Telecast. If a postponed telecast involves a change in the call of a performer to another broadcast day, it shall be treated as a cancelled telecast. Telecast. Telecast Rights (as defined herein) for the basketball games contracted for in this Agreement are granted to the Conference of the HOME TEAM (or if the HOME TEAM is not a member of a Conference, then to the HOME TEAM), provided that if the Atlantic Coast Conference team is the VISITING TEAM for a game and such game will be played at a neutral site, the grant of Telecast Rights for such game is subject to the prior written approval of the Atlantic Coast Conference. “Telecast” is defined as any distribution, transmission, display, exhibition, projection, duplication, performing of licensing of audiovisual works by which audio and visual materials are combined in any media or technology now known or hereafter created (whether analog, digital or other means) capable of simultaneous receipt by consumers, including, without limitation, over-the-air terrestrial broadcast, cable, MMDS, satellite, high-definition, subscription broadcasts (STV), pay-per-view, video-on-demand, enhanced or interactive television, whether on a free subscription or pay basis, including the re-transmission of any such works. “Telecast Rights” are defined as all rights to distribute, transmit, display, project, duplicate, perform, create derivative works of, or license visual or audiovisual material in any and all media and means of distribution whatsoever, whether now existing or developed in the future, including all Telecast media whatsoever (including, for the sake of clarity and not limitation, terrestrial broadcast, cable, satellite, high-definition, pay-per-view and video-on- demand), the internet and any other form of computer distribution, all forms of enhanced television or interactive media, home video, DVD, distribution to mobile platforms (including, without limitation, PDAs and mobile telephones) and all other forms of new media. A division of the Telecast Rights fees between the HOME TEAM and the VISITING TEAM will be determined prior to the Telecast of any neutral site basketball game as contracted for in this Agreement. In addition, in connection with any Telecast of any such game, all rules, regulations and relevant contractual obligations of the Conferences to which the parties may belong which are applicable to the Telecast of basketball games must be complied with, and the relevant rules and regulations of the NCAA must also be complied with. kee

Telecast. Each game covered hereunder shall be available for telecasting by the Host Institution. The Host Institutional shall have all rights of telecast, including, but not limited to, national network television, national cable, Conference networks, Internet streaming, delayed telecasting, unlimited highlights, institutionally syndicated packages, and telecasting any and all other means. The Visiting Institution agrees to the following: The scheduled start time for the game(s) is solely at the discretion of the Host Institution and may be changed up to six (6) days in advance of the game in order to accommodate television. Any changes in the date of the game(s), including changes for television, must be mutually agreed upon by the participating institutions. Media timeout formats are determined by the Host Institution’s conference. The Visiting Institution may not telecast the game(s) in any way or use any video from the Host Institution’s telecast of the game(s) without written permission of the Host Institution’s conference; provided, however, that the Visiting Institution shall be allowed the use of highlights of the game(s), not to exceed eight (8) minutes in length, for the sole purpose of producing coach’s show and season highlight presentations. The permission, if granted, must be within any limits set by the Host Institution’s conference or telecast rights holder regarding amount of video (time elapsed), where the video may be seen or accessed (i.e., national vs local TV, website, mobile device) and any other restrictions. Notwithstanding the above, immediately following the conclusion of each game hereunder, the Visiting Institution shall have the right to telecast audio and visual highlights not to exceed eight (8) minutes in length.
Telecast. The Home Team shall have all rights to telecast, including, but not limited to, national network television, national cable, Conference network, Internet streaming, delayed telecasting, highlights, and telecasting by any and all other means and media. It is understood that: (i) the Games hosted by Utah have been assigned to the Big 12, which in turn has entered into agreements with certain third parties for the telecast or distribution of such games and the Game hosted by USU has been assigned to the Mountain West Conference, which in turn has entered into agreements with certain third parties for the telecast or distribution of such game; (ii) the Home Team has no ability to grant to the Visiting Team any rights for the telecast or distribution of the Game; and, (iii) the Home Team or its athletics conference (as applicable) shall have the exclusive right to retain all revenues derived from the telecast or distribution of the Game. The Visiting Team authorizes the Home Team (and the Big 12 or Mountain West, as applicable) to use (and to authorize each entity effecting or facilitating the Game’s broadcast to use) the trademarks and logos of the Visiting Team and the names and likenesses of the Visiting Team individual players, mascots, cheerleaders, participants and coaches to promote and publicize the Game and the participating teams and institutions, provided that such trademarks, logos, names and likenesses must not be used as an endorsement of any product or service or in any manner prohibited by applicable NCAA rules and regulations. The parties agree to the following: • The scheduled start time for each Game is solely at the discretion of the Home Team and their athletic conference and may be decided up to six (6) days in advance of a Game to accommodate television. • A change to the date of a Game to accommodate television may occur and the Home Team will engage in a meaningful consultation with the Visiting Team before such date change occurs. A change to the date of a Game for any other reason may also occur and must be mutually agreed to by both parties. • Media timeout formats are determined by athletic conference of the Home Team.
