The Employer recognizes the Labourers' International Union of North America, Local as the sole and exclusive bargaining agent for all employees coming within the jurisdiction of this Agreement, while working on all construction projects as defined by Article Iof this agreement save and except xxxxxxx and persons above the rank of xxxxxxx, office and clerical staff, shop and yard employees engineering staff and security guards. The Employer agrees to employ only members of the Union in good standing during the term of this Agreement, Xxxxx agrees to give preference to the Employer in supplying men. It is understoodthat in the event that the Union cannot supply Labourers in numbers, Labourers may be hired from any source, who shall become members of the Union within working days from the initial date of employment. It is agreed and understood that employees recalled and or hired by the Employer must obtain a clearance slip from the union before commencing work. The Employer agrees to deduct from the employees last pay cheque of each month, the initiation fee and regular monthly dues of the Union and remit such monies as deducted to the of the Labourers' Union, local of the month following the date upon which such Union fees and dues were deducted for employees covered by this Agreement. The Union shall supply the Employer with applications for union membership and dues deduction authorization forms, which will be presented to all new employees on the day the new employee is hired. All completed copies of the application for union membershipform will be returned to the Union and will serve as notification of commencement of employment. Upon termination of employment of any employee, the dues deduction authorization form shall be returned to the Union within four working days. is agreed and understood that work covered by this agreement shall be sublet only to those sub-contractors who are signatory to the Labourers' International Union of North America, Local to perform such work.
AND UNION SECURITY. 1.01 PURPOSE The intent and purpose of the parties is to promote efficiency, increase production and improve and achieve harmonious industrial and economic relationships between the employees and the COMPANY; and to that end the parties express their intention to cooperate in fulfilling their mutual obligation in this basic agreement covering wages, hours of work and other terms and conditions of employment applicable to the employees covered by this collective bargaining agreement.
AND UNION SECURITY. SECTION 1. The committee recognizes the Union for purposes of negotiation as the exclusive representative of all custodians and maintenance employees of the Barrington School System. The employer and the Union shall recognize and adhere to all state labor laws, rules and regulations.
SECTION 2. The provisions of the agreement shall constitute the mutual desire of the parties to continue to promote cooperation and harmony and to formulate rules to govern the relationship between the Committee and the Union for the duration hereof.
SECTION 3. The Committee agrees not to negotiate with any organization other than the Union, as long as the Union remains the certified representative of all custodians and maintenance employees.
SECTION 4. Despite reference herein to the Committee or the Union as such, each reserves the right to act hereunder by committee, individual member, or designated representative, professional or lay, whether or not a member. Each party will provide the other with a list of officers and representatives and will keep such a list up to date.
SECTION 5. The Union agrees to supply the Committee with an up-to-date list of memberships.
SECTION 6. All employees covered by this agreement shall have all rights under this contract upon the completion of the probationary period. This probationary period shall be six months. During the probationary period employees must authorize payroll deductions in accordance with Article II, Section 1, said deduction shall commence with the employees first payroll check.
SECTION 7. The Union recognizes that the Committee and its representatives have the right to expect a full day's work for a full day's pay within the limits defined in this agreement and within the regulations established by law. The Committee recognizes the right of the Union in its efforts to obtain improved conditions of work and improved work hour schedules in accordance with the terms of this agreement. The Union recognizes that the Committee has the right to expect the custodians to perform their duties in an efficient manner. Except as specifically otherwise provided for herein, nothing contained in this agreement shall be considered as limiting the Committee in any way in the exercise of regular and customary functions of management.

