To that end, if 2/3 of the teachers in a given building and the building Principal desire to introduce restructuring or other changes which would otherwise be prohibited or limited by a contractual provision, the teachers and Principal may respectively make written requests to the Association and Board for an exception to the Master Agreement. TEACHING HOURS. A. Attendance will not be required at meetings where only one side of a controversial issue is presented. D. Except for school-sponsored events, teachers and students must not personally engage in any commercial profit-making activity during the school day as defined by this Master Agreement. At no time will teachers allow reference to the Frankfort-Elberta Area Schools in any commercial advertising. E. Teachers agree that the above times to accomplish a professional teaching job, time may be changedrequired beyond the school day as specified in this contract, by no more than twenty (20) minutesand therefore, agree to extend this day if the situation demands. Such things as a conference with a parent, or retention of a student, may demand extension of the day. F. In the case of an emergency, as determined by the Board upon prior notice administration, a teacher may be excused early without subjecting the Frankfort-Elberta Area School District to an unfair labor practice in respect to discrimination as to length of workday. G. Teachers are under contract for a specified school day as set forth in this section, and therefore, shall have the Associationprincipal's permission to leave the school building during that day; noon hour excepted. H. Preparation time is part of the contractual day. Teachers are expected to make this time available for pupil-teacher conferences, administrator-teacher conferences, other conferences, as well as using this time for classroom preparation. I. All full-time classroom teachers are guaranteed a minimum of 225 minutes per week of preparation time during the normal student instruction week. J. All teachers shall have a regular workday which duty free, uninterrupted thirty (30) minute lunch period except for those that have accepted the Schedule B Lunch Duty position. K. The principals in each building will not exceed seven (7) hours forty-five (45) minutesconduct monthly faculty meetings. Whenever possible these meetings will be held the third Wednesday afternoon of each month, inclusive of lunch period. Individual parent initiated conferences shall be scheduled by the teacher at a time that is convenient to him/her but within three (3) working days of the parent request. Participation in evening activities which relate to or strengthen the school's educational program shall be mutually determined by the administrator and the Association desire teaching staff of the building. Teacher participation in such evening activities shall not be required beyond 9:30 p.m. Every effort will be made to encourage innovation minimize the number and flexibility length of staff meetings. TEACHING HOURS. A. The teacher's day in the secondary and elementary schools shall be between the following hours: 8:00 A.M. and 4:00 P.M. Elementary 7:30 A.M. and 3:30 P.M. Middle Schools (6-8) 7:00 A.M. and 3:45 P.M. Senior High Annually the Board shall notify teachers of starting and ending time of teacher workday. On days preceding holidays or vacations, the teachers' day shall end at the end of the students' day. Teachers shall work at least the state mandated instructional days and instructional hours. The Board may schedule such time as necessary to satisfy state mandates. Teachers shall not be at their assigned classroom eligible for additional compensation for such time provided that it is within the 36.25 hours as set forth below. B. However, nothing shall be construed by the provision in Article V, Section A above to prevent a teacher from accepting an assignment that is other than the hours specified. This section is included as a means of providing scheduling flexibility, (i.e. a teacher may work eight (8) hours a day two days a week, and 6.75 hours per day three days per week). All assignments not provided for in Article V, Section A will be voluntary. No weekly assignment shall exceed 36.25 hours. Unless otherwise agreed to by the teacher, assignments will be made on a consecutive time basis, inclusive of instructional, planning and lunch time. If a teacher resigns a voluntary assignment once the school year has commenced and an additional volunteer is not available the Board reserves the right to assign the least senior teacher that is qualified and certified to fill the position. The board agrees, during the length of this agreement, to provide prior notice to the Association whenever such an assignment is to be made. C. The Board and the Association shall form a subcommittee comprised of representatives from each party to develop a contingency plan in the event that it becomes necessary to close any of the school buildings in the district. D. The parties recognize that teachers shall work at least the state mandated instructional days and instructional hours necessary for the district to receive its full state aid, and in the event that the Board decides to close any of its school buildings, and the subcommittee described above has not developed a contingency