Utilities and Utility Charges. Tenant shall arrange, contract and pay for its own account, at its own expense, and in its own name, all utilities necessary to serve the Suite including, without limitation, all water, light, power, electricity, gas telephone, information or computer services or other utility charges relating to the Suite. Separate meters shall be installed for such utilities.

Utilities and Utility Charges. LESSEE shall, during the entire term of the AGREEMENT, maintain utility service to PREMISES exclusive of utilities provided by LESSOR pursuant to Section 1 of this AGREEMENT. LESSEE obligated utility charges shall be at LESSEE’s sole expense and include utility-related municipal levies charged to PREMISES. Should LESSEE fail to maintain utiliy service to PREMISES, XXXXXX agrees to pay as additional rent all charges caused by the transfer of utility service into XXXXXX’s name and associated utility usage charges. In the event XXXXXX pays charges for utilities because of LESSEE’s breach of the requirements of this AGREEMENT, LESSEE agrees to pay to XXXXXX, in addition to said charges, $25.00 as additional rent as reimbursement for XXXXXX’s administrative time coordinating utility service.

Tenant shall be solely responsible for installing, and arranging for and maintaining satisfactory utility lines and services to and for the operation of the Gas Processing Plant, and Tenant shall pay promptly all deposits, rents, costs, tap-in fees and other charges and fees for water service, sewer service, gas, electricity, light, heat, steam, power, telephone and other communication services, and any and all other utility services desired, rendered or supplied to or in connection with the Premises and the Gas Processing Plant, provided, that, prior to the Phase II Commencement Date, Tenant shall pay for the cost of all of the utilities serving the Premises and Gas Processing Plant, including its proportionate share of the cost of utilities servicing the Control Building as such share is calculated by Landlord using reasonable allocation methodologies. Tenant shall, at its sole cost and expense, procure and keep in effect all necessary permits, licenses and other authorizations required by any federal, state, county, municipal and local governments, and all departments, commissions, boards, bureaus, agencies and offices thereof, having or claiming jurisdiction (“Governmental Authority”) for the lawful and proper installation and maintenance of the wires, pipes, shafts, ducts, conduits, tubes and other equipment and appliances for use in supplying any such services in connection with the operation of the Gas Processing Plant.
