Temporary Service Suspension. 12.1. AJM's Authority to Implement Measures: AJM reserves the prerogative to independently and prudently apply specific measures, factoring in the prevailing situation, while giving priority to complying with legal requisites applicable to AJM's operations, safeguarding the interests of the Client, AJM, and third parties. These measures can be enacted without prior notice and may include one or more of the following actions: 12.1.1. Suspending the execution of Payment operations. 12.1.2. Temporarily halting all or a portion of Services for the Client. 12.1.3. Restricting the Client's access to their Account. 12.1.4. Temporarily holding disputed funds in the Client's account. 12.1.5. Temporarily freezing the Account, which implies the complete or partial cessation of Payment operations within the AJM account. Also, freezing the Payment instrument, leading to full or partial prohibition of Payment instrument usage. 12.1.6. Under circumstances detailed in Clause 12.3 of the Agreement, returning frozen funds from the Client's AJM account to the original payer.

Temporary Service Suspension. The Customer agrees that it may be necessary for OG-IT to Temporarily suspend Services for technical reasons or to maintain the OG-IT network, the equipment or any other facilities, the timing of which will be as determined by OG-IT. Such suspension of the Services will not be an interruption of the OG-IT Services for the purpose of calculating network availability or the Customer's entitlement to credit for network interruption.

Should any maintenance work or testing be scheduled the Supplier will provide the Customer with a schedule and using a rating of 1-5 indicate the risk to system availability.1 = no risk, 5 = high risk of affecting system availability and reliability. Where the risk is identified at level 4or 5, the Supplier will notify the Customer of the date(s) of the scheduled work, 5 working days ahead of the work being carried out and provide the Customer with a contingency plan with procedural information and estimate timeframes for restoring the site, should the work cause the site to be unavailable within normal business hours

Such suspension of the Service shall continue for as long as any of the circumstances in Clauses 8 continues.

  • Post Suspension 1. Without prejudice to the procedures in Article 190 (Examination of the Benefit Suspension Level), if the Party complained against considers that it has eliminated the non-conformity that the Panel has found, it may provide written notice to the complaining Party with a description of how non-conformity has been removed. If the complaining Party has disagreement, it may refer the matter to the original Panel within 60 days after receipt of such written notice. Otherwise, the complaining Party shall promptly stop the suspension of benefits. 2. The Panel shall release its report within 60 days after the referral of the matter. If the Panel concludes that the Party complained against has eliminated the non-conformity, the complaining Party shall promptly stop the suspension of benefits.

  • Temporary Suspension or Prohibition If the Employee is suspended and/or temporarily prohibited from participating in the conduct of the Bank's affairs by a notice served under Section 8(e)(3) or (g)(1) of the FDIA, 12 U.S.C. § 1818(e)(3) and (g)(1), the Bank's obligations under this Agreement shall be suspended as of the date of service, unless stayed by appropriate proceedings.   • TEMPORARY LEAVE OF ABSENCE A. Members shall be entitled to the following temporary leaves of absence with full pay each school year. Such days of temporary leave must be taken as either one-half (1/2) or one (1) full working day. No personal leaves of absence shall be taken immediately prior to or immediately after holidays or vacations. Any exceptions must be requested in writing to the Superintendent or his designee and must have written approval. 1. Members are entitled to three (3) days personal leave annually subject to advance notice and approval secured from the Superintendent or designee. Personal leave means an activity that requires the member’s presence during the working day and is of such a nature that it cannot be attended to at a time when schools are not in session. Unused personal days shall be transferred to accumulated sick leave time on July 1st each year of this Agreement and all succeeding Agreements. 2. Up to five (5) working days at any one time shall be granted to members in the event of death of a member’s spouse, child, son-in-law, daughter-in-law, parent, father-in-law, mother-in-law, brother, sister, brother-in-law, sister-in-law, grandparent, or any person with whom the member has made his/her home, and any other member of the immediate household. 3. In the case of the death of a near relative, defined as first cousin, uncle, aunt, niece or nephew, there shall be no deduction from personal leave entitlement of up to three (3) days, subject to advance notice to and approval of the Superintendent. 4. A member shall also be granted a reasonable amount of bereavement time with full pay for the purpose of travel in cases where the funeral is out of state. Such time off is subject to the approval of the Assistant Superintendent to whom the member is reportable. 5. Any other leave of absence granted by the Board may be without pay. 6. No leave of absence with pay shall be granted due to the requirements of a second job. 7. Professional leave for such purposes as attending meetings, seminars and visiting other schools may be granted. 8. If a member is subpoenaed by a court of law to appear on behalf of the Board, such member shall do so without loss of pay.

  • Temporary Vacancies The Company and the Union recognize that temporary employees may be required to temporarily provide additional manpower due to vacation, weekly indemnity, excess of work, etc. All temporary employees performing bargaining unit work are members of the bargaining unit and as such all terms and conditions of the collective agreement apply except as herein provided. Individuals may be hired to fill temporary vacancies. Temporary vacancies and employees shall last a maximum of eight (8) calendar weeks. This does not prevent the Company and the Union from mutually agreeing to extend the eight (8) week limitation on an individual basis. However, unless there is written agreement to the contrary, the eight (8) calendar week limitation shall be respected. Should the position be made permanent, the job will be posted as per 9.07(e). Any skills or experience gained by the temporary employee while in the temporary job, shall not be used to determine him more suitable for the position than the employee with seniority who applies. Prior to any layoff all temporary employees will be terminated. Overtime will only be offered to temporary employees after all qualified senior and probationary employees within the classification concerned have refused. Public holidays will be paid to the temporary employees as per the Employment Standards Act Part X (10). Temporary employees will be hired for the applicable classification and wage rate as per Appendix A of the Collective Agreement. Should a temporary employee apply for a job posting and be successful as per Article 9.07 of the Collective Agreement the temporary employee shall then become a probationary employee. The seniority date of a temporary employee who is awarded a full-time position will equal the date the full-time position is awarded. No person, who is or has been employed by the Company outside of the bargaining unit, shall be eligible to work as a temporary employee within the bargaining unit, unless his record of employment with the Company has been severed in excess of one week.
