SUPERINTENDENT RIGHTS. 3.1 Except as otherwise provided in this agreement, it is understood and agreed that the Superintendent retains all powers and authority to direct, manage and control to the full extent of the law. Included in those duties and powers is the exclusive right to: determine its organization; direct the work of its employees; determine the times and hours of operation; determine the kinds and levels of services to be provided and the methods and means of providing them; establish its educational policies, goals and objectives; insure the rights and educational opportunities of students; determine staffing patterns; determine the number and kinds of personnel required; maintain the efficiency of Superintendent’s operation; determine the curriculum; build, move, or modify facilities; establish budget procedures and determine budgetary allocations; determine the methods of raising revenue; contract out non-unit work; and take action in the event of an “emergency”. The Superintendent retains the right to hire, classify, assign, evaluate, promote, and terminate employees. 3.2 The exercise of the foregoing rights, authority, duties, and responsibilities by the Superintendent, the adoption of policies, rules, regulations, and practices, shall be limited only by the specific and expressed terms of this Agreement, and then only to the extent such specific and expressed terms are in conformance with law. 3.3 The Superintendent retains the right to temporarily amend, modify, or rescind policies, practices, and provisions referred to in this Agreement in cases of “emergency”. An “emergency” shall be defined as an act of God, or situations which threaten the health, safety, or well-being of the Superintendent’s property, employees, or students.

In addition, the Superintendent retains the right to hire, classify, assign, transfer, evaluate, promote, discipline and terminate employees. 5.2 The exercise of the foregoing powers, rights, authority, duties and responsibilities by the Superintendent, the adoption of policies, rules, regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith, shall be limited only by the specific and express terms of this Agreement, and then only to the extent such specific and express terms are in conformance with law. 5.3 The provisions of this Article shall not be construed to override specific terms of this Agreement or to abrogate or limit rights guaranteed or provided by legal decisions or the operation of law.
SUPERINTENDENT RIGHTS. Each teacher shall be under the direction of the Superintendent and immediately responsible to the building principal for carrying out the policies of the Board of Education as they relate to the school system, to the attendance center, to the classroom and to the immediate contact with students and parents.

In addition, the Superintendent retains the right to hire, classify, assign, reassign, transfer, evaluate, promote, lay off, discipline, and terminate employees, and to determine the effects and impact of implementing these rights except as modified by this contract and law. 6.2 The exercise of the foregoing powers, rights, authority, duties and responsibilities by the Superintendent, including the adoption of policies, rules, regulations, and practices in furtherance thereof, and the use of judgment and discretion in connection therewith, shall be limited only by the specific and express terms of this Agreement, and then only to the extent such specific and express terms are in conformance with law. Further, the Superintendent’s rights as stated above shall not be subject to the Grievance procedures of this Agreement.
SUPERINTENDENT RIGHTS. A. The Association recognizes that under California Education Code sections 1293, 1294, and 1294.5 certificated personnel matters are solely the legal responsibility of the county superintendent. The exercise of these powers, rights, authority, duties, and responsibilities by the Superintendent and the adoption of such rules, regulations, and policies as he/she may deem necessary shall be limited only by the specific and expressed terms of this Agreement.

An emergency is defined as an act of God or unforeseen circumstance or combination of circumstances requiring immediate attention. In such instances of an emergency, the Superintendent will give the Union notice of the emergency and will consult on the temporary changes in the Agreement, which are attendant to the emergency.

SUPERINTENDENT RIGHTS. Consistent with Louisiana law, and as set forth in greater detail in La. R.S. 17:81, the Superintendent shall have the exclusive authority for the hiring, firing, and placement of all school and worksite personnel and/or employees, including the right to hire, promote, demote, discharge, discipline, transfer, assign work, and fix salaries.

  • Board-Superintendent Relationship The Board shall be primarily responsible for formulating and adopting policy. The Superintendent shall be the chief administrative officer for the district and shall be responsible for implementing Board policy. He shall organize the administrative and supervisory staff, and select, place, and transfer personnel with the concurrence of the Board. He is responsible for administering the instruction of students and the business affairs of the school district. The Board members agree, individually and collectively, to promptly refer all criticisms, complaints, and suggestions called to their attention to the Superintendent for action, study and/or recommendation, as appropriate.
