Annual Verification. No later than February 1st of each year, beginning in the year following the first year of occupancy of the Property, Owner shall submit a written statement to the Town including the following information and stating that such information is true and correct to the best of Owner's knowledge and belief:
a. Evidence to establish that the Property was occupied by a Qualified Household during all of the prior calendar year;
b. If applicable, a copy of the lease form currently used for the Property; and
c. If applicable, a list of tenants who occupied the Property in the prior calendar year and the evidence submitted by each tenant to establish that they were a Qualified Resident, as set forth in the Qualification Guidelines.
Annual Verification. Within ninety (90) days of the close of each calendar year, Diomed will provide the Doctor with an annual report of the number of Products sold in the immediately preceding calendar year, verified by Diomed's auditors. The Doctor and/or the LLC shall have the right to audit Diomed's books and records related to the transactions contemplated under this Agreement. In addition to any other sums that may be owing to the Doctor and/or the LLC as a result of such audit, Diomed shall be responsible for the cost of such audit in the event a discrepancy of five percent (5%) of more is documented by the Doctor's and/or LLC's auditor.
Annual Verification. On an annual basis, the Contractor shall submit verification to the Contracting Officer that the IT Security Plan remains valid.
Annual Verification. No later than April 15th of each year, beginning in the year following the first year of occupancy of the Property, Sellers shall submit a written statement to Buyer including the following information and stating that such information is true and correct to the best of Sellers’ knowledge and belief:
a. Evidence to establish that the Property was occupied by a Qualified Household during all of the prior calendar year;
b. If applicable, a copy of the lease currently used for the Property;
c. If applicable, a list of tenants who occupied the Property in the prior calendar year and evidence that at least one tenant is a Qualified Resident, as set forth in the Qualification Guidelines; and
d. Federal Income Tax Documents for Sellers, or Sellers’ tenant if the tenant is identified as the Qualified Resident. Federal Income Tax Documents may include Internal Revenue Service Form 1040, applicable schedules, W2s, and 1099s. In the event the tenant is identified as the Qualified Resident, Sellers shall require the tenant to fill out an Internal Revenue Service Form 8821 Tax Information Authorization. In the event Sellers do not provide the annual verification information required in this Section 6 to Buyer, Sellers shall be subject to the following fines for each year of noncompliance with this Section 6. Tax Day (typically April 15th) $250 June 1st $500 For Extension: six months from Tax Day $250 For Extension: December 1st $500
Annual Verification. Thermopompes N&R Sol Inc will provide one (1) annual inspection during normal business hours, for each equipment covered, and this, according to common industry practices. Should a service call be needed prior to the annual inspection, the following shall be done during the service call.
Annual Verification. No later than January 15 of each year beginning the year after the District has issued a final occupancy permit for all of the Dwelling Units in the Apartment Building the Owner will provide to the District a written statement of the Owner confirming the occupancy of every Rental Unit on the Land complies with section 2.1, above.
Annual Verification. At least annually the City may require the employee to verify his/her dependent status in writing to ensure that the City is contributing the appropriate amount toward health and dental insurance premiums, and Flexible Benefits Plan options. The City will use the PERS definition of the term “dependent.” The City reserves the right to conduct random checks of dependent status.
Annual Verification. Licensee shall verify each year that each participating school, club or other entity is fully insured to protect Licensee and Licensor from liability for operation of the Program.
Annual Verification. During the month of June, annually, each Unit C member will receive a contract letter indicating salary, sick days, personal days, and vacation days.
Annual Verification. No later than June 1st of each year, beginning in the year following the first occupancy of the Development, Owner shall submit or cause to be submitted by Owner’s authorized representatives or agents, including, but not limited to, a property manager or qualified auditor engaged by Owner, to the Town for each Qualified Resident or Qualified Household occupied Workforce Housing Unit, as well as for the Development generally, the following information, which information shall be certified by each such tenant to be true and correct:
a. Evidence to establish to the Town’s reasonable satisfaction that the required Dwelling Unit is leased to and occupied by only a Qualified Resident or Qualified Household, including documentation showing how the Owner applied the Guidelines to qualify the tenant(s) named on the Dwelling Unit’s lease as a Qualified Resident or Qualified Household for new leases and any renewing leases.
b. A copy of the lease form currently used to lease Dwelling Units and the current rent roll for the property listing the names of each tenant and the Dwelling Unit in which the tenants reside.
c. Proof of Owner’s annual calculation of the applicable annual income restriction at 120% or less of the AMI as published annually by the Colorado Housing and Finance Authority for Xxxxxxxxx County, which is inclusive of the cost of utilities, in accordance with Section 3 of the Guidelines.
d. Proof of the Workforce Housing Unit’s maximum rental rate, as specified in Section 6 herein, as based on the Qualified Resident’s or Qualified Household’s income in accordance with Section 3 of the Guidelines.
e. Proof of insurance for the Development providing for such coverages, and in such amounts, as determined by Owner in its commercially reasonable judgment.
