i) The successful applicant will be hired per Article 8 selected by the Authority from the three (Vacancies3) most senior applicants who are determined to possess minimum qualifications established by the Authority.
ii) Information in regard to the evaluation procedure shall be made available by the Authority to MSEA-SEIU upon request.

29.04 Employees selected, promoted or desiredappointed to a new position will have ninety (90) days worked in which to demonstrate that they can perform the new position duties in a safe, name productive and classification efficient manner. If in the opinion of immediate supervisorthe Employer they cannot, location then the employee will be returned to the previous position without loss of reporting and workingseniority, unless an extension of the familiarization period is mutually agreed upon.
29.05 At any time during the above familiarization period the employee wishes to return to their previous position, they may do so, and the deadline and place of application.

VACANCIES/PROMOTIONS. Section 8.1. A. Whenever the Employer determines that a vacancy exists within in a professional position occurs during the school year (September to June), it will be adequately publicized by the Superintendent by means of a notice placed on the Association bulletin board in this school as far in advance of the appointment as possible. Between close of one school year and start of next school year, an email notice of any such vacancy will be provided to each member of the bargaining unit which unit. In both situations, the Employer intends to fillqualifications for the position, its duties, and rate of compensation will be clearly set forth. The qualifications set forth for a particular position will not be changed when such future vacancies occur unless the Association has been notified in advance of such changes and the reasons therefore. No vacancy will be filled, except on a temporary basis, within ten (10) days from the date the notice is posted in the schools and the giving of notification to the Association membership.
B. All qualified teachers will be given adequate opportunity to make application for such positions, and the Committee agrees that the administration will give due weight to the professional background and attainments of all applicants, the length of time each has been in the school system and other relevant factors. v) Those who may have filled positions created by the movement of the affected employee shall likewise be returned to their former position and gain no right to the job taken until such time as the sixty (60) day qualification period with respect to the affected employee has elapsed.
vi) For bidding purposes, employees who have been promoted shall remain at that position for a period of sixty (60) days.
vii) With respect to promotions, the sixty (60) day period shall commence on a permanent basis. Additionally, nothing the date the employee begins work in this Article his/her new position.
viii) Nothing in these provisions shall be construed to require as requiring the Employer Authority to fill any vacancies which may occur.
8) Vacancies/Transfers
a) Vacancies/transfers in the Highway Division Supervisor classification shall:
i) Be filled on the basis of seniority being the sole determining factor with applicants limited to supervisory employees in the Highway Division Supervisor classification at the time the notice of vacancy/transfer is posted.
ii) Employees who have transferred shall remain at that position for a vacant period of sixty (60) days.
b) Vacancies/transfers in the Highway Maintenance Xxxxxxx classification shall:
i) Be filled on the basis of seniority being the sole determining factor with applicants limited to supervisory employees in the Highway Maintenance Xxxxxxx classification at the time the notice of vacancy/transfer is posted.
ii) Employees who have transferred shall remain at that position for a period of sixty (60) days.
c) Vacancies/transfers in the Automotive Mechanic Xxxxxxx classification shall:
i) Be filled on the basis of seniority being the sole determining factor with applicants limited to supervisory employees in the Automotive Mechanic Xxxxxxx classification at the time the notice of vacancy/transfer is posted.
ii) Employees who have transferred shall remain at that position for a period of sixty (60) days.
d) Vacancies/transfers in the Fare Collection Division Supervisor classification shall:
i) Be filled on the basis of seniority being the sole determining factor with applicants limited to supervisory employees in the Fare Collection Division Supervisor classification at the time the notice of vacancy/transfer is posted.
ii) Employees who have transferred shall remain at that position for a period of sixty (60) days.
e) Vacancies/transfers in the Toll Plaza Supervisor classification shall:
i) Be filled on the basis of seniority being the sole determining factor with applicants limited to supervisory employees in the Toll Plaza Supervisor classification at the time the notice of vacancy/transfer is posted.
ii) Employees who have transferred shall remain at that position for a period of sixty (60) days.
f) For purposes of this Article, with respect to transfers, the sixty (60) day period shall commence on the Sunday following the award of the position.
Section 8.6. g) Nothing in this Article these provisions shall be construed to limit or prevent as requiring the Employer from hiring an individual that is not currently in the bargaining unit Authority to fill a vacant position or assume a newly created position once the Employer has met its obligations under the contractany vacancies which may occur.
Section 8.7. If a library branch site is established, personnel will be hired per Article 8 (Vacancies/Promotions). Employees may bereassigned to any Employer location per Section 8.3 for no longer than ninety (90) days. Further, the Employer has theright to designateone(1) employeeas a“ floater” who may be assigned to any site on xxxx-to-day basis without the restrictions above, and without the restriction in Section 8.3. Theparties agree that the“ floater” position will beincluded in the bargaining unit.
