Unacceptable Material means the materials listed in Section 9 below. All Recyclable Materials collected for delivery and sale by Company shall be hauled to a processing facility selected by Company for processing (“Recycling Services”).
Unacceptable Material means any non-hazardous waste which is not permitted to be processed at a facility under applicable laws or permits, source, special nuclear or byproduct material as defined by the Atomic Energy Act of 1954 and the regulations thereunder; asbestos-containing waste; mercury-containing waste; and any waste delivered by Customer which is not approved by Company. If Customer has any questions about whether a particular material is considered hazardous, please call the Company before disposing of the material in the dumpster.
Unacceptable Material means Non-Recyclable Material that must be removed from the Received Material prior to processing because it is either Hazardous Waste, poses a health and safety threat to the MRF staff or it cannot be properly sorted by the MRF’s automated sorting mechanisms due to size, shape, weight or other restrictions.

Company may visually inspect the collected Recyclable Materials to ensure loads are at or below the Unacceptable Material Threshold.
If Company’s visual inspector determines that loads of Recyclable Material are consistently above the Unacceptable Material Threshold, Company will notify City of the issue and the parties agree to promptly negotiate in good faith (a) an agreed upon procedure to audit a representative sample of City’s Recyclable Material to determine its actual composition of Unacceptable Material; and (b) an updated Collection and Processing rate commensurate with the composition of Unacceptable Material.
City’s Collection and Processing rate assumes that, on average, City’s Recyclable Material consists of no more than 20% Unacceptable Material (the “Unacceptable Material Threshold”).
The District shall keep open and operate the Facility continuously and uninterruptedly, except when the District is prevented from doing so by any Uncontrollable Circumstance or rejection of Unacceptable Material.
The District may reject Unacceptable Material and any loads containing Unacceptable Materials.

Unacceptable Material means any material of any nature that is unlawful or which is defamatory, obscene, or which contains any viruses, worms, trojan horses or any other contaminants or materials that have the ability to access or modify, delete, disrupt or damage any data files or other computer programs, software or hardware or any material that provides access to any such contaminants or materials Any reference in this Agreement to a person shall include a reference to a juristic person, whether incorporated or unincorporated, a natural person or association; and any reference to any gender shall include a reference to any other gender. This Agreement and all of its provisions shall be interpreted in accordance with the common intention of the Parties that - this Agreement is concluded for the benefit of both Parties; and - neither Party shall obtain an undue or disproportionate benefit to the exclusion of or at the expense of the other Party; - their relationship shall be one of good faith at all times
Unacceptable Material means material that may include, but is not limited to, audio and video recordings or photographs that violate the privacy of others, bullying related issues and any content related to pornography, racism, hatred, or any other inappropriate materials.
