Working Pensioners. For bargaining unit employees who are in receipt of a pension from the IUOE Local 793 Pension Plan for Operating Engineers in Ontario (the Pension Plan), the Employer shall not make contributions to the Pension Plan. In lieu of such contributions the Employer shall pay an equivalent amount per hour earned as additional remuneration to the employee. Such remuneration shall be paid by remitting the amounts on a monthly basis at the same time as pension contributions to the Operating Engineers Benefits Administration Corporation (OEBAC), which shall annually pay these amounts with interest (less applicable deductions) to the employee. The dispatcher will canvas for available unemployed members on all of the hiring hall lists under Article Only after those lists have been exhausted will the Business Manager or Business Agent sign a new Day Referral Permit for the Pensioner to continue his employmentwith the contractor, If no new permit is granted, Local will the contractor that there are members available in the hiring halls, and that, as of the date of the expiry of the Pensioner’s Day Referral the Pensioner is no longer qualified to work for the contractorthroughthe Union office. If Contractor does not have employees, it shall provide a letter, on company letterhead, to the Judicial Council certifying, under penalty of perjury, that it does not have employees. Upon the Judicial Council’s receipt of the letter, Contractor shall not be required to maintain workers’ compensation insurance.

  • Death Benefit Should Employee die during the term of employment, the Company shall pay to Employee's estate any compensation due through the end of the month in which death occurred.
