SUMMER SCHOOL K-6 (Supplemental Assignment. A. Each year the East Valley School District will make the decision by May 1 whether to offer a summer school program. If the decision is made to provide this extended learning opportunity for its students, it is understood that the district will decide the dates, times, and eligibility criteria of students. B. The opportunity to teach summer school will be publicized to all the certificated employees through a written notice. This notice shall be distributed as far in advance as possible. C. Teachers chosen to teach summer school will be paid at their hourly per diem rate. Teachers may not use sick leave days or paid personal leave days during summer school. D. First consideration for employment will be given to teachers on a continuing contract with EVSD and those available for full summer school session. If teaching positions cannot be filled with East Valley teachers, then certificated staff outside EVSD will be recruited. E. The number of students who have indicated they will be attending summer school will determine the number of teachers hired from the application pool. The applicant pool will be divided into two groups: Level 1For students entering grades 1-4 and Level 2 – For students entering graders 5-7. Teachers for each group will be hired using the following criteria: a. Available for the entire summer school session b. Present teaching assignment c. Past teaching experience in desired level d. Teaching experience in the State of Washington e. Past summer school teaching experience F. In the event that fewer students participate in the summer school program than was anticipated at the time of hiring, the district will terminate the supplemental contract of the extra teacher(s). The first step in this reduction will be to ask for volunteers from the group(s) that is overstaffed. If there is further need to reduce staff, the criteria to determine who is to be terminated will be determined by the language in Paragraph E. If a reduction in staff needs to occur at the 4th or 5th grade summer school levels, the most senior teacher (Washington State experience) currently teaching 4th or 5th grade will be retained.   • Collateral Assignment The Owner may assign this contract as collateral security. The Company is not responsible for the validity or effect of a collateral assignment. The Company will not be responsible to an assignee for any payment or other action taken by the Company before receipt of the assignment in writing at its Home Office. The interest of any beneficiary will be subject to any collateral assignment made either before or after the beneficiary is named. A collateral assignee is not an Owner. A collateral assignment is not a transfer of ownership. Ownership can be transferred only by complying with Section 8.2.

  • Shift Assignment Should the University elect to establish a shift on any other schedule than the regular day shift (Monday through Friday) or to assign employees to work on any such shift, the employee(s) with the most seniority in the classification affected or to be assigned on such shift shall have preference in moving to such shift. If an insufficient number of employees in the classification elect to move to such shift, then the employee(s) with the least seniority in the classification shall be assigned to such shift. If positions or shifts are reduced or eliminated or movement of personnel to other shifts is required, then the seniority of the affected employee will prevail in the selection of shift, provided the affected employee can do the required work. Such shift preference is only applicable within the employee's classification.

  • Lien; Valid Assignment Subject to the Standard Qualifications, each endorsement or assignment of Mortgage and assignment of Assignment of Leases from the Mortgage Loan Seller or its Affiliate is in recordable form (but for the insertion of the name of the assignee and any related recording information which is not yet available to the Mortgage Loan Seller) and constitutes a legal, valid and binding endorsement or assignment from the Mortgage Loan Seller, or its Affiliate, as applicable. Each related Mortgage and Assignment of Leases is freely assignable without the consent of the related Mortgagor. Each related Mortgage is a legal, valid and enforceable first lien on the related Mortgagor’s fee (or if identified on the Mortgage Loan Schedule, leasehold) interest in the Mortgaged Property in the principal amount of such Mortgage Loan or allocated loan amount (subject only to Permitted Encumbrances (as defined below) and the exceptions to paragraph 8 below (each such exception, a “Title Exception”)), except as the enforcement thereof may be limited by the Standard Qualifications. Such Mortgaged Property (subject to Permitted Encumbrances and Title Exceptions) as of origination and, to the Mortgage Loan Seller’s knowledge, as of the Cut-off Date, is free and clear of any recorded mechanics’ or materialmen’s liens and other recorded encumbrances that would be prior to or equal with the lien of the related Mortgage (which lien secures the related Whole Loan, in the case of a Mortgage Loan that is part of a Whole Loan), except those which are bonded over, escrowed for or insured against by the applicable Title Policy (as described below), and as of origination and, to the Mortgage Loan Seller’s knowledge, as of the Cut-off Date, no rights exist which under law could give rise to any such lien or encumbrance that would be prior to or equal with the lien of the related Mortgage, except those which are bonded over, escrowed for or insured against by the applicable Title Policy. Notwithstanding anything herein to the contrary, no representation is made as to the perfection of any security interest in rents or other personal property to the extent that possession or control of such items or actions other than the filing of Uniform Commercial Code financing statements is required to effect such perfection.
