Equipment Covered. 2.1 This Voluntary Agreement covers the following types of SNE for residential use in the United States: Broadband Modems, Integrated Access Devices (IADs), and Local Network Equipment, as defined in Annex 1.
2.2 This Voluntary Agreement has no retroactive effect on equipment that is Sold, Purchased, deployed, or in inventory prior to January 1, 2015. In addition, the commitments of Section 3 have no retroactive effect on equipment that is Sold, Purchased, deployed, or in inventory prior to January 1, 2016. There is no requirement to retire or change existing equipment or to change existing equipment that is returned to a Service Provider and refurbished, repaired, and/or upgraded, and then redeployed. SNE that is returned from a retail channel to a Vendor and refurbished, repaired, and/or Sold shall be deemed to have been manufactured and Sold on its original date of manufacture and Sale.
Equipment Covered. 2.1. This Voluntary Agreement covers only new Set-Top Boxes, as defined in Annex 1, ordered and placed into service in the United States by a Service Provider after the Effective Date. There is no retroactive effect on equipment that is deployed or in inventory prior to the Effective Date, nor is there any requirement to retire or change existing equipment or to change existing equipment that is returned to the Service Provider and refurbished, repaired, and/or upgraded, and then redeployed
2.2. The Signatories will consider modifications to the definition of Set-Top Box in Annex 1 in the event that a new type of Service Provider-supplied equipment that uses a customer’s electricity to deliver residential multichannel video services represents a materially significant amount of energy use.
Equipment Covered. ABB Distributed Control Systems, Services include: ABB Ability Performance Optimization for control loops, LV Drives, QCS Grade Change Improvement and Paper Machine Fingerprint
Equipment Covered. 4.1 The equipment initially covered by this agreement is listed in Section 5 of the Order.
4.2 Microminder will send to the customer a copy of the schedule of equipment covered (Equipment Schedule) when the customer wishes either to add or remove items of equipment from cover. The customer should check the Equipment Schedule carefully to ensure that it is accurate, as Microminder shall charge fees, in addition to the charges, at Microminder’s then current standard time and materials charging rates for any item of equipment for which the customer has requested service that is not included in the Equipment Schedule.
4.3 If the customer wishes to include an additional item of equipment supported, it shall notify Microminder in writing of that fact. Microminder shall add it to the Equipment Schedule after an inspection (inspection) of such equipment and the customer shall pay Microminder’s cost of the inspection. If the inspection reveals any problems, these will need to be rectified on a chargeable basis before the equipment will be accepted by Microminder and added to the equipment schedule.
4.4 Microminder may, in its sole discretion, remove any item from the Equipment Schedule if, in Microminder’s reasonable opinion, the item of equipment is no longer economic to support or spare parts for the item of equipment are no longer available.
Equipment Covered. For purposes of this Agreement, the Network shall include all locations as outlined in the LOCATIONS section of your Agreement. Any additional critical devices added to the Network without the consent or acknowledgement of CCTG will not be honored or supported by CCTG under this Agreement. CCTG reserves the right to renegotiate rates based on additions of locations, hardware, software, hardware support requirements, and or services as well as modify this Agreement (or any portion thereof) with a 30-day notice. The Customer will designate a managerial level representative to authorize all Network Support Services as outlined in your Agreement. Whenever possible that representative shall be present whenever a CCTG’s service representative is on-site.
Equipment Covered. The parties agree that the following list is defined as “Heavy Equipment ” for the purposes of the additional compensation at the rates specified below for bargaining unit employees for the time spent operating the equipment. Equipment Covered. 5.1 Equipment Covered Customer’s fleet of Engines covered under this Agreement as of the Effective Date are identified in Exhibit B, which may be amended from time to time to incorporate addition or removal of Engines from the Agreement.
