Term Faculty Member Seniority. (1) Term faculty members shall accumulate seniority based on the total number of hours paid, exclusive of overtime and vacation pay-in-lieu, by a faculty member in the bargaining unit pursuant to his/her term appointment. (2) Term faculty members shall lose all seniority accumulated as a term faculty member in accordance with Articles 12.1(b)(1) and (2) if a period of twenty-four (24) months elapses from the date of the last term appointment to the date at which such an faculty member commences a subsequent term appointment. (3) A term faculty member's seniority credits shall be applied only for the following purposes: (i) determining the term faculty member's incremental entitlement in accordance with Article 24.5(d)(2) herein; (ii) preference for term appointment vacancies in accordance with Article 30.3 herein; (4) Any former term faculty member of the University hired on a subsequent term appointment more than twenty-four (24) months after the end of his previous term appointment shall accumulate term faculty member seniority in accordance with this Article 12.1(b) as a new faculty member starting at a base of zero hours and shall be placed on the salary scale in accordance with the initial placement provisions of Article 24.5(a). (5) Seniority as applied to term faculty members in this Collective Agreement shall be limited to the application of seniority credits only for the purposes identified in Article 12.1(b)(4) above. (6) Seniority will accrue for the contracted term of an appointment if an faculty member is on an approved Workers' Compensation claim.

  • Super Seniority For purposes of layoff and recall only, the President shall head the seniority list, provided however, that such officer must have the necessary skill and experience to perform the required work. The Sheriff agrees that this section shall not be applied in an arbitrary manner.

  • MEMBERS OF DIPLOMATIC MISSIONS AND CONSULAR POSTS Nothing in this Agreement shall affect the fiscal privileges of members of diplomatic missions or consular posts under the general rules of international law or under the provisions of special agreements.

  • Bargaining Unit Seniority The length of continuous service in a position or succession of positions within Bargaining Unit Two (2), beginning with the last date of hire or transfer into the Bargaining Unit, as defined by seniority credits.

  • Transfer and Seniority Outside the Bargaining Unit (a) It is understood that an employee shall not be transferred by the Hospital to a position outside the bargaining unit without his consent except in the case of temporary assignments not exceeding six (6) months. Such employees on temporary assignments shall remain members of the bargaining unit. (b) An employee who is transferred to a position outside the bargaining unit shall not, subject to (c) below, accumulate seniority. In the event the employee is returned by the Hospital to a position in the bargaining unit within twenty-four (24) months of the transfer he or she shall be credited with the seniority held at the time of transfer and resume accumulation from the date of his or her return to the bargaining unit. An employee not returned to the bargaining unit within 24 months shall forfeit bargaining unit seniority. (c) In the event an employee transferred out of the bargaining unit under (b) above is returned to the bargaining unit within a period of six (6) calendar months, he shall accumulate seniority during the period of time outside the bargaining unit."

  • Seniority Roster The District shall maintain an updated seniority roster, indicating employee's class seniority and hire date seniority. Such rosters shall be available to CSEA.

  • Role of Seniority in Layoffs (a) Both parties recognize that job security shall increase in proportion to length of service. Therefore, in the event of a layoff, employees shall be laid off in the reverse order of their bargaining-unit-wide seniority, providing that the retained employees are able to perform the available work. (b) The layoff process will occur in accordance with the Layoff/Recall Policy and Procedures. In no case may this policy override a right or condition outlined within this Collective Agreement.

  • Seniority Date Employees shall acquire seniority upon completion of the probationary period as defined in Article XIII and upon acquiring seniority, the seniority date shall relate back to the first date of continuous service in the bargaining unit. If more than one employee commences work on the same date, lot shall determine seniority ranking for such employees. A District-Wide seniority list will be provided for the exclusive representative no later than November 1 of each year.

  • SPECIALIZED JOB CLASSES Where there is a particular specialized job class in which the pay rate is below the local market value assessment of that job class, the parties may use existing means under the collective agreement to adjust compensation for that job class.

  • Departmental Seniority Departmental seniority is defined as the length of employment within the employee’s current department. Department seniority shall accrue as of the first day of employment or transfer into a new department.
