Use of Equipment Space. The Licensee shall not conduct any upgrades to the Space and Equipment without the prior written consent of North Forge. The Licensee shall immediately notify North Forge of any accident, lost, defect, stolen and/or damaged Space and Equipment. The Licensee shall at its sole cost be responsible for the actual cost value of lost, stolen and/or damaged Space and Equipment, except in the case of reasonable wear and tear. The Equipment shall at all times be and remain the exclusive property of North Forge and the Licensee will have no right of property in the Space and Equipment except to use the Space and Equipment on the terms and conditions in this Agreement.

Use of Equipment Space. By accepting an order for colocation services, Verizon grants Customer an exclusive, limited license (“License”) to use Equipment Space at the Facility for the sole purpose of installing, operating and maintaining Customer’s Colocation Equipment in accordance herewith. Customer acknowledges that it has not been granted any real property interest in Equipment Space or the Facility. Payments by Customer do not create or vest in Customer (or in any other entity or person) any leasehold estate, easement, ownership interest, or other property right or interest of any nature in the Facility or any part thereof. The Parties intend and agree that Customer’s Colocation Equipment, whether or not physically affixed to the Facility, are not fixtures and will not be construed as such. Customer (or the lessor of Customer’s Colocation Equipment, if applicable), will report Customer’s Colocation Equipment as its personal property wherever required by applicable laws and will pay all taxes levied upon such Customer’s Equipment. This Service Attachment and the agreements herein are expressly made subject and subordinate to the terms and conditions of any underlying ground or facilities lease or other superior right by which Verizon or its Affiliates have acquired its interest in the Facility. The actual location of Equipment Space within the Facility will be designated by Verizon prior to installation. Customer shall not make any changes or alterations to Equipment Space except as is reasonably necessary to install Customer’s Equipment, conduct Customer’s business or remove Customer’s Equipment.
Use of Equipment Space. The Equipment Space shall not be available for use by any entity or person except the Provider and the Provider’s use of the Equipment Space shall be limited to the placement of Provider’s equipment and materials.
Use of Equipment Space. The Licensee shall use the Equipment Space only for the purpose of the installation, operation, maintenance, repair and replacement of the Licensee’s Equipment as required by the Licensee for the purpose of providing communications services to the Licensee’s customers in the Building.
Use of Equipment Space. (a) Customer will be entitled to occupy and use the space (the “Equipment Space”) within Banks Facility only for placement and maintenance of telecommunications or Internet access equipment. Banks Data/Com shall have the right to access the Equipment Space for any business purpose at all times. Banks Data/Com may provide certain equipment (“Banks Data/Com Equipment”) used to deliver the products and services pursuant to the attached MSA. Banks Data/Com shall use reasonable efforts to provide and maintain the Banks Data/Com Equipment in good working order. Banks Data/Com shall be entitled to remove all Banks Data/Com Equipment for repair, replacement, or otherwise as Banks Data/Com may determine is necessary, but Banks Data/Com shall use reasonable efforts to minimize disruptions to the service provided to Customer caused thereby. Customer shall not and shall not permit others to rearrange, disconnect, remove, and attempt to repair or otherwise tamper with any of the Banks Data/Com Equipment.
