Temporary Vacancies a. For the first 13 weeks of a temporary vacancy, the Company may fill the vacancy by transferring a qualified bargaining unit employee into the position. If there is no qualified employee in the bargaining unit, the Company may elect to train a bargaining unit employee to fill the position, or it may elect to engage a temporary employee (for work in the Rail Yard) or, engage a contractor (for a Maintenance position or Pipeline or Measurement positions). Temporary employees engaged will be used in accordance with the Letter of Understanding attached to this Agreement. b. A temporary vacancy in a bargaining unit job that exists for more than 13 weeks may be posted and filled in the same manner as a permanent vacancy in 11.05 (c) above. Temporary postings will be for duration of not more than one (1) year; however an extension may be taken by agreement with the Union. c. Employees who are assigned to a temporary vacancy shall be paid the rate for the job in question or their regular rate of pay, whichever is higher. d. An employee may be removed from the temporary assignment if he fails to perform to job standards and will be returned to his/her former classification.

Temporary Vacancies a. The Company may fill any vacancy within the Rail Yard by transferring a qualified bargaining unit employee into the relevant position for a maximum of 26 weeks, cumulative in a 12 month period. If there is no qualified employee(s) in the bargaining unit, the Company may elect to train a bargaining unit employee to fill the position, or it may elect to engage a temporary employee. Temporary employees engaged will be used in accordance with the Letter of Understanding attached to this Agreement. b. The Company may fill any vacancy in a Maintenance, Pipeline or Measurement position(s), for a maximum of 13 weeks by transferring a qualified bargaining unit employee into the relevant position. If there is no qualified employee(s) in the bargaining unit, the Company may elect to train a bargaining unit employee to fill the position, or engage a contractor. c. A temporary vacancy in a bargaining unit job that exists for more than the timelines in 11.06 a and 11.06 b may be posted and filled in the same manner as a permanent vacancy in 11.05 (c) above. Employees who are assigned to a temporary vacancy shall be paid the rate for the job in question or their regular rate of pay, whichever is higher. e. The Company agrees to post at least two (2) relief technician from Operations for any temporary vacancies within one or both of the Lab and Material Handling classifications. The successful candidate will be given the appropriate training in order to perform the work necessary for temporary assignments. g. Special Project work will be posted and filled as per 11.05. h. Employees taking on Special Project work will be limited to one such assignment in any calendar year unless no other candidate applies for such position.