plan that has been ratified by the Board and the Association, the teachers shall satisfy this obligation. E. If Open Houses take place, they will be mutually agreed upon by the building principal and a majority of his/her staff. The principal will provide three weeks notice except in case of an emergency or tragedy. When such accord is reached, all members of said staff shall be expected to attend unless excused by the principal. F. The time stated above may be adjusted earlier or later by the Superintendent of Schools after notifying the Association, but the total hours shall remain the same. G. Teachers should remain for a sufficient period after the close of the pupil's school day to attend to those matters which properly require attention at that time, including but not limited to, consultations with parents, conferring with students, correcting papers, and preparing lesson plans. The schools are open until 5:00 P.M. or 5:30 P.M. and nothing in this agreement shall prevent teachers from remaining in the building until that time to complete or prepare their work. H. It is the responsibility of each individual teacher to provide the highest quality educational program practicable for every student in the school district, therefore, each teacher shall make daily preparation, attend staff meetings, and student assemblies unless excused by the principal. I. It is expected that each building administrator will announce the day of the week for regularly scheduled faculty meetings during the first two weeks of the school year. The time and day for such meeting shall coincide with the needs and requirements in the various buildings as follows: High School: 7:55 a.m. – 3:15 p.m. Middle School: 7:50 a.m. – 3:10 p.m. Elementary: 7:45 a.m. – 3:05 p.m. determined by the building administrator. It is understood, however, that consultations and communications pertinent to various school purposes may require additional meeting days. It shall be the aim of the administration to keep such meetings at a minimum, and where practicable, to no more than one (1) hour's duration. J. The Board shall provide training for all teachers in compliance with legal requirements regarding blood borne pathogens and pertinent state and federal laws. The Board shall provide each teacher with one hour of professional development time before the first student day of each school year to individually receive such training on the internet in accordance with instructions and computer equipment provided by the Board. Each teacher shall be required to complete such training before the first student day of each school year unless said teacher is unable to do so due to medical restrictions. Any teacher who fails to complete this training by the beginning of the second student week of each school year shall be docked $30 per day from his or her salary for each work day thereafter that the training remains uncompleted. Any teacher, prior to the first day of school, who cannot complete this training because of medical reasons, shall be allowed to complete the training prior to returning to active teaching duty. K. Since it is important to the education program to know and understand the whole child, teachers should attend and participate in activities of the school such as P.T.O. meetings. They are also encouraged to attend public performances of children in plays, concerts, athletic events, or other extra curricular events. L. The Agreement shall provide for the establishment of a noon lunch period for each teacher that shall be free of scheduled duties except that it is understood by all concerned that emergencies or building situations may require that teachers share responsibilities on a rotation basis. It is also understood that illness or emergency situations may cause a temporary cessation in the employment of lay persons. It is agreed that the above times teachers' lunch periods may be changed, by no more than twenty (20) minutes, by the Board upon prior notice vary according to the Associationscheduling needs. Whenever special teachers are responsible for the supervision of pupils during the passing of students between classes. On days preceding holidays, teachers are free from duty when buses transporting students to their homes leave the building. TEACHING HOURS. A. Teachers shall be at their assigned classroom within the building as follows: High School: 7:55 a.m. – 3:15 p.m. Middle School: 7:50 a.m. – 3:10 p.m. Elementary: 7:45 a.m. – 3:05 p.m. It is agreed that the above times may be changed, by no more than twenty (20) minutes, by the Board upon prior notice to the Association. All teachers shall have a regular workday which will not exceed seven daily six (76) hours hour and forty-five (45) minute contractual obligation and in addition thereto a duty free lunch period of not less than thirty-five (35) minutes for teachers in elementary schools and thirty (30) minutes for teachers in middle school, junior high and high school, all of which shall be contained within a seven (7) hour thirty (30) minute period. The beginning and ending of the seven (7) hour thirty (30) minute period shall be as specified by the administration, but shall be between the hours of 8:00 A.M. and 4:30 P.M. for grades K-5 and 7:00 A.M. and 4:30 P.M. for grades 6-12. The daily average