Storage of CO2. Information on a site either acquired following award of an exploration permit or from operation of a functioning or depleted hydrocarbons reservoir can be used by potential operators to apply for a storage permit. A storage permit is granted on the basis of objective, published and transparent criteria (Art. 6(1) CCS Directive). In summary, the storage permit application needs to demonstrate that the operator is financially sound and technically competent to operate and control the site (Art. 7 and 8 CCS Directive). Therefore the applicant must present information of the actual storage location, the composition, pressure and injection rates of the CO2 as well as a forecast of the total amount of CO2 to be injected. In order to ensure safe operations, the applicant must also present a monitoring plan, a corrective measures plan, a post-closure plan and measures to counter irregularities. Before awarding a storage permit, the competent authority must send the draft permit for review to the European Commission who may issue a non-binding opinion on it (Art. 10 CCS Directive). Similar to hydrocarbons licences, it is possible to change, review and withdraw a storage permit (Art. 11 CCS Directive). All operators need to monitor the site as specified in an approved monitoring plan and report regularly to the competent authority to ensure safe injection and storage of CO2 (Art. 13 and 14 CCS Directive). A monitoring plan needs prior approval and to be drafted in accordance to the requirements of Xxxxx XX of the CCS Directive (Art. 13 Directive 2009/31/EC). Activities and data collection specified in a monitoring plan enable comparison of the actual and the modelled behaviour of the CO2, storage site performance and migration of the injected CO2 in the subsoil. The ultimate aim is to prevent irregularities and releases of CO2 into the atmosphere and at the seabed. The operator is under the obligation to take all necessary corrective measures when irregularities or leakages occur. In addition to CO2 and methane or brine leakages for injection into hydrocarbon fields and aquifers, respectively, there is risk of induced earth tremors and ground movement. 90 In case the operator fails to correct these irregularities, the government authority may step in and take the required measure at the expense of the operator (Art. 16 CCS Directive).
