SUPERINTENDENTS AND FOREMEN. The Union recognizes that superintendents and foremen of employees covered by this Appendix are representatives of the Employer and the Employer shall have the right to select for these positions any person from within or without the employees listed in Schedule "A" of this Appendix. The ▇▇▇▇▇▇▇'▇ rights as outlined in this Article, shall not extend to anyone not covered by the terms of this Appendix. A ▇▇▇▇▇▇▇ has:
SUPERINTENDENTS AND FOREMEN. A superintendent for the Employer shall not be permitted to act as foremen. He shall appoint a ▇▇▇▇▇▇▇ or foremen as they are needed. Foremen shall be members in good standing of the Bricklayers and Allied Craftworkers Union. Foremen shall be practical journeyman mechanics in the branch of trade over which they exercise supervision. The foremen may have full charge of the employees on the work and have authority to hire and fire employees under his/her supervision. Anyone giving direct orders to the employees on the job site, on behalf of the Employer, shall be considered a ▇▇▇▇▇▇▇ and must be a member of the Bricklayers and Allied Craftworkers International Union.

A ▇▇▇▇▇▇▇ has: (a) The right to employ help and/or discharge for incompetency, neglect of duty or violation of office rules (which shall be conspicuously posted) and shall in no way abridge the civil rights of employees or their rights under the General Laws of the Communications, Energy and Paperworkers Union of Canada, Local 2000 and a superintendent or ▇▇▇▇▇▇▇ who is a member of the Union shall not be subject to fines or discipline by the Union on account of any action or decision made in carrying out the provisions of the Collective Agreement in accordance with the instructions of the Employer, but this shall not apply to infractions of Union Laws which are not involved in this collective agreement. (b) The General ▇▇▇▇▇▇▇ shall be the judge of a man's competency on the basis of work performed and shall have full control over all operations in the composing room. It is agreed that the chapel chairman shall be present when instructions are given for any competency tests conducted and duplicate proofs shall be provided of work performed. (c) The right to transfer men on a non-permanent basis from night work to day work and vice versa (provided priority in the class of work involving the transfer shall govern where such transfers are required), or to transfer from one department to another department, or from one position to another position at his discretion for such time as is necessary to produce the work. Employees shall perform any duties pertaining to work assigned to them but in no case shall a person be transferred to work with which he is not familiar and then declared incompetent. It is also understood there shall be no transfers made for disciplinary reasons or which discriminate against substitutes seeking employment. (d) The ▇▇▇▇▇▇▇ shall be exempt from priority claim as to starting time, days off and vacation scheduling. (e) When an assistant ▇▇▇▇▇▇▇ is in charge of a shift he shall be paid 10% above the journeyman rate for that shift, provided he is covered by this Appendix. This Article is not intended to prevent incidental communication from an Employer sales/estimator representative, but rather, identify persons responsible for direction and control of the employees.
