Use of Product. (S) Customer will restrict use of any Product(s) Licensed hereunder to only Customer employees and consultants. Customer will also restrict usage of the Product(s) to the number of Authorised Users designated in this Agreement and in any applicable Schedule. Customer will use Product(s) for own in-house use in accordance with conditions set out in documentation accompanying Product(s). Customer further agrees not to reproduce, copy, or duplicate Product(s) except for backup purposes, or to use the Product(s) outside the country in which Product(s) were first delivered to Customer.
Use of Product. The Product may be used only for, by and on behalf of Customer and only in connection with Customer's business operations. This license is granted only for use at a single location identified in Appendix A and upon a single computer system (CPU) identified in Appendix A and may not be used upon any other computer or at any other location except as provided under Paragraph 1.4.
Use of Product. Licensee may make unlimited copies of the VIC Editor and the Editable Template Case for its internal use of Product in the creation/generation and editing of VIC Case Files. Licensee may make copies of the (a) VIC Player and preloader, (b) VIC Library files/images, and (c) Product documentation, as reasonably required for use of VIC Case Files by Licensee’s authorized end-user(s). A “Licensee’s authorized end-user(s)” is defined as an employee, clinical staff member, researcher, student, or trainee of a Licensee.
Use of Product. We shall not be liable in the event the goods are not suitable for the purpose the customer had intended. We shall not provide compensation for damages that occur as a result of the further processing of the goods. In as far as we supply technical consultation or assistance for the application of our products, this is done on the basis of our latest technical experience. However, this shall not entitle the customer to derive any warranty or replacement claims of any kind therefrom.
Use of Product. Buyer hereby represents and warrants that it is purchasing the Product(s) for its own use and that it will not re-sell or otherwise transfer the Product(s) to third parties other than in connection with the incorporation of the Product(s) into its products or into third party products in connection with toll packing arrangements.
Use of Product. The parties understand and agree that the Purchaser is solely responsible to determine the suitability of the Product for the Purchaser’s intended use and, except as otherwise provided in this paragraph, the Purchaser shall indemnify and hold AVID harmless from any claims or consequential damages or costs arising from or related to any and all uses of the Product. The parties understand that AVID may require Purchaser to sign a Product Acceptance and Release Agreement prior to the beginning the production of Product in volumes beyond the engineering prototype level.
Use of Product. 7.1 The User may utilize the Product only for his/her personal use for the sole purposes for which the Product is designed. The User may not, under any circumstances whatsoever, use the Product in a manner or for a purpose for which it is not intended or designed. 7.2 The User may not, under any circumstances whatsoever, make or attempt to make, any unauthorised copies of the Product. 7.3 The Product is provided via installation on the User’s phone or other device. The User hereby expressly and unconditionally consent to the installation on his/her phone or other device of any and all materials, data, software and other items necessary for the Product to operate as intended. 7.4 In addition, the User may not, directly or indirectly, do any of the following: (a) remove any copyright, trademark, or other proprietary notices incorporated or affixed to the Product; (b) sell, transfer, rent, lease, or sub-license the Product to any third party; (c) alter, change, repurpose or modify the Product in an unauthorised manner; (d) reverse engineer, disassemble, decompile or attempt to derive source code from the Product; (e) prepare a derivative work, improvements or developments to the Product; (f) use the Product for any unlawful, immoral, unethical or unreasonable purpose or activity; or (g) cause or intend the Product to be used in any way or manner that may violate the intellectual property or other personal rights (including, but not limited to, privacy rights and ownership rights) of any other person or entity. 7.5 In the event of the User breaching any of the terms of this Agreement and failing to remedy such breach within a period of three business days after receipt of notice drawing attention to the breach, Supadata may forthwith terminate use of the Product by the User. 7.6 Supadata may supply the User with such reports as it, in its sole discretion may from time to time decide. Such reports will be supplied to the User electronically in such form as Supadata, in its sole discretion may decide from time to time.
Use of Product. School agrees to protect all curriculum and curriculum templates from being copied, duplicated or given to any third person without the consent of BTE and to obey all U.S. copyright laws.
Use of Product. You certify that this software will only be used for testing purposes, and will not be rented, leased, sold, sublicensed, assigned, or otherwise transferred. Further, You certify that You will not transfer or export any product, process, or service that is the direct product of the software. You shall not use or rely on the software, or any excerpts, variations or derivations thereof, in connection with the development by You of any programs, writings or works or in connection with the production of products or the performance of services for third parties without the prior written authorization of Citrix.
