Testing and Certification. Upon completion of installation of the Equipment, Company shall perform prescribed tests to determine that the Equipment is operating in conformance with Company's published performance specifications for the Equipment and any other requirements agreed to by the parties (hereinafter "Specifications"), a copy of which are attached hereto and incorporated herein as Exhibit C. A three conductor (grounded) power cord, no less than 18 AWG, with an approved hospital grade plug cap, is required. For portable or mobile equipment, the power cord is to be permanently attached; if portable equipment is provided without a permanently attached power cord, Buyer may, in its discretion, attach such permanent cord. Said modification to the Equipment will not affect the Warranty provided hereunder. Grounding resistance is to be less than 0.5 ohms to any exposed conductive surface. Leakage current is to be no more than 50 microamperes (10 microamperes if the Equipment is specified as being patient-isolated) between any patient lead and ground or any other patient lead, with the Equipment on or off, grounded or ungrounded, and correct or reversed polarity. When Company is satisfied that the Equipment is operating in conformance with the Specifications, Company shall produce, document and present to Buyer operational verification data (hereinafter "Equipment Turnover"). In the event the Equipment or any feature or option thereof requires certification under Federal law, Company will complete and file all necessary reports regarding Company's manufacture, assembly, installation or other activity relating to the Equipment.

Testing and Certification. 8.1 Upon completion of installation of the Equipment, Seller shall perform prescribed tests to determine that the Equipment is operating in conformance with the Specifications. 8.2 When Seller is satisfied that the Equipment is operating in conformance with the Specifications, Seller shall produce, document and present to Buyer operational verification data (hereinafter "Equipment Turnover"). In the event the Equipment or any feature or option thereof requires certification under the law, Seller will complete and file all necessary reports regarding Seller's manufacture, assembly, installation or other activity relating to the Equipment.

Testing and Certification. Without limiting Section 5.5(a) or 5.5(b), in connection with each Product Training, Spectrum shall provide testing that verifies that each CAM and other Spectrum Personnel has satisfactorily completed and understood the Product Training. Each CAM and other Spectrum Personnel also must certify at the end of each Product Training session that he/she has completed, understood and agrees to comply with such Product Training.

Testing and Certification. (a) The IESO shall evaluate the ASP’s performance as it relates to Regulation Service through the testing specified in Schedule 2 of this Agreement. (b) The Contract Facility must be Certified at all times it is providing Regulation Service. If, following a Certification Test pursuant to Schedule 2, the Contract Facility is deemed not to have maintained its Certification, the IESO: (i) shall have no obligation to make Monthly Payments to the ASP in respect of the period in which the Contract Facility did not maintain its Certification; and (ii) may exercise all rights and remedies available to it pursuant to Article 7 in connection with such failure.

Testing and Certification. The Client recognizes that the opinions and findings of CSA represent its judgment given with due consideration to this type of Certification, the necessary limitations of practical operation and in accordance with CSA’s objects and purposes and agrees that CSA does not warrant or guarantee its opinions or that its findings will be recognized or accepted by third parties. The Client agrees to accept the opinions and findings of CSA. Detailed test results arising from Services provided under this Agreement will not be divulged to the Client or to any other person or persons except with the mutual consent of the Client and CSA or as otherwise provided in Section 4.0. The Client recognizes that many tests specified in the Requirements may be inherently dangerous and except when injury or damage results solely from negligence on the part of CSA’s personnel, the Client agrees that CSA neither assumes nor accepts any responsibility for any injury or damage to the Client’s or third parties’ property or personnel that may occur during or as a result of tests or examination at the Client’s facilities.
