Use of Internet Services. 2.1 The Service is limited to use by Customer and its End Users. Customer must notify ACE DATA CENTERS within [**] days of any notices received by Customer that could adversely affect ACE DATA CENTERS including, but not limited to, notices of claims or proceedings that involve the Service. Customer must promptly notify ACE DATA CENTERS of any errors, “bugs,” or problems experienced in using the Service. ACE DATA CENTERS exercises no control over, and accepts no responsibility for, the informational content traversing the Service. EXCEPT AS EXPRESSLY SET FORTH IN SECTION 6.0 BELOW, ACE DATA CENTERS MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, FOR THE SERVICE AND IT DISCLAIMS ANY WARRANTY OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. Use of any information involving the Service is at Customer’s and End Users’ own risk. ACE DATA CENTERS specifically denies any responsibility for the accuracy or quality of information obtained via the Service.
Use of Internet Services. ArkLaFiber shall provide Customer with * under the terms and conditions embodied in this Agreement. Customers may not resell or redistribute any portion of the Internet Connectivity to any third party for financial gain. Customer agrees that the use of the Internet Connectivity by the Users will be subject to the terms and conditions hereof. Customer agrees that Customer is fully responsible for the Users’ conduct while using the Internet Connectivity, and for any consequences if such individual misuses the Internet Connectivity, violates this Agreement, or accesses material or information which Customer or any User determines as obscene or otherwise objectionable. Fees and Payment Regardless of whether or not Customer uses the Internet Services, ArkLaFiber will charge Customer for which shall be paid by Customer on the first day of each month during the term of this Agreement (the “Internet Fee”). The initial installation (one time fee) charge for set-up and installation of all equipment and configuration is $299. Gumbo Residential Customers will receive a discounted installation fee of $100.00. ArkLaFiber will bill and collect the first month installation fee and the Internet Plan will be prorated during the first month of the contract. From time to time, ArkLaFiber may add or modify certain services relating to the Internet Connectivity, and ArkLaFiber reserves the right to charge Customer additional or different fees for providing such new or modified services to Customer upon acceptance of the changes by the Customer. Customers will also be liable for all attorney and collection fees arising from efforts to collect any unpaid balances on Customer’s Account. Breach of this contract will result in the loss of the discounts on installation fees and the sum of which will become due and payable immediately.

Installation By signing this Agreement/Order Form, you are giving ArkFiber the right to install its facilities underground to your service location. ArkFiber will install a small box on the outside of the house. Then drill a small hole in the wall of the building to get a fiber cable inside your house to another small box mounted to a wall. Then a patch cable will be installed from the small inside box to the router. The Router is required and will be leased to you for $10.00 per month. The Router will provide wifi (wireless internet) inside your house. The router will require AC power which you will provide. Depending on the size and structure type of house additional access points may be needed, and an additional router can be leased for $10.00 per month. If for some reason you no longer want our service, you are legally obligated to return our router/routers via mail to our address: 000 Xxxxxxx Xxxxxx, West Monroe, LA 71291. If the router gets misplaced you will be billed a fee of $200.00. Uncensored Internet Access YOU UNDERSTAND THAT THE INTERNET SERVICES PROVIDES FULL, UNCENSORED ACCESS TO MATERIALS ON THE INTERNET CREATED AND MAINTAINED BY UNAFFILIATED THIRD PARTIES. ArkLaFiber EXERTS NO EDITORIAL CONTROL OVER SUCH MATERIALS, PORTIONS OF WHICH MAY BE CONSIDERED SEXUALLY EXPLICIT, OBSCENE OR OTHERWISE OFFENSIVE. IN NO EVENT SHALL ArkLaFiber BE LIABLE TO ANY PERSON OR ENTITY, EITHER DIRECTLY OR INDIRECTLY, WITH RESPECT TO ANY MATERIALS FROM THIRD PARTIES ACCESSED THROUGH THE INTERNET SERVICES. Your Internet Connectivity, violates this Agreement, or accesses material or information which Customer or any User determines as obscene or otherwise objectionable. Installation Fees and Payment ArkLaFiber will charge Customer RECURRING SERVICE WITH PRICES, which shall be paid by Customer on the first day of each month during the term of this Agreement (the “Internet Fee”). Use of Internet Services. The Macon County School System provides access to the Internet for staff members and students. Use of Internet services shall be for the purpose of education and research in accordance with the school system’s educational objectives. Parents or legal guardians of students are required to sign the Internet Access Agreement form giving permission for their students to access the Internet. Students, also, are required to sign the aforementioned form verifying that they have read, understand and agree to the conditions and rules for use of Internet services.

  • Internet Services Transfer Agent shall make available to Fund and Shareholders, through its web sites, including but not limited to xxx.xxxxxxxxxxxxx.xxx (collectively, “Web Site”), online access to certain Account and Shareholder information and certain transaction capabilities (“Internet Services”), subject to Transfer Agent’s security procedures and the terms and conditions set forth herein and on the Web Site. Transfer Agent provides Internet Services “as is,” on an “as available” basis, and hereby specifically disclaims any and all representations or warranties, express or implied, regarding such Internet Services, including any implied warranty of merchantability or fitness for a particular purpose and implied warranties arising from course of dealing or course of performance. Transfer Agent shall at all times use reasonable care in performing Internet Services under this Agreement.