teaching load for each teacher shall not exceed five (5) hours and twenty-five (25) minutes, inclusive . It is expressly understood that the daily average teaching load may deviate three (3) minutes either way without a violation of the contract. All teachers shall regulate student conduct in hallways or assigned duty stations up to the commencement of actual classroom instruction and during classroom changes where applicable except when on their duty free lunch period. All teachers are responsible for “Regulation of student conduct” shall not give the supervision building principals the right to physical assignment of pupils during the passing of students between classes. In performing this duty hallway duties, but teachers shall be stationed required to leave their room to maintain hallway discipline when necessary. Non-teaching time shall be used for preparation, consultation, planning, professional work with other staff, administrators, parents, and students, and other work related to the teacher’s assignment including travel for itinerant teachers. Teachers may make use of such time for other necessary purposes when mutually agreed by the principal and teacher. Within the parameters of non-teaching time, all teachers shall be provided with an average of fifty (50) minutes per day preparation time. In the secondary buildings preparation time is equal to a class period. Itinerant teachers shall not be required to travel during their thirty-five (35) minute lunch period. Further, principals shall work together to schedule significant blocks of preparation time when sharing itinerant teachers. Abuse or misuse of the time given to teachers for conference and preparation may result in disciplinary action. On days immediately preceding holidays, all teachers may be excused when students have boarded their respective buses. 1. Principals and other members of the administrative staff shall be free to schedule reasonable activities such as parent-teacher conferences, curriculum meetings, inservice programs, building meetings, following the dismissal of students from school so long as the same is within the aforementioned consecutive seven (7) hours and thirty (30) minutes, except as provided in Paragraph B of Article VI. 2. Elementary teacher preparation time for Fall & Spring Parent-Teacher Conferences shall be at least 90 consecutive minutes and will be granted within five (5) working days prior to the conferences. Each school at all levels shall schedule Spring and Fall Parent-Teacher Conferences which shall provide for a scheduled appointment with at least one of the pupil’s teachers. 3. Resource room teachers shall be granted one-half (1/2) day per week for preparation time in lieu of other preparation time during the balance of the week. Because of the unique nature of services rendered, school social workers, librarians, and counselors shall have flexible preparation time, as approved by the building principal, equal to that provided for regular classroom teachers. 4. When the Board provides elementary art, the classroom teacher may use this period for preparation time, but must return the last five (5) minutes to help clean up and/or to prepare for continuing student work on art project(s). 5. Elementary teachers shall have planning and preparation time while the art, music and physical education specialists have assumed the classroom teachers’ responsibilities. If specialists are absent, the administration shall obtain a substitute where the elementary teachers do not wish to teach the specialist classes. If substitutes are unavailable, the teacher shall instruct the specialist’s class of students. If elementary teachers are deprived of preparation time due to absence of the specialist, the teacher shall be reimbursed at the rate of twenty dollars ($20.00) per hour or receive comp time. If a specialist program is deleted from the curriculum, elementary teachers shall resume teaching of normally scheduled classes without additional compensation; however, it shall not serve to increase their daily average teaching load beyond five (5) hours and twenty-five (25) minutes beginning July 1, 2005. Beginning in the hallway area near 2005-2006 school year it shall not serve to increase their classrooms daily average teaching load beyond five (5) hours and twenty-five (25) minutes, or at their classroom dooras changed in Section A above. It is recognized expressly understood that circumstances the daily average teaching load may occasionally deviate three (3) minutes either way without a violation of the contract. Teachers in elementary buildings, except kindergarten teachers and specialists, shall also have the right to use the time when their students are at the scheduled recess, equivalent up to one hundred twenty (120) minutes per week, for preparation and planning. Kindergarten teachers will supervise both of their recesses as part of their normal teaching loads. Specialists need not supervise recess. Classroom teachers shall assist recess aides in supervision of their students on inclement weather days. The classroom teachers and the aide shall work out a reasonable schedule of supervision so that one adult is in eye contact with a classroom of students. B. Building meetings, committee meetings, and other school activities including