Releasing Plaintiffs means each and all of the following: Lead Plaintiffs and each of the other Settlement Class Members (regardless of whether that Person actually submits a Claim Form, seeks or obtains a distribution from the Net Settlement Fund, is entitled to receive a distribution under the Plan of Allocation approved by the Court, or has objected to the Settlement, the Plan of Allocation, or the fee and expense application), on behalf of themselves, and their respective heirs, executors, administrators, predecessors, successors, and assigns, in their capacities as such.
Releasing Plaintiffs means Named Plaintiffs, each and every member of the Classes, Class Counsel, and Liaison Counsel, and each and all of their respective predecessors, successors, representatives, agents, attorneys, heirs, executors, trustees, personal representatives, estates, administrators and assigns; and any other Person who has the right, ability, standing or capacity to assert, prosecute or maintain any of the Released Claims; provided however, that Releasing Plaintiffs shall not include any Person who or which properly excludes himself, herself or itself by filing a valid and timely request for exclusion.
