Affordable Housing Requirement. Attachment C (Mission Bay South Housing Program) is hereby amended to include a new Section 4.5 under Owner Housing Program as follows:

Affordable Housing Requirement. Notwithstanding anything contained in this Lease to the contrary, during the Lease Term Tenant shall provide a minimum of fifteen percent (15%) of the aggregate residential units in the Building (rounding upward for any fraction) that will qualify as Affordable Housing through the Land Trust as more particularly described in the Development Agreement.
Affordable Housing Requirement. Developer will comply with all affordable housing requirements of D.C. Official Code 10-801 et seq., as amended, and Applicable Law, and will also comply with the requirements of District’s Inclusionary Zoning program, if and to the extent applicable to the Project. As of the Effective Date, Developer has delivered an Affordable Housing Plan in the form attached hereto as Exhibit D governing the requirements for ADUs, including specific affordability levels, tenure type, unit mix, bedroom size breakdowns and formula for the rents of the ADUs, which Affordable Housing Plan shall be subject to the prior approval of District, which shall not be unreasonably withheld, conditioned or delayed. Floor plans depicting the ADUs for the Property shall also be presented to District for review and approval prior to Closing. At Closing, Developer shall execute the Affordable Housing Covenant, which shall reflect the Affordable Housing Plan and the Development Plan. District agrees that Developer may retain ownership of the ADUs and lease the ADUs to qualified tenants, whether or not Developer sells the balance of the Residential Units as individually-owned condominium units.

Affordable Housing Requirement. Only Affordable Housing and associated uses permitted in the zoning district of the Property, including public facilities (streets, paths, trails, open space) and utilities serving the Property may be developed on the Property. Uses other than Affordable Housing are permitted only if Affordable Housing is provided at a density of at least nine units per acre. “Affordable Housing” means dwelling units offered only to households with incomes of 60% or less of the area median income, as defined in ORS 456.270, or if part of an income-averaging program approved by the Oregon Housing and Community Services Department, households whose incomes average 60% or less of the area median income; and for which the rent and utilities constitute no more than 30% of gross annual household income.
Affordable Housing Requirement. Only residential housing and associated uses permitted in the zoning district of the Property, including public facilities (streets, paths, trails, open space) and utilities serving the Property may be developed on the Property. At least 80% of the residential housing units on the Property shall be Affordable Housing as defined herein. Uses other than residential housing are permitted only if residential housing units are provided at a density of at least nine units per acre. “Affordable Housing” means dwelling units offered only to households with incomes of 80 percent or less of the area median income, as defined in ORS 456.270; and, for dwelling units offered for rent, monthly rent and utilities constitute no more than 30% of the gross annual household income for households with incomes of 80% or less of the area median income, as defined in ORS 456.270, or for dwelling units offered for sale, housing that is sold for a price that will allow for a monthly mortgage payment, including any secondary financing, that constitute no more than 30% of the gross annual household income for households with incomes of 80% or less of the area median income, as defined in ORS 456.270.

Uses other than Affordable Housing with an Education Priority are permitted only if Affordable Housing with an Education Priority is provided at a density of at least nine units per acre. “Affordable Housing” means dwelling units offered only to households with incomes of 80% or less of the area median income, as defined in ORS 456.270; and, for dwelling units offered for rent, monthly rent and utilities constitute no more than 30% of gross annual household income, or for dwelling units offered for sale, housing that is sold for a price that will allow for a monthly mortgage payment, including any secondary financing, that constitute no more than 30% of gross annual household income. “Education Priority” means housing made available, to the extent permitted by law, in a manner that gives a priority to households in which at least one individual is employed by an education provider, for dwelling units offered for rent, at the time of entry into a lease, or, for dwelling units offered for sale, at the time of closing of the sale, over other members of the public.

Affordable Housing Requirement. City has determined that the Project’s rental senior housing component and rental residential care component are not subject to the provisions of Albany Municipal Code section 20.40.030 (Inclusionary Housing) regarding development of new dwelling units, and City shall not impose an inclusionary housing in-lieu fee on the Project so long as the residential units in the Project remain all-rental.
