Virtual Items. You understand that at times you may earn buy or purchase virtual tokens for use in the Services (Virtual Items). You agree and acknowledge that you do not in fact own the Virtual Items and the amounts of any Virtual Item do not refer to any credit balance of real currency or its equivalent. Rather, you may purchase or earn a limited right to exchange Virtual Items for a limited license to use certain features of the Services. Any virtual token balance shown in your account does not constitute a real-world balance or reflect any stored value, but instead constitutes a measurement of the extent of your ability to procure such limited license to use certain features made available via the Services. Notwithstanding the foregoing, from time to time Parler may make available a feature where Virtual Items may be redeemed for cash. Parler prohibits and does not recognize any purported transfers of Virtual Items effectuated outside of the Services, or the purported sale, gift, or trade in the real world of anything that appears or originates in the Services, unless otherwise expressly authorized by Parler in writing. Accordingly, you may not sublicense, trade, sell, or attempt to sell Virtual Items for real money, or exchange Virtual Items for value of any kind outside of the Services, without Parler’s written permission. Any such transfer or attempted transfer is prohibited and void, and will subject your user account to termination. You are responsible for all taxes arising out of your use of the Services, including without limitation any taxes due upon your redemption of the Virtual Items for cash. If you redeem Virtual Items for cash, you may be required to supply a social security number and/or tax identification number prior to the issuance of the cash redemption to you. Parler may file an IRS form 1099 or similar form with the Internal Revenue Service or the appropriate tax filing with a governmental entity for the fair market value of any cash redemptions issued to you in exchange for the Virtual items.
Virtual Items. The Service may make available virtual digital items, including digital points (“Credits”), which enable users to play games on the Service and “Tickets”, which users may be able to collect by playing games, inviting new users to the Service, or through such other methods as permitted by us from time to time (collectively, “Virtual Items”). Virtual Items may be purchased by a user in quantities and prices determined by us at our discretion. Users can only obtain Virtual Items in accordance with these Terms and through methods approved by us, which methods we will determine and update from time to time at our sole discretion. We may impose limits or modify limits on the number of Virtual Items that you may purchase or hold at any time. All non-standard transactions between users related to Virtual Items are prohibited.
Virtual Items. 7.1 The main feature of the App is your ability to enjoy live and pre-recorded digital performances in augmented reality (“Virtual Items”).
7.2 Virtual Items are features of the App, and can be streamed, downloaded and used as part of the App only, in accordance with this Terms of Use Agreement.
7.3 Streaming of Virtual Items are subject to this Terms of Use Agreement and the terms of any third party app store through which your App download is made. Downloads of the App are made via permitted third party stores, such as Apple App Store, and not via Reality Check. To the extent that this Terms of Use Agreement conflicts with such agreement between you and the relevant third party in respect of any use of Virtual Items, the terms of your agreement with the third party app store shall prevail.
7.4 It is a condition and fundamental term of this Terms of Use Agreement and your use of the App that you must not buy, sell, barter, swap, exchange, trade, lend, rent or otherwise deal in any way with any Virtual Item outside of the App (such as on unauthorised item trading sites) or in any way other than as expressly provided above. Virtual Items may only be exchanged for certain other designated Virtual Items in and as part of the App only and where that functionality is made available by Reality Check.
7.5 Subject to Clause 4, Reality Check may manage, vary, regulate, control, modify or eliminate Virtual Items in its sole discretion, with or without notice (including not supplying Virtual Items if it is reasonable to do so). Subject to Clause 4 and this Terms of Use Agreement, Reality Check shall have no liability to you or any third party in the event that Reality Check exercises such rights.
7.6 Please notify Reality Check immediately if you dispute the use involving Virtual Items or believe that any use is unauthorised.
Virtual Items. GolfStatus owns, has licensed, or otherwise has rights to use all of the content that appears in the Service. Notwithstanding any provision to the contrary herein, you agree that you have no right or title in or to any content that appears in the Services, including without limitation the virtual goods or currency appearing or originating in the Services, whether earned or purchased from GolfStatus, or any other attributes associated with an Account or stored on the Services. GolfStatus prohibits and does not recognize any purported transfers of virtual property effectuated outside of the Services, or the purported sale, gift or trade in the “real world” of anything that appears or originates in the Services, unless otherwise expressly authorized by GolfStatus in writing. Accordingly, you may not trade, sell or attempt to sell virtual items or currency for “real” money, or exchange those items or currency for value of any kind outside of the Services, without GolfStatus’s written permission. Any such transfer or attempted transfer is prohibited and void, and will subject your Account to termination.
