Provision of Utilities. 7.7.1 The Operator shall be solely responsible for arranging for all utilities for the operation and maintenance of the Facility. Notwithstanding the foregoing, the Authority shall be solely responsible to pay any outstanding dues or claims in respect of any utilities consumed at the Facility prior to the commencement of the Concession Period.
7.7.2 Where the Operator seeks to procure any utilities from Government Authorities, the Authority shall use reasonable endeavors to assist the Operator in obtaining rates from such Government Authorities that are no higher than the rates offered to commercial or industrial users of such utilities.
Provision of Utilities. It is the Owners responsibility to obtain written confirmation from the appropriate entities that all public utility requirements for the Land, including but not limited to telephone, underground without any expense, cost or obligation on the part of the Municipality and that all requisite easements have been or will be provided to such entities. It is the Owner’s responsibility to ensure that telecommunications, cable television, hydro-electric power, gas and postal services, have been satisfactorily arranged, that servicing for same will be provided underground without any expense, cost or obligation on the part of the Municipality and that all requisite easements have been or will be provided to such entities.
Provision of Utilities. 7.7.1 The Operator shall be solely responsible for arranging for all utilities for the O&M of the Facility, inter alia, including solar power generation in accordance with the Invitation for Bids. Notwithstanding the foregoing, the Authority shall be solely responsible to pay any outstanding dues or claims in respect of any utilities consumed at the Facility prior to the commencement of the Concession Period.
7.7.2 Where the Operator seeks to procure any utilities from Government Authorities, the Authority shall use reasonable endeavors to assist the Operator in obtaining rates from such Government Authorities that are no higher than the rates offered to commercial or industrial users of such utilities.
Provision of Utilities. Landlord agrees to furnish or cause to be furnished to the Premises the utilities described in this Section 4.1 and in Appendix 4.1 attached hereto and incorporated herein by this reference (hereinafter referred to collectively as “Landlord’s Services”), subject to the conditions and in accordance with the standards set forth in this Section 4.1 and in Appendix 4.1 hereto.
Provision of Utilities. Provision of and payment for sewer, water, and electric utilities associated with the TTMS Roadside Equipment will be the responsibility of VDOT.
Provision of Utilities. The Concessionaire shall be responsible for procuring all utilities, including electricity, water, telecommunications, sanitation and fuel, as required for the completion of the Construction Works and operations of the VIS. It shall also be the responsibility of the Concessionaire to make alternative power arrangement to meet the scheduled and unscheduled load shedding of electricity and gas.
Provision of Utilities. Lessor will contract with all applicable Utility providers for the delivery and purchase of sufficient Utilities (and with respect to water, within acceptable industry standards) to the Xxxx Center Plant in sufficient quantities in order that BREP may perform its obligations under the Phase I Ancillary Agreements. The costs of all such Utilities shall be borne by Lessor, subject to the Off-taker Purchased Utility Reimbursement as described in Exhibit “K” to the CEA; provided, however, that if Lessor elects to terminate the Phase I Ancillary Agreements due to a Non-Appropriation Event and fails to pay the full Termination Fee due as a result thereof, and if BREP elects to keep this Lease in full force and effect pursuant to Section 3.3.f, then BREP shall be responsible for the costs of all such Utilities and shall reimburse Lessor therefor within thirty (30) days of BREP’s receipt of any invoices relating thereto.
Provision of Utilities. Lessor will provide, or cause to be provided to the Premises water, electricity, telephone, sanitary sewer, heat, ventilation and air conditioning. Lessee shall arrange for the furnishing to the Premises of such utility services as it may require, as well as for the installation of all meters or other devices. Lessee shall be solely responsible for and shall promptly pay, as and when the same become due and payable, all charges for water, sewer, electricity, gas, telephone and any other utility used or consumed in the Premises and supplied by a public utility or public authority or any other person, firm or corporation, including Lessor, supplying the same.
Provision of Utilities. 6.6.1 Prior to the start of O&M Work, the Implementing Agencies shall pay all utility bills that are due up to the date of start of Installation Period and provide an evidence of the same to the Independent Auditor. From the commencement of O&M Work, the Concessionaire shall be solely responsible for arranging for all utilities for the operation and maintenance of the Institute. Further, prior to the start of O&M Work, the Implementing Agencies shall get separated the meters of electricity for the Institute and other buildings, which are not forming part of the Institute.
6.6.2 Where the Concessionaire seeks to procure any utilities from Government Authorities, the Implementing Agencies shall use reasonable endeavors to assist the Concessionaire in obtaining rates from such Government Authorities that are no higher than the rates offered to public sector users of such utilities.
Provision of Utilities. BMS shall supply certain utilities and additives in specified quantities (each, a "Utility" and “Additive”) based on certain assumptions set forth in Schedule 1, to the Nitric Acid Facility for use in the manufacture of Nitric Acid and operation and maintenance of the Nitric Acid Facility, such supply to be in the amounts and manner provided in this Section 11. EDNLP warrants that the quantities provided in Schedule 1 are a good faith estimate of the quantities of Utilities it will consume at an annual production rate of 476,000 short tons of Nitric Acid per year. It is expressly understood that BMS shall not be obligated to supply any Utilities or Additives other than those specifically listed in this Agreement and that BMS shall not be obligated to supply such Utilities or Additives in excess of the quantities provided for in Schedule 1. BMS's obligations hereunder shall at all times remain subject to any competing priorities BMS may have at the BMS Baytown Plant for such Utilities or Additives. BMS shall provide all such Utilities and Additives to the Nitric Acid Facility at the Battery Limits in accordance with the specifications set forth on Schedule 1 hereto and at BMS's Net Distributed Cost.
(A) Water - The Bayer Baytown Plant is served by public utility-supplied and plant-supplied water that is piped through and from the Bayer Baytown Plant. BMS agrees to supply to the Nitric Acid Facility at the Battery Limits: (i) boiler feed water; (ii) fire water; (iii) potable water; (iv) plant (non-potable) water; and (v) demineralized water in the amounts and at the specifications set forth in Schedule 1. BMS shall supply all water at BMS's Net Distributed Cost.
(B) Nitrogen - BMS agrees to supply to the Nitric Acid Facility at the Battery Limits, at BMS's Net Distributed Cost, nitrogen gas through pipelines located at or on the Bayer Baytown Plant in the amounts and in the specifications set forth in Schedule 1.
(C) Air - BMS agrees to supply to the Nitric Acid Facility at the Battery Limits, at BMS's Net Distributed Cost: (i) plant air and (ii) instrument air through pipelines located at or on the Bayer Baytown Plant in the amounts and in the specifications set forth in Schedule 1.
