Watershed. All property owned, acquired or occupied by the city’s waterworks, reservoirs systems, springs, branches, pipes; and all lakes, rivers, springs, streams, creeks or tributaries acquired by the city, or the right of use of water therefrom acquired by the city constituting sources of city water supply and by means of which the city supplies water, or stores or conducts the water supply; and all property acquired for the preservation and protection of the purity of the city water supply; and all property owned or possessed by the city within the areas draining into lakes, rivers, springs, streams, creeks or tributaries constituting those sources of water supply. Watershed. This project consisted of updating the watershed parameters used in the computer simulation of the watershed based on land use changes. The total cost of this multi-year project was $300,000.00, of which the SWFWMD committed up to $150,000.00. The Agreement remained in effect through December 31, 2015, with the SWFWMD managing the project. On March 29, 2016, the County and the SWFWMD entered into modification Agreement No. 2013REV0006-A to extend the expiration date of the agreement from December 31, 2015, to December 31, 2017. Subsequently, on May 8, 2018, the County and the SWFWMD entered into modification Agreement No. 2013REV0006-B to extend the expiration date of the agreement to June 30, 2019. On April 7, 2020, the County and the SWFWMD entered into modification Agreement No. 2013REV0006-C which extended the completion date of Agreement No. 2013REV0006-B from June 30, 2019, to June 30, 2021. At the present time, Agreement No. 2013REV0006-C has expired, but there is additional work required to update the model. This is primarily due to extensive land use changes resulting from new construction activities in the watershed that started after the watershed model was finalized. The parties wish to enter into Agreement No. 2013REV0006-D retroactively, effective June 30, 2021, which would incorporate and amend the language in the prior Agreement, modify the completion dates, performance schedule, and extend the expiration date from June 30, 2021, to June 30, 2023. Developer and County acknowledge that County has entered into an Interlocal Cooperation Act Agreement for the Continuation of the Papillion Creek Watershed Partnership, (hereinafter called “Watershed Partnership Agreement” as from time to time amended).