inservices may require the presence teacher to work outside the daily contractual time. It is expected that all teachers recognize the worth and importance of such meetings and shall be in attendance when the meeting is called by the building principal, assistant principal, or the superintendent. Such meetings shall be limited to three (3) meetings per month ending one hour after the daily contractual obligation time except for one meeting per month that may last until six (6:00) P.M. Attendance after the one hour shall be voluntary except for the one meeting per month that may last to six (6:00) P.M. and teachers shall be notified one (1) week in advance of this meeting. Bargaining unit members involved in Schedule B activities shall attend or make up meetings and inservices as rescheduled with the building principal. C. Each teacher shall be required to attend parent-teacher conferences and open houses, but attendance at PTO will be voluntary. D. Each teacher, with the exception of those teachers who volunteer for paid duty in the amount of nine dollars and twenty-five cents ($9.25) for 2008-2009 and nine dollars and seventy-five cents ($9.75) for 2009-2010 for each thirty (30) minute lunch period; shall have not less nor more than the equivalent time received by students of duty-free, uninterrupted lunch daily, except teachers’ lunch hours shall be thirty (30) minutes in grades 6-12 and thirty five (35) minutes in grades K-5. It is expressly understood that these lunch periods may be staggered in accordance with scheduling by the building principal. E. Act of God Days: 1. With the consent of the teacher elsewhereAssociation, the Board or administration may use “snow days” or inclement weather days for inservice training. TEACHING HOURS. A. Attendance will not be required at meetings where only one side of a controversial issue is presented. D. Except for school-sponsored events, teachers and students must not personally engage in any commercial profit-making activity during the school day as defined by this Master Agreement. At no time will teachers allow reference to the Frankfort-Elberta Area Schools in any commercial advertising. E. Teachers agree that the above times to accomplish a professional teaching job, time may be changedrequired beyond the school day as specified in this contract, by no more than twenty (20) minutesand therefore, agree to extend this day if the situation demands. Such things as a conference with a parent, or retention of a student, may demand extension of the day. F. In the case of an emergency, as determined by the Board upon prior notice administration, a teacher may be excused early without subjecting the Frankfort-Elberta Area School District to an unfair labor practice in respect to discrimination as to length of workday. G. Teachers are under contract for a specified school day as set forth in this section, and therefore, shall have the Associationprincipal's permission to leave the school building during that day; noon hour excepted. H. Preparation time is part of the contractual day. Teachers are expected to make this time available for pupil-teacher conferences, administrator-teacher conferences, other conferences, as well as using this time for classroom preparation. I. All full-time classroom teachers are guaranteed a minimum of 225 minutes per week of preparation time during the normal student instruction week. J. All teachers shall have a regular workday which duty free, uninterrupted thirty (30) minute lunch period except for those that have accepted the Schedule B Lunch Duty position. K. The principals in each building will not exceed seven (7) hours forty-five (45) minutesconduct monthly faculty meetings. Whenever possible these meetings will be held the third Wednesday afternoon of each month, inclusive of lunch period. All teachers are responsible for the supervision of pupils lasting no longer than 4:30 p.m. during the passing of students between classes. The schools are open and nothing in this agreement shall prevent teachers from remaining in the building to complete or prepare their work. B. Duty free lunch periods will be at least 25 minutes H. It is the responsibility of each individual teacher to provide the highest quality educational program practicable for every student in the secondary schools school district; therefore, each teacher shall make daily preparation, attend staff meetings, and student assemblies unless excused by the principal. I. It is expected that each building administrator will be 45 minutes announce the day of the week for regularly scheduled faculty meetings during the first two weeks of the school year. The time and day for such meeting shall coincide with the needs and requirements in the elementary schools. C. It is recognized understood, however, that any consultations and communications pertinent to various school purposes may require additional meeting days. It shall be the aim of the administration to keep such exceptionmeetings at a minimum, and where practicable, to no more than one (1) hour's duration. Meetings must end more than ten (10) minutes prior to the start of the instructional day or begin no earlier than ten (10) minutes after the end of the instructional day. J. The Board shall provide training for all teachers in compliance with