Party Software definition

Party Software means software or SaaS that is owned by a party other than either You or Us which may be supplied under this Agreement as specified in a Statement of Work;
Party Software means software that is developed for general commercial use, available to the public or not developed for HSD. Third-Party Software includes, without limitation, commercial off-the-shelf software, operating system software, and application software, tools and utilities.
Party Software means any software which is owned by a third party, and is provided by either Kineo or the Client, and forms part of the Learning Management System; Totara Learning means the owner of the Totara Platform, as stated in the Totara Subscription Agreement. Virus means any software, code, file, programme, or similar, which may: a. prevent, impair or otherwise adversely affect the operation of any computer software, hardware or network, any telecommunications service, equipment or network or any other service or device; b. prevent, impair or otherwise adversely affect access to or the operation of any programme or data, including the reliability of any programme or data (whether by re-arranging, altering or erasing the programme or data in whole or part or otherwise); c. or adversely affect the user experience, including worms, trojan horses, viruses and other similar things or devices. User means a person under the direction or authorisation of the Client who may access and use the Learning Management System during an SOW Term. Working Day means any day that is not a Saturday, Sunday, or public holiday in the Territory.

  • Unless otherwise stated in the relevant Statement of Work, all software provided under a Statement of Work is Third Party Software.

  • Supplier Materials: all documents, information and materials in any form (including hard copy and electronic form), which are provided by the Supplier to the Customer in connection with the Services, Third Party Software: the software programs proprietary to third parties which are provided to the Customer without modification, with the Deliverables.
