Age Discrimination Waiver. Employee and Employer each agree and expressly acknowledge that this Separation and Release Agreement includes a waiver and release of all claims which Employee has or may have under the Age Discrimination in Employment Act of 1967, as amended, 29 U.S.C. § 621, et seq. (“ADEA”), which prohibits discrimination on the basis of age and prohibits retaliation. The following terms and conditions apply to and are part of the waiver and release of ADEA claims under this Separation and Release Agreement, and Employee understands and acknowledges that: (a) This Agreement is in writing in a manner that is understandable to Employee and Employee has read and fully understands this Agreement. (b) Employee is advised to consult an attorney before signing this Agreement. (c) The waiver and release of claims under the ADEA contained in this Separation and Release Agreement does not cover rights or claims that may arise after the date on which Employee signs this Agreement. (d) In exchange for signing this Agreement, Employee is receiving valuable consideration in the form of, inter alia, Separation Payment and a month of coverage under Employer’s group health benefit plan(s), as described in Paragraphs 3 and 4(b) of this Agreement, and such consideration is not something Employee would otherwise be entitled to receive unless Employee signs this Agreement. (e) Employee has Twenty-One (21) days after Employee is presented with this Agreement to decide whether to sign this Agreement. If Employee elects to sign this Agreement prior to the expiration of the 21-day period, Employee agrees that Employee has made the decision to forego the remaining 21-day consideration period voluntarily and with full understanding of Employee’s right to utilize the entire 21-day period. Employee agrees that changes to this Agreement, whether material or immaterial, do not restart this 21-day period. Once executed, the Agreement must be promptly returned to Xxxxxxx Xxxxxxxx, Manager, Human Resources; xxxxxxxxx@xxxxxxxxxxxx.xxx. (f) Employee will have the right to revoke this Agreement within seven (7) days of signing this Agreement. In order to revoke this Agreement, Employee must submit written notice of Employee’s revocation to Xxxxxxx Xxxxxxxx, Manager, Human Resources xxxxxxxxx@xxxxxxxxxxxx.xxx, such that the notice is received by said person before the expiration of the seven (7) day revocation period. (g) In the event of timely revocation of the Agreement, this Agreement shall be cancelled...

Age Discrimination Waiver. With respect to the waiver of the Employee’s rights under the Age Discrimination in Employment Act, the Employee acknowledges that he is aware of and understands the following rights under the Older Workers Benefit Protection Act: a. The Employee should consult an attorney before executing the waiver herein of his rights under the Age Discrimination in Employment Act; b. The Employee has at least forty-five (45) days within which to consider the waiver of his rights herein under the Age Discrimination in Employment Act; and c. For a period of seven (7) days following the execution of this waiver of rights under the Age Discrimination in Employment Act, the Employee can revoke the Agreement by providing written notice of such revocation to Sunrise’s Senior Vice President of Human Resources, or his successor. This Agreement shall not become effective or enforceable until the seven (7) day revocation period has expired. d. Sunrise has provided to the Employee the ages and job titles of all other employees whose positions, like his, are being eliminated subject to a group termination program. Sunrise also has provided to the Employee the ages and job titles of all other employees within the relevant organizational unit. All of those employees are subject to the group termination program. Sunrise has provided to the Employee the eligibility factors and time limits applicable to the group termination program.
Age Discrimination Waiver. Executive acknowledges that this Agreement includes a release and waiver of any and all claims of age discrimination that Executive may have under the Age Discrimination in Employment Act (“ADEA”) and the Older WorkersBenefit Protection Act. Executive understands that he is not releasing any ADEA claims that arise after Executive signs this Agreement. Further, Executive agrees to the following terms with respect to the waiver of potential age discrimination claims:

For a period of seven (7) days following the execution of the above waiver of rights under the Age Discrimination in Employment Act, the Employee can revoke the Agreement by providing written notice of such revocation to Sunrise’s Senior Vice President of Human Resources, or his successor, together with any payments made under this Agreement by Sunrise. This Agreement shall not become effective or enforceable until the seven (7) day revocation period has expired.
Age Discrimination Waiver. Munsxxxx xxxnowledges that his release set forth in this Section 4 waives any rights he may have under the Age Discrimination in Employment Act of 1967 and related laws, that his release is knowing and voluntary, that he may take 21 days to consider this Agreement (which can be waived by earlier execution of this Agreement), and that he has been advised to consult with an attorney prior to executing this Agreement. Munsxxxx xxxther acknowledges that he understands he may revoke this Agreement within seven days after his execution of it and that the provisions in this Agreement, if not revoked in writing within the seven-day period, will be effective at the end of that time.
Age Discrimination Waiver. In exchange for a portion of the payments described in this Release, Employee hereby knowingly and voluntarily waives and releases all rights and claims, known and unknown, arising under the Age Discrimination in Employment Act of 1967, 290 U.S.C. §621-634, as amended, and the Older Workers Benefit Protection Act, which Employee might otherwise have had against any and all of the Released Parties regarding any aspect of employment with Company up to and including the separation from employment and signing this Release.
