If the Product prototype delivered at the completion of a Program that is the subject of a Work Statement meets the applicable Specifications, then the provisions of Section 3 shall take effect with respect to such Product. If the Product prototype delivered at the completion of a Program that is the subject of a Work Statement does not meet the Specifications or if ViewRay and PEKO determine during the course of the Program that the results of the Program are unsatisfactory; which determination shall be made with reference to the prospects for realizing Products that meet the applicable Specifications then in each case they may mutually agree to terminate the Program under Section 9.2(b). If the parties do not agree with respect to termination of the Program, they shall resolve such dispute using the procedure specified in Section 10.2(a)-(b).

The Contractor will work toward fulfilling the success criteria for the 2011app: - Evaluation show that it: enhances sociable, meandering exploration and prompts discussion, e.g. through feedback such as „it transformed my visit into a wonderful enlightening experience that I‟ve never experienced before [at Kew]‟ makes moments of serendipitous discovery into deeper, meaningful interactions, so fostering an interest in plants, conservation and Kew‟s work reveals a place full of hidden gems – helping visitors find areas of the garden they would not have found without it - Download targets are met – 20,000 downloads between launch and the end of the year. These targets are based on benchmarks from the visitor attraction sector, modified to take account of mobile ownership amongst Kew audiences. - Users are positive about the app – we will measure this though evaluation onsite and through app store reviews. We would like our average store rating to be at least 3 out of 5 stars and preferably more! - Interaction – both the amount and quality of participation. - Successful achievement of milestones. The Authority will evaluate the app as a separate piece of work from this Contract. Success criteria Phase III will be developed after the 2011 Phases I and II.
