Use of Internet Services. 2.1 The Service is limited to use by Customer and its End Users. Customer must notify ACE DATA CENTERS within [**] days of any notices received by Customer that could adversely affect ACE DATA CENTERS including, but not limited to, notices of claims or proceedings that involve the Service. Customer must promptly notify ACE DATA CENTERS of any errors, “bugs,” or problems experienced in using the Service. ACE DATA CENTERS exercises no control over, and accepts no responsibility for, the informational content traversing the Service. EXCEPT AS EXPRESSLY SET FORTH IN SECTION 6.0 BELOW, ACE DATA CENTERS MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, FOR THE SERVICE AND IT DISCLAIMS ANY WARRANTY OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. Use of any information involving the Service is at Customer’s and End Users’ own risk. ACE DATA CENTERS specifically denies any responsibility for the accuracy or quality of information obtained via the Service.

Use of Internet Services. ArkLaFiber shall provide Customer with * under the terms and conditions embodied in this Agreement. Customers may not resell or redistribute any portion of the Internet Connectivity to any third party for financial gain. Customer agrees that the use of the Internet Connectivity by the Users will be subject to the terms and conditions hereof. Customer agrees that Customer is fully responsible for the Users’ conduct while using the Internet Connectivity, and for any consequences if such individual misuses the Internet Connectivity, violates this Agreement, or accesses material or information which Customer or any User determines as obscene or otherwise objectionable. Regardless of whether or not Customer uses the Internet Services, ArkLaFiber will charge Customer for installation of all equipment and configuration is $299. Gumbo Residential Customers will receive a discounted installation fee of $100.00. ArkLaFiber will bill and collect the first month installation fee and the Internet Plan will be prorated during the first month of the contract. From time to time, ArkLaFiber may add or modify certain services relating to the Internet Connectivity, and ArkLaFiber reserves the right to charge Customer additional or different fees for providing such new or modified services to Customer upon acceptance of the changes by the Customer. Customers will also be liable for all attorney and collection fees arising from efforts to collect any unpaid balances on Customer’s Account. Breach of this contract will result in the loss of the discounts on installation fees and the sum of which will become due and payable immediately.
Use of Internet Services. 10.1 The Customer shall at all times comply with the Acceptable Use Policy and particularly undertakes not to use or permit anyone else to use the Internet Services and Connection: 10.1.1 To send a message or communication which is offensive, abusive, indecent, obscene or menacing; or 10.1.2 To cause annoyance or inconvenience; or 10.1.3 In a manner which is contrary to any applicable Law. 10.2 The Customer shall keep Metrotech indemnified against all liabilities, claims, damages, losses, proceedings, compensation, costs and expenses arising out of, or in any way connected with, any such use of the Internet Services and Connection by the Customer which infringes the Acceptable Use Policy, provided that Metrotech shall not compromise, admit or settle any such actions without the prior written consent of the Customer which is not to be unreasonably withheld or delayed.

ArkLaFiber will bill and collect the first month’s installation fee and the Internet Plan will be prorated during the first month of the contract. From time to time, ArkLaFiber may add or modify certain services relating to the Internet Connectivity, and ArkLaFiber reserves the right to charge Customer additional or different fees for providing such new or modified services to Customer upon acceptance of the changes by the Customer. Use of Internet Services. The Macon County School System provides access to the Internet for staff members and students. Use of Internet services shall be for the purpose of education and research in accordance with the school system’s educational objectives. Parents or legal guardians of students are required to sign the Internet Access Agreement form giving permission for their students to access the Internet. Students, also, are required to sign the aforementioned form verifying that they have read, understand and agree to the conditions and rules for use of Internet services.
Use of Internet Services. 5.1 Except for the Filtering Services, the Customer acknowledges the Contractor does not in any way supervise, aid or control the content and form of any information or data accessed through the Internet Services. 5.2 The Customer will not and shall use reasonable endeavours to ensure that its Users do not use the Internet Services: (a) for any illegal, fraudulent or defamatory purposes; (b) to engage in the bulk transmission of unsolicited electronic mail;

