Tribal Communities and Organizations. COUNTY shall regularly review population information available through Census, compare to information obtained in the California Outcome Measurement System for Treatment (CalOMS-Tx) to determine whether the population is being reached, and survey Tribal representatives for insight in potential barriers to the substance use service needs of the American Indian/Alaskan Native (AI/AN) population within the COUNTY geographic area. Contractor shall also engage in regular and meaningful consultation and collaboration with elected officials of the tribe, Rancheria, or their designee for the purpose of identifying issues/barriers to service delivery and improvement of the quality, effectiveness, and accessibility of services available to AI/AN communities within the COUNTY.

CONTRACTOR shall comply with, and assist the COUNTY in complying with, the privacy requirements of the Health Insurance Portability and Accountability Act (including but not limited to 45 Code of Federal Regulations (CFR) parts 5b; 160, 162 and 164), hereinafter collectively referred to as the “Privacy Rule”. 2. CONTRACTOR may use or further disclose any Protected Health Information, provided by or obtained on behalf of the COUNTY, to perform functions, activities or services as specified in this Addendum, provided that such use or disclosure does not violate the Privacy Rule as it applies to the COUNTY. 3. CONTRACTOR shall not use or disclose Protected Health Information other than as permitted or required by this Addendum or as required by State or Federal Regulations. 4. CONTRACTOR shall use appropriate safeguards to prevent use or disclosure of Protected Health Information other than as provided for in this Addendum. 5. CONTRACTOR shall report to the COUNTY any use or disclosure of Protected Health Information not provided for in this Addendum of which it becomes aware. 6. CONTRACTOR shall ensure that any agent, including subcontractors, with whom it shares (creates, receives, provides) Protected Health Information on behalf of the COUNTY, agrees to applicable restrictions and conditions with respect to such information. 7. CONTRACTOR shall provide access, at the request of the COUNTY, and in the time and manner designated by the COUNTY, to Protected Health Information in a Designated Record Set, to the County or, as directed by the COUNTY, to an Individual in order to meet the requirements of 45 CFR 164.524. 8.
