ADDITIONAL RENT - OPERATING COSTS. In addition to the Rent set forth in Section IV of this Lease and as part of the Rent due pursuant to the provisions of this Lease, Tenant shall pay Landlord as Additional Rent the Operating Cost Excess as set forth in this Section X(b). ADDITIONAL RENT - OPERATING COSTS. (1) For the purposes of this Section, the following terms shall have the following respective meanings: Operating Year: Each successive fiscal year (as adopted by Landlord) in which any part of the Term of this lease shall fall.
ADDITIONAL RENT - OPERATING COSTS. (a) Lessee shall pay as Additional Rent Lessee’s Share of all "Operating Costs" for the Building and the land upon which the Building is situated. "Operating Costs" shall be all expenses paid or incurred by Lessor or on Lessor's behalf as reasonably determined by Lessor to be necessary or appropriate for the ownership, operation, maintenance and repair of the Building, the land upon which it is situated, and any other improvements provided by Lessor to the common areas of the Building or for the general benefit of all of the tenants of the Building, including without limitation, all expenses paid or incurred by Lessor for heating, cooling, electricity, water, gas, sewers, refuse collection, telephone service not separately chargeable to specific tenants, and similar utilities services; the cost of supplies; janitorial services; landscaping, maintenance and replacements; window washing; insurance; management fees; services of independent contractors; cost of all maintenance and service contracts; personal property taxes; non-capitalized alterations or improvements made to the Building by reason of the laws and/or requirements of any insurer or governmental agency enacted, promulgated or made applicable to the Building after the Commencement Date; the cost of compensation (including without limitation, employment taxes and fringe benefits) of all persons who perform duties in connection with such Operating Costs; annualized costs of capital expenditures made after completion of renovation of the Building to the extent that such capital expenditures improve the efficiency of the Building by reducing the Operating Costs and are amortized using a straight-line method over a life acceptable to the appropriate taxing authority together with interest at the rate equal to eight percent (8%) per annum, regardless of whether such capital expenditures are required by governmental law or regulation; the costs of telecommunications equipment and cable that is not used exclusively by any single tenant or any subset of tenants of the Building; painting and decorating common areas, including without limitation, holiday decorations; deductible payments under insurance policies; the cost of legal services that relate to the Building as a whole and are for the benefit of the tenants of the Building; and the cost of accounting services relating to the Building as a whole. Lessor may, in a reasonable manner, allocate insurance premiums for so-called "blanket" insurance policies...
ADDITIONAL RENT - OPERATING COSTS. Landlord and Tenant agree that the Net Base Rental set out in section three (3) hereof is a minimum Net Base Rental to be paid by Tenant. Landlord will charge Tenant, and Tenant agrees to pay, as “Additional Rent”, Tenant’s Pro-rata Share (as defined at the end of this section) of Operating Costs (as defined below) during the term of this Lease in excess of the Operating Costs incurred or paid by Landlord for calendar year 2011 (the “Base Year”). Tenant shall also pay to Landlord, as Additional Rental for each month of each adjustment year, in addition to Base Rental and all other amounts herein required to be paid by Tenant, an amount equal to one-twelfth of the percentage (Tenant’s Proportionate Share) derived from a fraction using as the numerator the net rentable area of the Premises (in this case 10,471 square feet) and as the denominator, the net rentable area in the Building (in this case 47,000 square feet) times the amount, if and, by which the aggregate of all “Operating Costs”) paid or incurred by Landlord on account of the management, operation and maintenance of the Building exceeds the actual operating costs for the calendar year 2011 per Rentable Square Foot of the Building. An expense stop shall be based on a 2011 base year adjusted to reflect a fully assessed, 100% occupied Building.
ADDITIONAL RENT - OPERATING COSTS. A. Tenant shall, for the entire Term, pay to Landlord as additional rent, without any set-off or deduction therefrom (except as otherwise expressly provided in this Lease), one hundred percent (100%) of Operating Costs incurred by Landlord in maintaining and operating the Premises. Operating Costs shall be based on a one hundred percent (100%)-occupied building, whether or not the entire Building is actually occupied.

ADDITIONAL RENT - OPERATING COSTS. The LESSEE shall pay to the LESSOR as additional rent hereunder. LESSEE’S pro-rata share of Operating Expenses for maintaining and operating the building known as 000-000 Xxxxxxxx Xxxxxx, Xxxxxxxx, XX. Operating Expenses are defined for the purposes of this agreements as only building insurance, real estate taxes, snowplowing, landscaping, water and sewer costs, repairs. LESSEE’S pro-rata share is 19.5% (14,400 SF / 74,379 SF building area = 19.4%) LESSEE shall pay 1/12th of its pro rata share of the previous years actual operating expenses monthly. LESSEE’s proportionate share of expenses shall be paid as additional rent monthly, and shall commence upon rent commencement, Tenant’s proportionate share of estimated operating expenses for Year 1, which shall constitute the total additional rent payable by Tenant for Year 1 of the lease term, shall be $15,856.86, or $1.10 PSF per year. Notwithstanding any term or provision of this lease to the contrary, regardless of the actual amount of Operating Expenses for the building for any year of the lease term, commencing with the second year of the lease term, the total amount of Operating Expenses for which LESSEE shall be obligated to pay its pro rata share as additional rent hereunder shall not increase for any lease year by more than Ten Thousand and No/100 Dollars ($10,000.00) over the amount payable for the immediately preceding year of the lease term without the prior written consent of LESSEE. LESSEE shall pay monthly $1,321.41 in addition to the rent stated in Paragraph 4. At the end of arch calendar year of the Lease Term, LESSOR shall provide LESSEE with an operating statement, including copies of the actual bills, reflecting LESSOR’s total operating costs and LESSEE’s pro-rata share thereof. If LESSEE’s share of actual operating costs for such previous calendar year is less than the amount paid for such calendar year, LESSOR shall promptly refund the difference to LESSEE. If LESSEE’s share of the operating costs exceeds the sum paid, LESSEE shall promptly pay the amount of said excess to LESSOR. Set Operating Costs for the building for the first year of the Lease Term attached hereto as Addendum A.