Use of Internet Services. ArkLaFiber shall provide Customer with RECURRING SERVICEunder the terms and conditions embodied in this Agreement. Customers may not resell or redistribute any portion of the Internet Connectivity to any third party for financial gain. Customer agrees that the use of the Internet Connectivity by the Users will be subject to the terms and conditions hereof. Customer agrees that Customer is fully responsible for the Users’ conduct while using the Internet Connectivity, and for any consequences if such individual misuses. By signing this Agreement/Order Form, you are giving ArkFiber the right to install its facilities underground to your service location. ArkFiber will install a small box on the outside of the house. Then drill a small hole in the wall of the building to get a fiber cable inside your house to another small box mounted to a wall. Then a patch cable will be installed from the small inside box to the router. The Router is required and will be leased to you for $10.00 per month. The Router will provide wifi (wireless internet) inside your house. The router will require AC power which you will provide. Depending on the size and structure type of house additional access points may be needed, and an additional router can be leased for $10.00 per month. If for some reason you no longer want our service, you are legally obligated to return our router/routers via mail to our address: 000 Xxxxxxx Xxxxxx, West Monroe, LA 71291. If the router gets misplaced you will be billed a fee of $200.00. YOU UNDERSTAND THAT THE INTERNET SERVICES PROVIDES FULL, UNCENSORED ACCESS TO MATERIALS ON THE INTERNET CREATED AND MAINTAINED BY UNAFFILIATED THIRD PARTIES. ArkLaFiber EXERTS NO EDITORIAL CONTROL OVER SUCH MATERIALS, PORTIONS OF WHICH MAY BE CONSIDERED SEXUALLY EXPLICIT, OBSCENE OR OTHERWISE OFFENSIVE. IN NO EVENT SHALL ArkLaFiber BE LIABLE TO ANY PERSON OR ENTITY, EITHER DIRECTLY OR INDIRECTLY, WITH RESPECT TO ANY MATERIALS FROM THIRD PARTIES ACCESSED THROUGH THE INTERNET SERVICES. Your Internet Connectivity, violates this Agreement, or accesses material or information which Customer or any User determines as obscene or otherwise objectionable.   • Internet Services Transfer Agent shall make available to Fund and Shareholders, through its web sites, including but not limited to xxx.xxxxxxxxxxxxx.xxx (collectively, “Web Site”), online access to certain Account and Shareholder information and certain transaction capabilities (“Internet Services”), subject to Transfer Agent’s security procedures and the terms and conditions set forth herein and on the Web Site. Transfer Agent provides Internet Services “as is,” on an “as available” basis, and hereby specifically disclaims any and all representations or warranties, express or implied, regarding such Internet Services, including any implied warranty of merchantability or fitness for a particular purpose and implied warranties arising from course of dealing or course of performance. Transfer Agent shall at all times use reasonable care in performing Internet Services under this Agreement.

  • Internet Service In the event that internet is required during your stay, please verify that the Property selected provides the service. Rules of the House: In the event there are rules specific to your Property either required by the Owner or if applicable from an HOA, they will be posted at the home and your compliance is necessary. Rental Unit for Sale: Occasionally a Property may go on the market for sale. In such cases Agent reserves the right to show the Property to potential buyers. Agent will make every effort to schedule the showing at a time that is convenient for Tenant, so as not to interrupt your vacation. Tenant’s cooperation is appreciated. Consumable Products: Paper products, laundry/dish detergent, personal toiletry items and food staples are not included in the Properties. Linens: Linens are included with all Properties for reservations up to 2 days or more. If linens and towels are damaged or missing there will be an added fee to replace and/or clean those items. Linens and towels should only be used for sleeping in and drying off. Damaged or missing bath towels are $25, hand towels are $15, wash cloths are $10, sheets are $30, pillow cases are $15, and bath mats are $20. Damaged items might include makeup, blood stains, excessive dirt, tanning lotion, and human waste.

  • Use of the Services 1.1 We will make the Oracle services listed in Your order (the “Services”) available to You pursuant to this Agreement and Your order. Except as otherwise stated in this Agreement or Your order, You have the non- exclusive, worldwide, limited right to use the Services during the period defined in Your order, unless earlier terminated in accordance with this Agreement or Your order (the “Services Period”), solely for Your internal business operations. You may allow Your Users (as defined below) to use the Services for this purpose, and You are responsible for their compliance with this Agreement and Your order. 1.2 The Service Specifications describe and govern the Services. During the Services Period, we may update the Services and Service Specifications (with the exception of the Data Processing Agreement as described below) to reflect changes in, among other things, laws, regulations, rules, technology, industry practices, patterns of system use, and availability of Third Party Content (as defined below). Oracle updates to the Services or Service Specifications will not materially reduce the level of performance, functionality, security or availability of the Services during the Services Period of Your order. 1.3 You may not, and may not cause or permit others to: (a) use the Services to harass any person; cause damage or injury to any person or property; publish any material that is false, defamatory, harassing or obscene; violate privacy rights; promote bigotry, racism, hatred or harm; send unsolicited bulk e-mail, junk mail, spam or chain letters; infringe property rights; or otherwise violate applicable laws, ordinances or regulations; (b) perform or disclose any benchmarking or availability testing of the Services; (c) perform or disclose any performance or vulnerability testing of the Services without Oracle’s prior written approval, or perform or disclose network discovery, port and service identification, vulnerability scanning, password cracking or remote access testing of the Services; or (d) use the Services to perform cyber currency or crypto currency mining ((a) through (d) collectively, the “Acceptable Use Policy”). In addition to other rights that we have in this Agreement and Your order, we have the right to take remedial action if the Acceptable Use Policy is violated, and such remedial action may include removing or disabling access to material that violates the policy.

