical substances can have on the safety of students and employees and their adverse affect on an employee's ability to perform the employee's job, the Board will not tolerate employees who use, possess, distribute, purchase, sell or are under the influence (as defined in the Policy) of alcohol or illegal chemical substances when on duty or while on school property. This Policy will apply to all employees of the School District regardless of position, title or seniority except bus drivers. The testing of bus drivers for alcohol or illegal chemical substances is exclusively governed by the School District's Policy on Alcohol and Drug Testing for Drivers and the federal Omnibus Transportation Act of 1991. Violations of this Policy will subject the employee to disciplinary action, including termination.

For the safety, health, and well being of the students of the Carthage R-9 School District, the district has adopted this policy for R-9 students who participate in off-season and in-season extracurricular and co-curricular activities in grades 7-12 as enumerated below. It is the desire of the Board of Education, administration and staff that every student in the District refrains from using, possessing or distributing illegal drugs. Substance abuse prevention programs have been utilized in the District in all grades, preschool through grade twelve. The Safe and Drug-Free Schools and Communities Program, funded by a federal grant, has helped provide educational activities and materials for students, teachers, parents and community members. Some of the services provided include the Drug Education Resistance Education (D.A.R.E.) program in cooperation with the Carthage Police Department, activities in connection with Red Ribbon Week, motivational speakers, and a social worker who works with students, parents, counselors and teachers in the District. Instruction is also provided in drug abuse prevention in health and science classes as appropriate for various grade levels. We believe students abuse drugs and alcohol less than they would if these programs did not exist. However, statistics indicate that Carthage students continue to abuse drugs at significant levels. In a recent Safe and Drug-Free Schools and Communities survey of freshmen and seniors, 25% reported they had used marijuana, 8% have used crack or cocaine, and 12% have used LSD, PCP, mushrooms or speed.

Madison County, Mississippi (the “County”) has .elected to adopt the following Ordinance in order to obtain for its citizens the following advantages: (1) access to emergency medical services of superior quality, quantity, and economic stability; (2) economies of scale and cost containment; and (3) access to disaster response capabilities superior to those which would otherwise be available.
STATEMENT OF PURPOSE AND INTENT. Prior to April 1, 1998, Employee had an account under the W.R. Grace & Co. Deferred Compensation Plan (the "Prior Grace Plan"), x xxx-xxxlified deferred compensation plan. Effective April 1, 1998, the Company ceased to sponsor the Prior Grace Plan as a result of a corporate re-organization and spin-off of certain business units. In order to avoid a taxable distribution from the Prior Grace Plan that would have occurred as a result of the corporate re-organization, the Company established and currently sponsors the Sealed Air Corporation Deferred Compensation Program for Cryovac Employees (the "Cryovac Plan") to hold and administer accounts of its employees transferred from the Prior Grace Plan. Effective January 1, 2001, the Company is terminating the Cryovac Plan and each participant in the Cryovac Plan will receive a distribution in the full amount of his or her Cryovac Plan account. The Company is giving each participant in the Cryovac Plan the opportunity, until September 30, 2000, to elect to continue to defer payment of his or her Cryovac Plan account by entering into a compensation deferral agreement with the Company. The purpose of this Agreement is to evidence Employee's decision to continue to defer payment of his or her Cryovac Plan account pursuant to the terms and conditions set forth herein. It is the intent of the Company that benefits under this Agreement shall not be taxable to Employee for income tax purposes until the time actually received by Employee. The provisions of this Agreement shall be construed and interpreted to effectuate such intent.