AND UNION SECURITY. The Town recognizes the Union as the sole and exclusive bargaining agent for the purpose of establishing wages, salaries, hours and other conditions of employment for all full time regular employees of the Highway, Water, Cemetery/Commons, Tree Departments and the Town Hall Custodian classification. The Union recognizes the Pembroke Board of Selectmen as the sole and exclusive representative of the town for the purpose of collective bargaining relative to wages, hours and other conditions of employment. The Town shall reserve the right to have present during bargaining sessions members of the Board of Selectmen, the Town Administrator and an attorney which shall be limited to the above. The Union shall reserve the right to have present during bargaining sessions three (3) bargaining unit members, the Union Xxxxxxx, the Staff Representative and an attorney which shall be limited to the above. Part-year employees who, during any fiscal year covered by this Agreement, are employed for a minimum of forty (40) hours in each of at least twenty-six (26) weeks (not necessarily consecutive) shall be entitled to receive the appropriate hourly wage rate set forth herein for all hours worked in that fiscal year and shall be entitled to the fringe benefits herein pro-rated on the basis of the number of forty (40) hour weeks worked divided by fifty-two (52). The difference, if any, between wages paid under the Town By-law and the benefits granted by this paragraph shall be retroactively provided a part-year employee upon his or her initial qualification for the same by completion of the minimal amount of employment above. Following initial qualification, an employee shall not be required to re-qualify (await retroactive payment) in subsequent fiscal years provided always the minimal amount of employment had been attained in the fiscal year before that in question. The Town will not bid, promote, or finance any labor group or organization which purports to engage in collective bargaining, or make any agreement with any group or individual for the purpose of undermining the Union or changing any conditions contained in this Agreement.
AND UNION SECURITY. Section 1. The Employer recognizes Local Union 702 of the International Brotherhood of Electrical Workers, AFL-CIO, as the exclusive representative for the purpose of collective bargaining in respect to rates of pay, hours of employment and other conditions of employment for all production and maintenance workers employed by the Company at its Murphysboro, Illinois Extrusion Plant located at 0000 Xxxxx Xxxxxx Xxxxxx, except office clerical employees, watchmen, guards and supervisors as defined in the Act.
Section 2. All employees covered by this Agreement who are members of the Union on the effective date of this Agreement, and all employees who voluntarily become members after that date, shall, as a condition of employment, maintain the membership in the Union during the term of this Agreement to the extent of payment and uniform initiation fees and periodic dues, as provided by law.
Section 3. The Company agrees to make payroll deduction for the Union dues and initiation fee or agency fees, as provided in Section 2 of this Article, for each employee who submits a signed payroll deduction authorization form to the Company, and to pay the Union the total amount thus deducted for all such employees, together with a list of the names of the individuals for whom the deductions were made. Such deductions of any employee will be made only on the basis of specific written authorization signed by the individual employee, and delivered to the Company. Such written authorization shall be on a form agreed upon by the Company and the Union and will continue in effect only during such periods as this Agreement or extensions thereof are in effect and the authorization remains unrevoked by the employee. Such deduction shall not continue after the expiration of the Agreement or any extension thereof.
Section 4. Each newly hired employee shall during the first or second day of employment be scheduled for an orientation at mutually agreeable time to the parties, which shall be provided by the Union. The Union orientation shall be a period of not more than fifteen

In order to insure the carrying out of the purpose of this Agreement, the Company recognizes the Union as the sole bargaining agent for all office and clerical personnel working in the offices of AV CELL Inc., at but excluding supervisory, management and professional employees, Auditors, Analysts, Supervisory Accountants, Purchasing Agent, Property Investigator, Mill Maintenance Co-ordinators, Chief and all technical employees of Central Research Industrial Relations and as Secretaries to Officers of the company and Payroll Department employees charged with the responsibility of handling confidential salaried payrolls, as certified by the Province of New Brunswick, Labour Relations Board on July All employees who are members of the Union or who become members after this date must, as a condition of employment, maintain their membership dues in good standing. Employees will have a right to normal Union representation at disciplinary hearings and in matters related to interpretation of the Labour Agreement when requested. All new employees who are not member of the Union shall become members after the first ten (10) working days of employment on a Union job Salaried supervisory and non-bargaining unit personnel will not perform routine bargaining unit duties except for instructional purposes, work during emergency to prevent potential injury to employees, damage to equipment property and the environment. It is understood that this wording is not intended to change past practice and it is agreed that the restriction related to bargaining unit duties refers to specific job duties and not to such as writing, using calculators, Xerox, telephoning.
