Time-Only Changes. The DB Contractor may request a Change Order for time extensions, subject to the limitations set forth in Section 15.6.3, for additional time for Completion Deadlines, only for the following: A. Force Majeure Events as described in Section 18.2. B. Failure or inability of the District to provide responses to proposed schedules, design submittals or other submittals and matters for which response by the District is required within the time periods indicated in the Contract Documents, so long as such schedules, design submittals, or other submittals and matters meet all of the applicable requirements of the Contract Documents.

Time-Only Changes. ‌ The DB Contractor may request a Change Order for time extensions, subject to the limitations set forth in Section 15.6.3, for additional time for Completion Dates, only for the following: 1. Force Majeure Events as described in Section 18.2. 2. Failure or inability of the District to provide responses to proposed schedules, design submittals or other submittals and matters for which response by the District is required within the time periods indicated in the Contract Documents, so long as such schedules, design submittals, or other submittals and matters meet all of the applicable requirements of the Contract Documents. Any increase in the contract completion date past the date specified in the RFP will negate the incentive payment portion of the design build fee as detailed in the RFP and Section 19.4 of this DB Agreement. 3. Additional costs and/or time directly attributable to failure or inability of the District to provide the DB Contractor with access to ROW identified on the Intermediate Plans on or before the deadline for such access set forth in this DB Agreement. 4. Additional costs and/or time directly attributable to Differing Site Conditions, to the extent provided in Section 15.8. 5. Certain additional costs (in the case of added Utility Work as described in Section 8) or time relating to discovery of unknown Utilities or uncooperative Utilities, as described in Section 8, to the extent provided therein. 6. Certain additional costs and/or time relating to material errors in the ROW Drawings, as described in Section 15, to the extent provided therein. Changes in the Work ‌ This Section 15 sets forth the requirements for obtaining all Change Orders under the Contract. The DB Contractor hereby acknowledges and agrees that the Contract Price constitutes full compensation for performance of all Work, subject only to those exceptions specified in this Section 15, and that the District is subject to constraints which limit its ability to increase the Contract Price or extend the Completion Dates. The DB Contractor hereby waives the right to make any Claim for a time extension or for any monetary compensation in addition to the Contract Price and other compensation specified in the Contract, except as set forth in this Section 15.

  • Business Changes Change in any material respect the nature of the business of the Borrower or its Subsidiaries as conducted on the Effective Date.

  • Interim Changes Since the date of its balance sheets, except as set forth in Exhibit C, there have been no (1) changes in financial condition, assets, liabilities or business of Amalgamated which, in the aggregate, have been materially adverse; (2) damages, destruction or losses of or to property of Amalgamated, payments of any dividend or other distribution in respect of any class of stock of Amalgamated, or any direct or indirect redemption, purchase or other acquisition of any class of any such stock; or (3) increases paid or agreed to in the compensation, retirement benefits or other commitments to its employees.

  • Eligibility Changes Employees who become eligible for a full Employer Contribution must make their benefit elections within thirty (30) calendar days of becoming eligible. If employees do not choose a health plan administrator and a primary care clinic and do not waive coverage within this thirty (30) day timeframe, they will be enrolled in a Benefit Level Two clinic (or Level One, if available) that meets established access standards in the health plan with the largest number of Benefit Level One and Two clinics in the county of the employee’s residence at the beginning of the insurance year. If employees who become eligible for a partial Employer Contribution choose to enroll in insurance, they must do so within thirty (30) days of becoming eligible or during open enrollment. An employee may change their health or dental plan if the employee changes to a new permanent work or residence location and the employee's current plan is no longer available. If the employee has family coverage and if the new residence location is outside of the current plan’s service area, the employee shall be permitted to switch to a new plan administrator and new Benefit Level within thirty (30) days of the residence location change. The election change must be due to and correspond with the change in status. An employee who receives notification of a work location change between the end of an open enrollment period and the beginning of the next insurance year, may change their health or dental plan within thirty (30) days of the date of the relocation under the same provisions accorded during the last open enrollment period. An employee or retiree may also change health or dental plans in any other situation in which the Employer is required by the applicable federal or state law to allow a plan change.

  • Service Changes PBI may modify its Service by giving written notice to you (a “Service Change Notice”), which will state whether the change is material. After receiving a Service Change Notice, if the change is material, you may terminate Service by giving us a termination notice at the address indicated in Section 21 or you may create a case at xxxxxxxxxxx.xxx/xx/xxxxxxx-xx.xxxx (follow the instructions under “how to create a case”).

  • Room Changes No changes in room assignment will be based upon age, race, religion, national origin, disability, sexual orientation, and online profiles except as needed to provide a reasonable accommodation to residents with eligible disabilities registered with the College Office of Counseling and Disability Services. Room change may only be made with the written approval of College Housing and is dependent upon space availability, timing of the request, and grounds for transfer. Residents who receive approval for a room change may be charged a room change fee as shown on the College Housing website, which will be posted to Resident’s account.   • Schedule Changes (a) If, in the course of a posted schedule, the Employer: (i) changes Employees’ scheduled days off without giving 14 days’ notice of the change, they shall be paid 2X their Basic Rate of Pay for all hours worked on what would otherwise have been their off-duty days. (ii) changes Employees’ scheduled Shift, but not their scheduled days off, without giving 14 days’ notice of the change, they shall be paid 2X their Basic Rate of Pay for all hours worked during the first Shift of the changed schedule. (b) Employees shall be notified of such changes in their schedule and such changes shall be recorded on the Shift schedule. (c) An Employee or the Employer may, during the course of a posted schedule, ask to amend scheduled Shifts. Such Employee requests shall be granted where operationally possible without additional cost. Where mutually agreed, the requirements for 14 days’ notice of change and the resultant penalty pay as described in Article 7.04(a) shall not apply. Employees or the Employer should make such requests as far in advance as possible in order to maximize the ability to accommodate the request. Any Shift changes made by mutual agreement shall not violate the scheduling provisions of this Article.

  • Minor Changes Within Sale Area, minor adjustments may be made in boundaries of cutting units or in the timber individually Marked for cutting when ac- ceptable to Purchaser and Forest Service.
