Use of Goods. Except as otherwise expressly authorized by the Bank, any goods procured with the resources of the Loan shall be used exclusively for the purposes of the Project.

Use of Goods. Except with the express authorization of the Bank, the goods acquired with the resources of the Financing shall be used exclusively for the purposes of the Project. Once the Project has been completed, the construction machinery and equipment utilized in the execution of the Project may be used for other purposes.
Use of GoodsBuyer shall use all appropriate safety devices, guards, and safe operating procedures (whether or not specified by Seller), and properly instruct employees in the use of the Goods and comply with all OSHA regulations and ANSI standards. BUYER SHALL NOT REMOVE OR MODIFY ANY SAFETY DEVICE, GUARD OR WARNING SIGN OR MODIFY THE MACHINE IN ANY WAY. Buyer acknowledges that certain of the Goods may not be susceptible to placement of devices and guard, which will protect operator in all possible uses. Buyer shall notify Seller immediately of any accident or malfunction involving the Goods, which results in personal injury or property damage and shall cooperate fully in investigating causes of same. Buyer shall indemnify, defend and hold Seller harmless against any and all claims or damages (including attorney’s fees and legal expenses) in any way related to the use of the Goods by Buyer.

Use of Goods. Xxxxx acknowledges and agrees that Seller is in no way responsible for the use of the Goods by Xxxxx, that Seller cannot anticipate all conditions under which the Goods may be used and that Buyer shall conduct its own tests to determine the safety and suitability of the Goods for Buyer’s purposes. Any representations or other statements concerning the Goods, other than those in Seller’s quotations and order acknowledgements, these Terms and Conditions of Sale, any other document issued by Seller, or any other document signed by both Xxxxx and Seller, are not binding on Seller and Seller shall not be liable for any such representations or other statements.
Use of Goods. Ensure the Goods are used, operated and serviced properly and safely using recognised and approved methods and standards of operation and servicing in accordance with the manufacturer's instructions, specifications and recommendations using proper parts and without risk to health. Keep or maintain the Goods in good repair and condition, fair wear and tear excepted. You will give the Lender (if it reasonably requests) all proper parts for this purpose.
Use of GoodsThe User undertakes that it shall: 6.1 Use the Goods only for the purposes and in the manner for which it is intended to be used. 6.2 Keep the Goods free from the claims of other parties or from attachment and shall not alienate, assign or charge the Goods or any part thereof with any encumbrance or allow any lien to arise thereon or affix the Goods to any other property with the intention of or in such a manner that the Goods become affixed thereto. 6.3 Allow the Hirer or its agent reasonable access for the inspection and/or reparation of the Goods. 6.4 Keep the Goods in its custody and under its control at the premises mentioned in the Definition Schedule and shall obtain the Hirer's written consent for the removal thereof to other premises. The User shall regularly pay the rental of the premises where the Goods are kept and shall comply with all statutes, regulations or other contractual obligations pertaining to its occupation of the premises. 6.5 Not use the Goods in contravention of any statute, regulation or any law and shall strictly adhere to the Hirer's or the manufacturer's instructions as to the use and servicing of the Goods, and shall only use such consumables as are approved by the Hirer.

Use of Goods. 16.8.1 The Client shall bring to the attention of all persons using the Goods all of CMI's instructions and recommendations for the use thereof. 16.8.2 The Client shall not remove or deface any label affixed to the Goods referring any user thereof to CMI's instructions and or recommendations for use. 16.8.3 If any item comprised in the Goods is resold by the Client, the Client shall bring to the attention of its purchaser all of CMI's or the manufacturer's instructions and recommendations for use of the Goods. 16.8.4 On such resale as contemplated in sub-clause 16.8.3 the Client shall exact an enforceable undertaking from its purchaser not to remove any label affixed to the Goods which refers any user thereof to CMI's or the manufacturer's instructions and recommendations for use of the Goods and that such purchaser shall take such steps as are necessary to ensure that there will be available in connection with the use of the Goods adequate information about the use for which they were designed and about any conditions necessary to ensure that when put to that use they will be safe and without risk to health; and a) Subject to the provisions of sub-clause 10.13, the Client shall indemnify CMI against all third-party claims which arise in connection with the Client’s breach of the terms of sub- clauses 16.8.3 and 16.8. 16.8.5 The Client shall be solely responsible for the disposal of the Goods and packaging; and a) Shall be solely responsible for its obligations under the Waste Electrical and Electronic Equipment Directive (2012/19/EU), the Packaging Waste Directive (94/62/EC) and Batteries Directive (2006/66/EC), as applicable.
Use of Goods must ensure that Goods are used only in Customer’s general business operations and only for the purposes for which they were designed, by qualified personnel complying at all times with all laws relating to Goods and their use and with all instructions and recommendations issued by the supplier or manufacturer of Goods and, if the law requires Goods to be registered, Customer must attend to this and ensure they remain registered at all times;
Use of Goods. In bailment, the bailee can use the goods so delivered, but in pledge the pawnee has no right to use them.
