Supply of Utilities. Except as set forth on Schedule 3.19, the Real Estate has adequate arrangements for supplies of electricity, gas, oil, coal and/or sewer for all operations at the 1998 or current operating levels, whichever is greater. Except as set forth on Schedule 3.19, there are no actions or proceedings pending or, to the best of the Seller Parties' knowledge, threatened, that would adversely affect the supply of electricity, gas, coal or sewer to the Real Estate except for those which individually and in the aggregate would not have a Material Adverse Effect.
Supply of Utilities. (a) The Landlord will provide and permit the Tenant to use the electricity, domestic water, sewage disposal and other utility services serving the Building in such quantities as the Landlord, from time to time, determines to constitute normal use for tenants in the Building. The Tenant shall not overload the capacity of any such service. The Tenant shall not bring onto the Leased Premises any installations, appliances or business machines which are likely to consume significant amounts of electricity or other utilities or which require special venting without the prior written consent of the Landlord. The Tenant shall not engage any person to provide any utility service to the Leased Premises.
(b) The Landlord shall have no obligation to provide the Tenant with HVAC, electricity, sewage disposal, water or other utility services of a type or in quantities that exceed normal use by tenants in the Building (as such normal use is determined by the Landlord), unless the Landlord determines, in its sole discretion, that the provision of such services: (i) is within the capacity of the Building systems; (ii) would not affect the operation, aesthetics or structure of the Building; (iii) would not reduce the efficiency of the existing services supplied to other tenants or parts of the Building; and (iv) is otherwise feasible. The Tenant will pay to the Landlord all costs, both non-recurring and recurring, of providing all such services as part of Operating Costs.
Supply of Utilities. Except as set forth on Section 3.2(k)(iv) of the Disclosure Schedule, there are no actions or Legal Proceedings pending or, to the Company’s Knowledge, threatened against the Company or any of the Subsidiaries, that would adversely affect the supply of electricity, gas, coal or sewer to either the Owned Real Property or the Leased Real Property.

Supply of Utilities. 8.3.1 Party A shall ensure that its Affiliate(s) supply, to the Company services and utilities, pursuant to and in accordance with the terms and conditions set forth in the Services and Utilities Agreement.
8.3.2 If, due to the expansion of production described in Article 4.3.2, the Company’s facilities’, services’, and utilities’ needs exceed the amounts set out in the and in the Services and Utilities Agreement, and Party A’s Affiliate(s) is unable to meet the Company’s requirements, then Party A and Party C will assist the Company to apply for and obtain from the relevant authorities such supply of additional amounts of such facilities, services and utilities as follows:
(A) on a continuous uninterrupted basis;
(B) in quantities sufficient to meet the full operational requirements of the Company,
(C) in accordance with the practice in other comparable industrial joint ventures in Hebei Province; and
(D) at a favorable cost which shall be no higher than that paid by state-owned enterprises for similar facilities, services and utilities in the area.
Supply of Utilities. The [Authority] will enter into all contracts for the provision of Utilities Services to the Project Facilities, with the exception of Utilities Services used by the PPP Co. in connection with the carrying out and completion of the Works. PPP Co. shall ensure that the conducting media (including connections) and containers for the supply of Utilities Services comply with applicable Laws and Good Industry Practice and are maintained, repaired and replaced in accordance with Schedule 3 (Works Requirements) and Schedule 10 (Services Requirements) throughout the Term of this Project Agreement.
Supply of Utilities. Village shall provide electricity, heat, cooling, ventilation, water and sewer to the Leased Premises, at commercially reasonable levels. Village shall not be liable, under any circumstances, for loss or injury to any person or property through or in connection with or incidental to the furnishing of or failure to furnish any of the utility or other building services, unless such loss or injury was caused by the negligence or willful misconduct of Village or its agents.
