Xxxxxxx Officer. If the Association is not satisfied with the decision of the Office of Collective Bargaining, the grievance may be appealed to arbitration, in writing, within fifteen (15) days of the Office of Collective Bargaining answer or date it was due. The parties shall schedule a hearing officer to determine if an employee was performing duties substantially beyond the scope of his/her classification and for what period of time. Present at the hearing shall be the employee, and an Association representative and a management representative. Both sides will present arguments to the hearing officer. The hearing officer will issue a binding bench decision at the conclusion of the hearing, which will identify if the employee was working out of classification and for what period of time. The expenses of the hearing officer shall be borne equally by the parties.

Xxxxxxx Officer. 1. The City Manager shall have twenty-one (21) calendar days from receipt of the notice of appeal to designate himself/herself as the hearing officer or appoint a neutral hearing officer who is not embroiled in the controversy, i.e., a person who did not initiate or authorize the action in question. 2. If a hearing officer is appointed by the City Manager, the hearing officer shall serve in an advisory capacity and shall be responsible for making recommended findings of fact and issuing an advisory decision to the City Manager. The City Manager may adopt, modify, or reject the hearing officer’s recommendations and advisory decision and the City Manager’s decision shall be final and binding.
Xxxxxxx Officer. A trained decision-maker with the authority and responsibility to determine whether a Respondent has engaged in behavior in violation of University Antidiscrimination Policies.
Xxxxxxx Officer. Hearings conducted pursuant to this article shall be conducted before a hearing officer designated by the Chief Administrative Officer for the County. The hearing officer may issue subpoenas for the production of documents or the attendance of witnesses. The hearing officer shall determine whether oral evidence at the hearing shall be recorded by a court reporter. At the conclusion of said hearings the hearing officer shall prepare a written statement setting forth in summary fashion his/her findings and conclusions with regard to the matters submitted for his/her decision. The parties shall equally bear the expense of the hearing officer and the cost of the hearing. Each party shall bear its own expenses.
Xxxxxxx Officer. A neutral person who shall be appointed by mutual agreement of the parties.
Xxxxxxx Officer. A neutral hearing officer shall conduct the administrative review. The hearing officer may not be a person who approved the decision to deny the Certificate of Preference or a subordinate of that person. As of the date of these amended rules, the Agency intends to use the Administrative Law Judges of the San Francisco Residential Rent Stabilization and Arbitration Board to review these matters.
Xxxxxxx Officer. A person selected in accordance with 24 CFR § 966.550 and this procedure to hear grievances and render a decision with respect thereto.