legal requirements regarding blood borne pathogens, sexual harassment and pertinent state and federal laws and more. The Board shall provide each teacher with professional development time equal to the amount of time required to complete all assigned training videos before the first student day of each school year to individually receive such training on the internet in accordance with instructions and computer equipment provided by the Board. Each teacher shall be required to complete such training before the first student day of each school year unless said teacher is unable to do so due to medical restrictions. Teachers hired after the start of the school year shall complete the training within one week of beginning employment. Any teacher who fails to complete this training by the beginning of the second student week of each school year shall be docked $30 per day from his or her salary for each work day thereafter that the training remains uncompleted. Any teacher, prior to implementationthe first day of school, who cannot complete this training because of medical reasons, shall be allowed to complete the training prior to returning to active teaching duty. K. Since it is subject important to ratification the education program to know and understand the whole child, teachers should attend and participate in activities of the school such as P.T.O. meetings. They are also encouraged to attend public performances of children in plays, concerts, athletic events, or other extracurricular events. L. A noon lunch period for each teacher shall be free of scheduled duties. Teachers' lunch periods may vary according to scheduling needs. The elementary teachers will have approximately a thirty-five (35) minute lunch period and the lunch period for secondary teachers will be equivalent to a student lunch period. M. The Board will make every reasonable effort to provide a planning period for all teachers. For secondary teachers, the planning period should coincide with the standard class period of the students' schedule. For elementary teachers, efforts will be made to schedule special subjects so as to ensure periods for teacher planning time. Where deemed administratively feasible, these times will be distributed to allow for planning time on a regular daily basis. N. Whenever special teachers are absent, every reasonable effort will be made to provide substitutes. O. Ten hours of PLC/Data meeting to be completed yearly. Date and time each meeting will be mutually agreed upon by both building staff and administration. If mutual agreement cannot be reached the SHEA president and superintendent xxxx xxxxxx and the superintendent will make the final decision on day and time for each month. 1. The purpose of the PLC/Data meeting time is to collaborate and engage in reflective inquiry with PLC members through analyzing data from curriculum based and standardized assessments for the purpose of improving instruction and student learning. Through analysis and reflection teachers should work with their teacher leaders and administrators to develop a plan for improving student learning. 2. PLC/Data teams will be determined at the beginning of the school year with the intent they stay intact throughout the school year. In the event changes need to be made due to unforeseen circumstances, members will receive at least 60 days notice. P. Elementary Planning Time 1. In each week that there is a full five-day week of full days of school for elementary school students, each full time elementary classroom, Title, and related arts teacher shall be provided with an average of 225 minutes of planning time. 2. This Agreement specifically does not apply to any week in which, for any reason, there are less than five student school days or in which, for any reason, there is any student school day that is shorter than a regularly scheduled full day of school. 3. Planning time means any time between the start and end of the student day, excluding lunch time, that a teacher is not instructing or monitoring a class of students. Planning time for an elementary classroom teacher includes, but is not limited to, related arts instruction, library or computer time, and recess time to which the teacher is not assigned to assist in supervision. Planning time for an elementary related arts teacher includes, but is not limited to, all times that the teacher is not assigned to teach a related arts class, excluding travel time. 4. If an activity such as an assembly, field trip, or other similar student activity occurs during a time that an elementary school teacher would otherwise have planning time, said activity will count towards the elementary teachers total 225 weekly minutes. 5. For any full five-day week of full days of school for elementary school students that an elementary teacher is provided less than an average of 225 minutes of planning time, the Board and Associationshall pay such teacher, at his or her contract rate, for the number of minutes that equals 225 minus the actual number of minutes of planning time provided to the teacher during such week. 6. In that event, the exception Elementary Principals shall be memorialized in a Memorandum of Agreement which shall be executed between the partiesnot hold more than one common planning time meeting per month.