Virtual Items. From time to time, you may be able to purchase a limited, personal, non-transferable, non- sublicensable, revocable license to use "virtual items", including but not limited to Gifts (collectively, "Virtual Items"). Any Virtual Item balance shown in your account does not constitute a real-world balance or reflect any stored value, but instead constitutes a measurement of the extent of your license. Virtual Items do not incur fees for non-use, however, the license granted to you in Virtual Items will terminate in accordance with the terms of this Agreement, when Let’s Relate ceases providing the Service or your account is otherwise closed or terminated. Let’s Relate, in its sole discretion, reserves the right to charge fees for the right to access or use Virtual Items and/ or may distribute Virtual Items with or without charge. Let’s Relate may manage, regulate, control, modify or eliminate Virtual Items at any time. Let’s Relate shall have no liability to you or any third party in the event that Let’s Relate exercises any such rights. Virtual Items may only be redeemed through the Service. ALL PURCHASES AND REDEMPTIONS OF VIRTUAL ITEMS MADE THROUGH THE SERVICE ARE FINAL AND NON-REFUNDABLE. The provision of Virtual Items for use in the Service is a service that commences immediately upon the acceptance of your purchase of such Virtual Items. YOU ACKNOWLEDGE THAT LET’S RELATE IS NOT REQUIRED TO PROVIDE A REFUND IN RESPECT OF VIRTUAL ITEMS FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.
Virtual Items. From time to time during your use of the Service, you may have the opportunity to “earn”, “buy” or “purchase” (a) virtual in-game items; or (b) virtual in-game points, including but not limited to virtual coins, cash or points, all for use in the Service (together with virtual in- game items, “Virtual Items”). You do not in fact “own” the Virtual Items and the amounts of any Virtual Item do not refer to any credit balance of real points or its equivalent. Rather, by “earning”, “buying” or “purchasing” Virtual Items, you are granted a limited license to use the software programs that manifest themselves as the Virtual Items. The purchase and sale of such limited licenses to use Virtual Items is a completed transaction upon redemption of the applicable payment and shall under no circumstances be refundable, transferable or exchangeable including, without limitation, upon termination of your Account, termination of these Terms, and/or the discontinuation of the Service, except as required by law. COMPANY prohibits and does not recognize any purported transfers of Virtual Items effectuated outside of the Service, or the purported sale, gift or trade of anything that appears or originates in the Service, unless otherwise expressly authorized by COMPANY in writing. Accordingly, you may not sublicense, trade, sell or attempt to sell in- game Virtual Items for real money, or exchange Virtual Items for value of any kind outside of a game, without COMPANY’s written permission. Any such transfer or attempted transfer is prohibited and void, and will subject your Account to termination. You acknowledge and agree: (a) that COMPANY may change the price of Virtual Items at any time, without notice, for any reason or for no reason, (b) that the amount of virtual points necessary to obtain certain Virtual Items may fluctuate, and (c) that COMPANY has no liability to you for any changes in the price of such Virtual Items and/or the amount of virtual points necessary to obtain Virtual Items. COMPANY reserves the right, without prior notification, to limit the quantity of the Virtual Items you can purchase and/or to refuse to allow you to purchase such Virtual Items. You acknowledge and agree that COMPANY shall have no liability for loss of Virtual Items due to any unauthorized third party activity, such as hacking, phishing, password mining, social engineering, and/or any other unauthorized third party activity. Virtual Items. 3.1. Any virtual currency (such as Titanium), goods, resources, or effects such as coins, points, tokens, cards, scrolls, weapons, items, equipment, skins, boosts, power-ups, trophies, achievements, rewards, badges or other digital content (“Virtual Items”) made available, purchased, earned, or otherwise acquired through the Services are licensed under the terms of this Agreement and are not a sale or transfer of any rights in such Virtual Items. Virtual Items are only available to users in certain locations, and you may not purchase or use Virtual Items if you are not in an approved location. Virtual Items have no value outside the Game and cannot be used outside of the Services, and may not be sold or redeemed for real money or items of value. We have the right to modify, re-price, delete, move, remove, or suspend any Virtual Items at any time with or without notice to you and with no liability of any kind to you. We may limit the total amount of Virtual Items that may be purchased or used for any one game or that may be held in your account in the aggregate. Additionally, price and availability of Virtual Items are subject to change. All purchases of Virtual Items are final and under no circumstances will such purchases be refundable, transferable, or exchangeable. You agree that you have no ownership or other property interest in your account or any Virtual Items.
Virtual Items. VRKiwi owns, has licensed, or otherwise has rights to use all of the content that appears in the Service. Notwithstanding any provision to the contrary herein, you agree that you have no right or title in or to any content that appears in the Service, including without limitation the Virtual Items appearing or originating in any VRKiwi game, whether “earned” in a game or “purchased” from VRKiwi, or any other attributes stored on the Service.
Virtual Items. Zeeverse owns, has licensed, or otherwise has rights to use all of the content that appears in the Service. Notwithstanding any provision to the contrary herein, you agree that you have no right or title in or to any content that appears in the Service, including without limitation the virtual goods or currency appearing or originating in any Zeeverse game, whether earned in a game or purchased from Zeeverse, or any other attributes associated with an Account or stored on the Service.
Virtual Items. Project Zero owns, has licensed, or otherwise has rights to use all of the content that appears in the Service or in Project Zero games. Notwithstanding any provision to the contrary herein, you agree that you have no right or title in or to any content that appears in the Service, including without limitation the virtual goods or currency appearing or originating in any Project Zero game, whether earned in a game or purchased from Project Zero, or any other attributes associated with an Account or stored on the Service.
