Operating Charges definition

Operating Charges means any amounts charged in respect of the operation of an investment account of a client, including service charges, administration fees, safekeeping fees, management fees, performance fees;
Operating Charges means all expenses incurred in the operation, maintenance, and repair of the Leased Premises , including the following: (1) water, electricity, and other utility charges of every type and nature; (2) premiums and other charges for insurance and deductibles under such insurance policies; (3) any business, professional, and occupational license tax payable by the Lessee with respect to the Leased Premises; (4) any costs to comply with legal or insurance requirements applicable to the Leased Premises; and (5) any other expense incurred in maintaining the Leased Premises.

More Definitions of Operating Charges

Operating Charges means the sum of all direct and indirect costs and expenses of any kind or nature whatsoever incurred in connection with the management, operation, maintenance, repair, replacement and cleaning of the Building, the Land and the Common Areas. Commencing on the first day of the year following the Base Year and thereafter for the remainder of the Term, Licensee shall pay, as Additional Rent, Licensee’s proportionate share of the amount by which Real Estate Taxes for each year falling entirely or partially within the Term following the Base Year exceeds the Base Year Real Estate Taxes (hereinafter referred to as the “Real Estate Taxes Escalation”). As of the date hereof, Licensee’s Proportionate Share is agreed to be 30.25%.

Operating Charges shall not include: (i) principal or interest payments on any Mortgages (as defined in Section 21.1); (ii) leasing commissions with respect to the negotiation of leases; (iii) depreciation for capital expenditures, except as specified above; (iv) the costs of special services and utilities separately charged to particular tenants of the Building; (v) costs reimbursed to Landlord from any source including insurance claims and warranties (but excluding payments by other tenants for Operating Charges); (vi) costs of financing the Building and/or the Land; (vii) wages, salaries and other compensation paid to employees of Landlord or its managing agent above the level of senior property manager; (viii) leasing commissions, attorneys' fees, accounting fees, construction fees or other fees and expenses if such fees and expenses are incurred in connection with negotiations or disputes with tenants or prospective tenants of the Building; (ix) costs of administering the affairs of the ownership entity which are unrelated to the maintenance, management and ownership of the Building; (x) expenses in connection with servi...