  • Voice Services In lieu of any other rates and discounts, Customer will pay fixed per-minute rates ranging from $0.000 to $0.000 for the following Voice Services: Domestic Voice Service: Domestic Outbound Voice Service, including Calling Card and Domestic Inbound Voice Service based on origination and termination type.   • Web Services Our Web Services are designed to enable you to easily establish a presence on the Internet. Our Web Hosting and Design is composed of our Web Hosting and Design Publishing Component and other miscellaneous components. These components may be used independently or in conjunction with each other.

  • Internet Use Customer assumes total responsibility for its and its users’ use of the Internet. Masergy specifically disclaims any warranties, endorsements or representations regarding any merchandise, information, software, products, data, files, or services provided through the Internet.

  • Use of Services Subject to the terms of this Agreement, Stripe grants you a worldwide, non-exclusive, non-transferable, non-sublicensable, royalty-free license during the Term to access the Documentation, and access and use the Stripe Technology, as long as your access and use is (a) solely as necessary to use the Services; (b) solely for your business purposes; and (c) in compliance with this Agreement and the Documentation.

  • Beta Services From time to time, We may invite You to try Beta Services at no charge. You may accept or decline any such trial in Your sole discretion. Beta Services will be clearly designated as beta, pilot, limited release, developer preview, non-production, evaluation or by a description of similar import. Beta Services are for evaluation purposes and not for production use, are not considered “Services” under this Agreement, are not supported, and may be subject to additional terms. Unless otherwise stated, any Beta Services trial period will expire upon the earlier of one year from the trial start date or the date that a version of the Beta Services becomes generally available. We may discontinue Beta Services at any time in Our sole discretion and may never make them generally available. We will have no liability for any harm or damage arising out of or in connection with a Beta Service.

  • Use of Verizon Telecommunications Services 2.1 Verizon Telecommunications Services may be purchased by Z-Tel under this Resale Attachment only for the purpose of resale by Z-Tel as a Telecommunications Carrier. Verizon Telecommunications Services to be purchased by Z-Tel for other purposes (including, but not limited to, Z-Tel’s own use) must be purchased by Z-Tel pursuant to other applicable Attachments to this Agreement (if any), or separate written agreements, including, but not limited to, applicable Verizon Tariffs. 2.2 Z-Tel shall not resell: 2.2.1 Residential service to persons not eligible to subscribe to such service from Verizon (including, but not limited to, business or other nonresidential Customers); 2.2.2 Lifeline, Link Up America, or other means-tested service offerings, to persons not eligible to subscribe to such service offerings from Verizon; 2.2.3 Grandfathered or discontinued service offerings to persons not eligible to subscribe to such service offerings from Verizon; or 2.2.4 Any other Verizon service in violation of a restriction stated in this Agreement (including, but not limited to, a Verizon Tariff) that is not prohibited by Applicable Law. 2.2.5 In addition to any other actions taken by Z-Tel to comply with this Section 2.2, Z-Tel shall take those actions required by Applicable Law to determine the eligibility of Z-Tel Customers to purchase a service, including, but not limited to, obtaining any proof or certification of eligibility to purchase Lifeline, Link Up America, or other means-tested services, required by Applicable Law. Z-Tel shall indemnify Verizon from any Claims resulting from Z-Tel’s failure to take such actions required by Applicable Law. 2.2.6 Verizon may perform audits to confirm Z-Tel’s conformity to the provisions of this Section 2.2. Such audits may be performed twice per calendar year and shall be performed in accordance with Sections 4.4.2 through 4.4.4 of the General Terms and Conditions. 2.3 Z-Tel shall be subject to the same limitations that Verizon’s Customers are subject to with respect to any Telecommunications Service that Verizon grandfathers or discontinues offering. Without limiting the foregoing, except to the extent that Verizon follows a different practice for Verizon Customers in regard to a grandfathered Telecommunications Service, such grandfathered Telecommunications Service: (a) shall be available only to a Customer that already has such Telecommunications Service; (b) may not be moved to a new service location; and, (c) will be furnished only to the extent that facilities continue to be available to provide such Telecommunications Service. 2.4 Z-Tel shall not be eligible to participate in any Verizon plan or program under which Verizon Customers may obtain products or services which are not Verizon Telecommunications Services, in return for trying, agreeing to purchase, purchasing, or using, Verizon Telecommunications Services. 2.5 In accordance with 47 CFR § 51.617(b), Verizon shall be entitled to all charges for Verizon Exchange Access services used by interexchange carriers to provide service to Z-Tel Customers.
