Where a Member has private seafarer re- cruitment and placement services operating in its territory whose primary purpose is the recruitment and placement of seafarers or which recruit and place a significant number of seafarers, they shall be operated only in todistusta edellyttävään tai muuhun säännel- tyyn järjestelmään, jonka perustaminen, uu- distaminen tai muuttaminen edellyttää asiaan- kuuluvien laivanvarustajien ja merenkulkijoi- den järjestöjen kuulemista. Tarpeettomien yksityisten työnvälitys- palvelujen perustamista ei pidä rohkaista.
Where a) an enterprise of a Party participates di- rectly or indirectly in the management, cont- rol or capital of an enterprise of the other Party, or
Where a) an enterprise of a Contracting Jurisdic- tion to a Covered Tax Agreement derives in- come from the other Contracting Jurisdiction and the first-mentioned Contracting Jurisdic- tion treats such income as attributable to a permanent establishment of the enterprise situated in a third jurisdiction; and
Where a) a resident of a Contracting State participates directly or indirectly in the management, control or capital of a resident of the other Contracting State, or
Where a Member State on the date of signature of this Agreement, due to the es- tablished jurisprudence of its domestic legal system applicable at such date, cannot apply the measures referred to in paragraph 1, this Article shall not apply to it, until such time as that Member State and the United States of America, by exchange of diplomatic note, agree otherwise.
