Transfer in status or classification shall not delay the use of entitled benefits. Voluntarily transferred and promoted bargaining unit members shall serve a ninety (90) calendar day probationary period, subject to a ninety (90) thirty (30) calendar day extension. Such Supervisors shall retain all benefits and rights pertaining to bargaining unit members, including access to the grievance procedure, except for the decision concerning the outcome and disposition of their probationary period. Should the supervisor fail the probationary period, the University shall return the supervisor to his/her former position if it is still available or will attempt to place the supervisor in a vacancy suitable to his or her work experience. Such vacancy may be at the same or lower level than the title held by the supervisor prior to being transferred or promoted. VACANCIES AND PROMOTIONS. Supervisors are eligible for A. A vacancy shall be defined as any position, either newly created or a promotion when there present position that is not filled. An interim unfilled position due to the layoff procedure shall not be construed as a vacancy. VACANCIES AND PROMOTIONS. Supervisors are 9.01 Vacancies, which the Company requires to be filled, will be bulletined and posted for seven [7] calendar days in a place accessible to employees affected and a copy sent to the Union. VACANCIES AND PROMOTIONS. A newly hired employee must attain one year's seniority before being eligible to transfer from one Area to another. An employee accepting a transfer under section above may return or be returned by the Company to his former job during the calendar days following such transfer. An employee accepting permanent promotion under section above may return to his former job during the calendar days following such promotion. Any employee who may otherwise have been appointed by posting or otherwise to fill any vacancies created by such transfer or permanent promotion shall thereupon revert to his former job and shall be made availablepaid the rate which such employee would have been entitled to had such employee not vacated such former job. Such vacancy may be at the same or lower level than the title held by the supervisor prior to being transferred or promoted. Should the supervisor’s former position not be available and should no suitable vacancy be available, the supervisor will be placed on the recall list. At any time during the probationary period, the supervisor may return to his or her former position if it is still available. If an employee opts allowed to return to his their old position after the training is completed. Section 3. All job openings shall be posted for at least seven (7) calendar days before being filled. Section 4. (1) An employee who is involuntarily transferred shall receive compensation that is equal to or her former greater than the compensation received in their previous position. An involuntary transfer does not include a situation where an employee bumps another employee as a result of employment reassignment or layoffs within the department, or where an employee was promoted and then returned to their previous position because of inability to satisfactorily perform job duties and responsibilities in the promoted position or the employee may not bid on another position for six monthsrequests a transfer back to their position.
